A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE AUTHORIZING AN AGREEMENT TO CONTRIBUTE
FUNDS FOR PARTICIPATION WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR 10% OF THE COST TO RELOCATE UTILITIES
RELATED TO THE HIGHWAY 30 OVERPASS WIDENING PROJECT.
WHEREAS, the Texas Department of Transportation has previously requested the City of
Huntsville (City) to enter into a contractual agreement and adjust utilities for the highway project
on SH 30 from 700 feet West of IH 45 Frontage Road at SH 30 to 700 feet East of IH 45 Frontage
Road at SH 30; and
WHEREAS, the city desires to voluntarily contribute to the State funds equal to ten (10)
percent of the cost of the adjustment of said Utilities for the proper development and construction
of the project; and
WHEREAS, the completion of the improvement to SH 30 is crucial to the enhancement of
circulation and safety; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntsville, Texas, that:
SECTION 1: The City of Huntsville, Texas, accepts responsibility for ten (10) percent of
the cost of said Utilities which is currently estimated at $100,000.00 for the improvement of SH 30
from 700 feet West of IH 45 Frontage Road at SH 39 to 700 feet East of IH 45 Frontage Road at SH
30. The Texas Department of Transportation will be responsible for adjusting all utilities for project.
Utility adjustment procedures will be in accordance with policies of the Texas Department of
Transportation and with applicable Federal and State laws governing the acquisition policies for
acquiring real property. The Mayor is hereby authorized to execute an agreement with the Texas
Department of Transportation on behalf of the City of Huntsville.
SECTION 2: This resolution shall be effective immediately upon adoption.
