RESO 2007-07 - Dedication of 0.5 ac. of Eastham-Thomason park as wetlands, as required by TPWDRESOLUTION NO. 2007 -07
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, DEDICATING
0.500 ACRES OF PARKLAND IN THE EASTHAM - THOMASON PARK AS WETLAND SPACE FOR
PERPETUITY, AS REQUIRED BY THE TEXAS PARKS AND WILDLIFE DEPARTMENT;
APPROVING THE TERMS AND CONDITIONS OF THE AGREEMENT; AUTHORIZING ITS
EXECUTION BY THE CITY SECRETARY AND MAYOR; REPEALING ALL RESOLUTIONS IN
CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Huntsville City Council desires to provide quality park facilities for the
residents of Huntsville; and
WHEREAS, the City of Huntsville has obtained a grant from the Texas Parks and Wildlife
Department for the development of a community park and desires to comply with all of the
requirements set forth in the grant.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS THAT;
SECTION 1. In order to fulfill the requirements of the Texas Parks and Wildlife Department's
grant to the City of Huntsville, the City Council of Huntsville, Texas hereby designates 0.500 acres of
parkland in the Eastham- Thomason Park for wetlands, said wetlands being more particularly
described in Exhibit "A" attached hereto and incorporated herein by reference as if set out verbatim.
SECTION 2. The Mayor of the City of Huntsville, along with the City Secretary, are hereby
authorized to execute the appropriate documents approving the terms and conditions of the
agreement with the Texas Parks and Wildlife Department.
SECTION 3. Any prior Resolution of the City Council in conflict with the provisions contained in
this Resolution are hereby repealed and revoked.
SECTION 4. Should any part of this Resolution be held to be invalid for any reason, the
remainder shall not be affected thereby, and such remaining portions are hereby declared to be
severable.
SECTION 5. This Resolution shall take effect immediately from and after its passage and it is
so duly resolved.

I, Leonard E. Woods, Registered Professional Land Surveyor No. 2524, do hereby certify that the
following field notes represent a survey made on the ground of the following described tract or parcel of
land located in Walker County, Texas. Coordinates and bearings herein are referred to the Texas
Coordinate System of 1983, Central Zone and are based on the position of National Geodetic Survey
(formerly known as the U. S. Coast & Geodetic Survey) Primary Airport Control Station (PACS)
monument designated "T39 A" having published NAD 83 (1993) coordinates of N= 3,128,437.762 meters
and E= 1,154,289.433 meters. Distances herein are U. S. Survey Feet in "Grid" units and may be
converted to "Geodetic Horizontal" by dividing by a combined scale factor of 0.99988.
Being a 0.500 acre tract or parcel, situated in the PLEASANT GRAY LEAGUE, Abstract No. 24,
Walker County, Texas, and being out of and a part of a called 5.71 acre tract described in a Deed from
Michael P. Breston to the City of Huntsville, Texas dated July 27, 2007, recorded in Volume 818, page
678, Official Public Records of Walker County, Texas, said 0.500 acre tract being also encompasses
portions of Lots 18, 19, 20 and 21 of the Susie Barnes Subdivision recorded in Volume 117, page 149,
Deed Records of Walker County, Texas, said 0.500 acre being more particularity described by metes and
bounds as follows;
COMMENCING, for reference only, at the northeast corner of said City of Huntsville 5.71 acre
tract and of said Susie Barnes Subdivision, found a 5/8" iron rod for corner with an aluminum cap
stamped "Murray & Moorer, Inc" in the westerly edge of a City - maintained roadway known locally as
Smith Hill Road, having coordinates of N= 10,263,999.62 feet and E= 3,794,252.13 feet, said
commencing corner being also in the most easterly south line of a called 1401 acre tract described in a
Deed to the State of Texas recorded in Volume Y, page 181, Deed Records;
THENCE S 36 °25' 17 "W, a distance of 64.28 feet to the POINT OF BEGINNING, set a 1 /2" iron
rod with aluminum cap within said City of Huntsville 5.71 acre tract for the northeast corner of the herein
described 0.500 acre tract;
THENCE S 00 °34'39 "E, a distance of 47.54 feet to a 1/2" iron rod with aluminum cap set for the
Point of Curvature of a curve to the right having a Radius of 185.00 feet, a Central Angle of 17 °21'44"
and a Long Chord of S 08°06'13"W- 55.85 feet;
THENCE along said curve to the right, an arc distance of 56.06 feet to a Y2" iron rod with
aluminum cap set for corner;
THENCE S 83 °07'42 "W, at 136.00 feet pass the northeast corner of a 40 foot wide strip labeled
"STREET" on said Plat of Susie Barnes Subdivision, continuing along the north line of said 40 foot wide
strip, a total distance of 191.07 feet to a 1/2" iron rod with aluminum cap set for corner;
THENCE N 02 °31'07 "W, a distance of 116.91 feet to a %2" iron rod with aluminum cap set for the
northwest corner of the herein described 0.500 acre tract;
THENCE N 87 °28'53 "E, a distance of 202.42 feet to the POINT OF BEGINNING.
