RESO 2009-01A - Tejas Housing LP, Senior Villages, The Villages of Huntsville, Essex Blvd.
RESOLUTION NO. 2009-01 RESOLUTION IN SUPPORT OF "THE SENIOR VILLAGES" COMMUNITY WHEREAS, Tejas Housing LP proposes to build an affordable Senior Villages Community, on Lot 4 of "The Villages of Huntsville" consisting of 7.8654 acres located on Essex Boulevard in Huntsville, Texas, and WHEREAS, The "The Senior Villages" community will be comprised of a community center building containing on -site management offices, residential activity areas, as well as 36 units; WHEREAS, The Senior Villages community will consist of one and two bedroom units, which will be beneficial to seniors whose income is below the county's median income level in the City of Huntsville; and WHEREAS, Tejas Housing LP development application for the "Senior Villages" community will be submitted in the Texas Department of Housing & Community Affairs' 2009 tax credit round for Region 3. WHEREAS, Because of Texas Department of Housing & Community Affairs' housing need high score and the strong demand for affordable senior housing in the City of Huntsville, this development should be supported by the City Council. WHEREAS, "The Senior Villages" will become a member of the community of Huntsville and will pay all city and county taxes. WHEREAS, The Senior Villages community will need a financial commitment of at least $255,000.00 from the City of Huntsville to be utilized as leverage as defined in the 2009 Qualified Allocation Plan for Low Income Housing Tax Credits in the State of Texas. The financial commitment will allow Senior Villages community to score high points. WHEREAS, The City of Huntsville will agree to waive permit fees, tap fees and required infrastructure improvements up to the maximum amount of $ 255,054 as follows; Water Taps $ 19,800 (waiver) Wastewater Taps $ 22,500 (waiver) Building & Public Improvement Permits $ 16,290 (waiver) Street Extension Requirements $ 196,464 (waiver) Total $ 255,054 WHEREAS, The City Council of Huntsville agrees to support a plan of action to facilitate a financial commitment to reach said goal. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE: That the City Council finds that Tejas Housing L P. has the historical experience in developing high quality affordable communities for the City of Huntsville. BE IT FURTHER RESOLVED That the City Council offers its full support to the proposed "Senior Villages" community, including the aforementioned financial commitment. In addition, the City Council supports the efforts to receive an allocation from the Texas Department of Housing and Community Affairs for Low Income Housing Tax Credits in 2009. Per our discussions Tejas Housing has agreed to the following: The parcel of land shown on The Villages of Huntsville plat as reserve "A" (4.267 acres) on the map enclosed is proposed to be exchanged (deed to HISD by Lone Star L P) with the Huntsville ISD. For the parcel shown on the attached map as property "B" (a portion of 2.101 acres) the HISD would exchange (deed to Lone Star L P by HISD). The HISD would grant (by deed) the parcel shown as proposed R.O.W. (.409 acres) on the attached map to the City of Huntsville. The City of Huntsville would vacate the existing R.O.W. (.353 acres) as shown on the attached map. The City of Huntsville would agree to waive Section 17 paragraphs provision that requires all public improvements to be developed on Essex Blvd. before lot 4 (of the "The Villages of Huntsville" plat) could be developed. The City would allow Tejas Housing or successor owners to develop Lot 4 along with the necessary Public Improvements for the proposed seniors' development The City of Huntsville would agree to support the attached Local Support Resolution in a similar form (final form to be approved by the City Attorney) for Tejas Housing Seniors development in 2009 and future years if necessary to receive an allocation of Tax Credits.
