SPECIAL SESSION (10:00 a.m.) CALL TO ORDER INVOCATION AND PLEDGES - U.S. Flag and Texas Flag: Honor the Texas Flag. I pledge allegiance to thee, Texas, one state, under God, one, and indivisible. Test 1. CITY COUNCIL/MAYOR/CITY MANAGER a. Consider Canvassing the returns of the Municipal Runoff Election held on the 13th Day of December 2025, for the purpose of electing a Ward One Councilmember; Declaring the results of the Runoff Election of the City of Huntsville. Kristy Doll, City Secretary ADJOURNMENT *If during the course of the meeting and discussion of any items covered by this notice, City Council determines that a Closed or Executive session of the Council is required, then such closed meeting will be held as authorized by Texas Government Code, Chapter 551, Section 551.071 – consultation with counsel on legal matters; 551.072 – deliberation regarding purchase, exchange, lease or value of real property; 551.073 – deliberation regarding a prospective gift; 551.074 – personnel matters regarding the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee; 551.076 – implementation of security personnel or devices; 551.087 – deliberation regarding economic development negotiation; Sec. 551.089 - deliberation regarding security devices or security audits; and/or other matters as authorized under the Texas Government Code. If a Closed or Executive session is held in accordance with the Texas Government Code as set out above, the City Council will reconvene in Open Session to take action, if necessary, on the items addressed during Executive Session. Kristy Doll, City Secretary 2 TAKEN DOWN: ORDINANCE NO. 2025 - 42 AN ORDINANCE CANVASSING THE RETURNS OF THE MUNICIPAL RUNOFF ELECTION HELD WITHIN THE CITY OF HUNTSVILLE ON THE 13TH DAY OF DECEMBER 2025, FOR THE PURPOSE OF ELECTING A WARD ONE COUNCILMEMBER; DECLARING THE RESULTS OF THE RUNOFF ELECTION OF THE CITY OF HUNTSVILLE, TEXAS; FINDING THAT NOTICE OF THE ELECTION WAS DULY AND PROPERLY GIVEN, THAT THE ELECTION WAS PROPERLY HELD AND RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE. WHEREAS pursuant to Texas Election Code Chapter 67 and Section 6.06 of the Charter of the City of Huntsville, the City Council, at a special meeting held on the 19th day of December 2025, proceeded to canvass the returns of the Runoff Election held in the City on the 13th day of December 2025, for the purpose of electing a Ward One Councilmember; and WHEREAS the election was held under and pursuant to the provisions of Ordinance No. 2025- 35, calling the Runoff Election; and WHEREAS the election has been duly and regularly held as called in the Ordinance and according to law, and the returns thereof having been made and the election judges having certified the results of the election, as hereinafter set out, and the City Council having duly and regularly canvassed the returns of the election and finding that the total votes cast at the election was as follows: COUNCILMEMBER WARD ONE Total Ballots Cast 122 TORE FOSSUM 77 63.64% RICK BOEHNING 44 36.36% Total Votes Cast 121 100% WHEREAS the City Council of the City of Huntsville finds that the election returns set out above to be accurate and correct. No election protest or contest has been filed with the Council or instituted in connection with the election returns. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Tore Fossum received a majority of the votes cast at the election for the office of Councilmember Ward One, and accordingly, Tore Fossum is declared elected to the office of Councilmember Ward One, subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. SECTION 2: City Council finds that the notice of the election was duly and properly given as required by law and as provided in the ordinance calling the election, and that the election was duly and regularly held, and the returns thereof duly and regularly made by the proper officials of the election, and in all things according to the law. SECTION 3: Attached hereto and incorporated herein for all purposes are: Exhibit A Report on Election Returns Certifying the Election Returns to the City of Huntsville for the December 13, 2025, Runoff Election Exhibit B Final Unofficial Summary Results for the December 13, 2025, Runoff Election Exhibit C Precinct by Precinct Election Report for the December 13, 2025, Runoff Election SECTION 4: This ordinance shall take effect immediately upon its passage.
