ORD 1981-47 - Amend Ch 12 Trafficd • : • ORDINANCE NO. 81- 47 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY THE AMENDMENT OF CHAPTER, "MOTOR VEHICLES AND TRAFFIC;" REPEALING CHAPTER 12 AS PRESENTLY CONSTITUTED AND ADOPTING A NEW CHAPTER 12, "MOTOR VEHICLES AND TRAFFIC;" PROVIDING AUTHORITY TO REGULATE VEHICLES AND TRAFFIC; ESTAB- LISHING TRAFFIC CONTROL DEVICES; ADOPTING SPEED REGULATIONS; REQUIRING ACCIDENT REPORTS; REGULATING STOPPING, STANDING, AND PARKING OF VEHICLES; REGULATING TRAFFIC GENERALLY; PROVID- ING A PENALTY; REPEALING INCONSISTENT ORDINANCES; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; ESTABLISHING AN EFFECTIVE DATE; AND MAKING OTHER PROVISIONS RELATED THERETO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILIE, TEXAS: Section 1: That the Code of Ordinances of the City of Huntsville, Texas, is hereby amended by the repeal of Chapter 12, Motor Vehicles and Traffic," and by the adoption of a new Chapter 12, "Motor Vehicles and Traffic," that shall read as follows, to -wit: (See Exhibit "A ", attached hereto and made a part hereof for all intents and purposes.) Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: Any person, firm or corporation who shall violate any of the provisions of this Chapter, or who shall fail to comply with same shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not exceeding two hundred dollars ($200.00). Each day an offense is committed shall constitute a separate offense. Section 4: If any provision or part of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to the end all provisions of this ordinance are declared to be severable. Section 5: This ordinance shall take effect from and after ten (10) days from its publication. The City Secretary is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the City's official newspaper at least once within twenty (20) days after its final passage by City Council. Junked Vehicles. Chaper 12 MOTOR VEHICLES AND TRAFFIC ARTICLE I. IN GENERAL Sec. 12.01 Definitions. • (a) The words and phrases shall have the following meanings: (1) Curb zone. Any area immediately adjacent and parallel to the edge of a roadway, curb, or a sidewalk of a public street or a public traffic area where its use is reserved for a traffic control purpose. (2) Holiday. New Year's Day, Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas Eve or Christmas Day. (3) Left turn. The making of a left turn from the direction being traveled of a vehicle into a cross intersection by the operator thereof. (4) Limit line. Boundaries of parking areas, loading zones, safety or danger zones, crosswalks and lines marked for purposes of excluding traffic and parking. (5) Load. The material, equipment or other property placed upon or attached to a vehicle or within a cavity of a vehicle. (6) Loading zone. A curb zone designated for the exclusive use of vehicles loading or unloading property. (7) No turn. The making of a no turn from the direction being traveled of a vehicle into a cross intersection by the operator thereof. (8) One -way street. Any public street, avenue, alley, or way, or a section or portion thereof, on and over which all vehicles shall lawfully travel in only one and the same direction. (9) Owner. Any person who holds the legal title of a vehicle or who has the legal right of possession or control thereof. (10) Public traffic area. Public property, roads owned and controlled by a water control and improvement district; and private property commonly used by the public, such as supermarket, hospital, or shopping center parking lots; parking areas provided by business establishment for the convenience of their customers, clients or patrons; parking lots owned and operated by the State of Texas or the City of Huntsville; or any other parking area owned and operated for the convenience of and commonly used by the public, excluding privately owned residential parking area or privately owned parking lots where a fee is charged for the privilege of parking or storing a motor vehicle. (11) Right turn. The making of a right turn from the direction being traveled of a vehicle into a cross intersection by the operator thereof. (12) Traffic sign. Any block, sign or obstruction placed at the inter- section of streets to indicate the point where traffic should move, any safety zone sign or marker, reserved or no parking sign, and any other sign, mark or instrumentality used for the purpose of regulating and directing traffic. (13) U -turn. To turn a vehicle, bicycle or motor - assisted bicycle so as to proceed in the opposite direction upon a public street or any turning of a vehicle, bicycle or motor - assisted bicycle, at one point, which results in a reversal of direction, at another point, upon parallel lines with a public street. (b) Unless a different definition is required by this chapter, the definitions contained in the Texas Uniform Act Regulating Traffic or Highways (Art- icle 6701d, Vernon's Texas Civil Statutes)or the Texas Penal Code shall apply. The definition of a term applies to each grammatical variation of the term. Sec. 12.02 Rules of Construction. The Texas Penal Code applies to the construction of this chapter, except as it might apply to the use of general presumption, defenses, culpability, or penalty clauses. Sec. 12.03 Culpable Mental State Not Required. Unless otherwise stated in the definition of an offense in this Chapter, a culpable mental state is not required as an element of such offense. Sec. 12.04 General Penalty Clause. An offense under this Chapter for which another penalty is not provided is a misdemeanor punishable by a fine of not less than $1 nor more than $200; except that minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than $100. • • ARTICLE II. AUTHORITY TO REGULATE VEHICLES AND TRAFFIC Sec. 12 -10 Statutory Authority. By authority of Article 6701d (Vernon's Texas Civil Statutes), the City of Huntsville, with respect to streets and highways and other public traffic areas within its jurisdiction and within the reasonable exercise of its police power, hereby ordains this Chapter: (a) regulating the stopping, standing and parking of vehicles, bicycles and motor - assisted bicycles; (b) regulating traffic by means of police officer and traffic control devices deemed necessary to indicate and carry out the provisions of Article 6701d or this Chapter or to regulate, warn or otherwise guide traffic; (c) regulating processions and assemblages on streets or highways; (d) designation of particular streets as one -way streets and requiring that all vehicles, bicycles or motor - assisted bicycles thereon be moved in one specific direction; (e) regulating the speed of vehicles in public parks; (f) designating particular streets as through streets and requiring that all vehicles, bicycles or motor - assisted bicycles stop and /or yield the right -of -way before entering or crossing same, and designating particular intersections and requiring all vehicles, bicycles and motor- assisted bicycles to stop and /or yield the right -of -way at one or more entrances to such intersection; (g) regulating the turning of vehicles, bicycles and motor - assisted bicycles or specified types of vehicles; (h) altering the maximum prima facie speed limits upon specific streets upon the basis of engineering and traffic investigations; (i) adopting and enforcing additional traffic regulations which are in conflict with Article 6701d where expressly authorized therein; (j) adopting and enforcing additional traffic regulations which are not in conflict with Article 6701d; (k) authorizing the investigation of certain accidents resulting in injury to or death of any person, or certain total property damage. • • Sec. 12 -11. Authority and Duties of the City Engineer: It shall be the duty of the City Engineer to: (a) Conduct investigations based upon engineering traffic considerations in order to recommend: (1) Maximum prima facie speed limits; (2) Installation, maintenance, or removal of traffic control duties; (3) Plans for street and public traffic area traffic flow; and (4) Remedial measures to prevent traffic accidents. (b) Make temporary or experimental traffic regulations for emergencies, special conditions or investigations with the approval of the City Manager to remain effective not to exceed ninety (90) days; (c) Install, maintain or remove traffic control devices and otherwise implement traffic plans pursuant to ordinances; (d) Cooperate with other city officials in the improvement of traffic conditions and traffic safety; (e) Carry out any additional duties imposed by ordinance. Sec. 12 -12. Authority and Duties of Police Department. It shall be the duty of the Police Department of the City of Huntsville and it is hereby authorized to enforce the provisions of this Chapter as well as all applicable laws of this state and to cooperate with other city officials to promote traffic safety. Sec. 12 -13. Authority and Duty to Keep Violations Records. The Municipal Court shall keep a record of each person's driving viola- tions for a period of at least five (5) years. ARTICLE III. TRAFFIC CONTROL DEVICES Sec, 12-20. Ratification of Existing Traffic Control Devices. All traffic control devices heretofore placed and currently maintained by the City of Huntsville are hereby individually noted and hereby affirmed, ratified and declared to be official traffic control devices of the City of Huntsville. Sec. 12-21. •Proof'of'Existence'of'Traffic Conttoi 'Devices ' ' Presumption. (a) In any prosecution authorized by this Chapter or Article 6701d (V.T.C.S.) or both, when proof is presented as to the existence of a traffic control device, in its proper place and visible by an ordinarily observant person upon any public street, such traffic control device shall be presumed to have been placed and maintained by competent authority of and a duly en- acted ordinance by the City of Huntsville. (b) Any person shall have the right to prove that such traffic control device was not properly authorized or installed. Sec. 12-22. Manual for Uniform Traffic Control Devices. "The Texas Manual on Uniform Traffic Control Devices for Streets and Highways, 1980" and amendments thereto, shall be the standard for a uniform system of traffic control devices upon streets within the City of Huntsville. All traffic control signs, signals and devices shall conform to the specifi- cation set forth in this manual. All traffic control devices so erected and not inconsistent with the Code of Ordinances shall be official traffic control devices. ARTICLE IV. SPEED REGULATIONS Sec. 12-30. Exceeding Reasonable and Prudent Speed. (a) A person commits an offense if he drives a vehicle upon a public street at a speed greater than is reasonable and prudent under the circumstances then existing. (b) If signs are present and visible upon such street designating a speed zone: (1) it shall be presumed that the signs were placed and maintained by competent authority of and a duly enacted ordinance by the City of Huntsville; and (2) proof of any speed in excess of the speed designated shall be prima facie evidence that the speed was not reasonable or prudent and that it is unlawful. (c) If no signs are present and visible upon such street designating a speed zone: (1) proof of any speed in excess of 30 miles per hour in an urban dis- trict, as defined in Article 6701d, sec. 166(a), shall be prima facie evidence that the speed was not reasonable or prudent and that it is unlawful; or • • (2) proof of any speed in excess of 55 miles per hour outside an urban district, as defined above, shall be prima facie evidence that the speed was not reasonable or prudent and that it is unlawful. ARTICLE V. ACCIDENTS Section 12.40. Reports of Accidents. (a) A person commits an offense if he drives a vehicle upon a public street or public traffic area and becomes involved in an accident resulting in total property damage to an apparent extent of Two Hundred Fifty Dollars ($250.00) or more and he fails to immediately give notice of such acci- dent to the Huntsville Police Department by the quickest means of com- munications available. (b) An officer of the City shall not investigate an accident unless it in- volves personal injury or death to a person, or total property damage to an apparent extent of more than $250.00. Sec. 12.41. Colliding with Parked or Stationary Objects. A person commits an offense if, while driving a vehicle, bicycle or motor - assisted bicycle, he collides with a parked vehicle, bicycle or motor - assisted bicycle or any stationary object upon or near a public roadway or a public traffic area. ARTICLE VI. STOPPING, STANDING AND PARKING Sec. 12.50. Proof of Ownership of Vehicle -- Presumption. In any prosecution authorized by this Article or the parking regulations of Article 6701d (V.T.C.S.) or both, when proof is presented as to the identity of the owner of a vehicle, such owner shall be presumed to have stopped, stood or parked such vehicle. Sec. 12.51. Parking Prohibited for Certain Vehicles and Purposes. (a) A person commits an offense if he stops, stands or parks upon a public street: (1) a commercial motor vehicle, truck tractor, trailer, or semi - trailer; (2) a vehicle for the purpose of repair, service, washing, or displaying it for sale. (b) It is an exception to the application of this sub- section (a) if: (1) the vehicle's manufacturers rated carrying capacity does not exceed two thousand pounds (3/4 ton or less). (2) the vehicle is parked for the purpose of loading or unloading merchandise, supplies and materials to or from a residence and the vehicle is removed from the street within one (1) hour; or (3) such vehicle is not attached to a trailer and is being used as a private passenger vehicle. (c) It shall be a defense to any prosecution of sub- section (a)(2) that such repair or service was necessitated by emergency and that the vehicle was removed from the street within one (1) hour after it became disabled. Sec. 12.52. Prohibited Curb Zone Parking. (a) A person commits an offense if he stops, stands or parks a vehicle, bicycle or motor - assisted bicycle in a curb zone: (1) for a period of time longer than is designated; (2) at a time prohibited by designation; (3) for any purpose other than that which is designated; or (4) at a place prohibited by designation. (b) It is an affirmative defense to any prosecution under Sub- section (a) (1) and (2) of this section if: (1) Such vehicle was owned by, driven by or in possession of the follow- ing designated individuals who are performing county, state or governmental business: (aa) Texas Rangers; (bb) Texas Game Wardens; (cc) Texas Department of Public Safety Officers (exempt tags); (dd) Texas Alcoholic and Beverage Commission officers; (ee) All sheriff officers (exempt tags); (ff) All Walker County justices of the peace; (gg) All City of Huntsville police and emergency officers (exempt tags); (hh) All United States units (exempt tags). (2) It was a Sunday or Holiday. • • Sec. 12.53. Designation of Parking Spaces; Manner of Parking. (a) The City Manager is hereby directed and authorized to mark off individual parking spaces in the parking zones designated pursuant Section 12.52(a) of this Chapter and in such other zones as may be hereafter established. The parking spaces shall be designated by lines painted or durably marked on the curbing or surface of the street. (b) A person commits an offense if he stops, stands or parks a vehicle, bi- cycle or motor - assisted bicycle in such a way that said vehicle is not entirely within the limits of the parking space so designated. Sec. 12.54. Prohibited Parking Upon Streets. A person commits an offense if he stops, stands or parks a vehicle, bicycle or motor- assisted bicycle upon a street: (1) so as to leave less than ten (10) feet in a moving lane of traffic; (2) when the left side of the vehicle is next to the curb, except on one -way streets; (3) in front of a public or private driveway. Sec. 12.55. Parking of trucks, trailers, etc. in restricted curb zone. (a) A person commits an offense if he stops, stands or parks a vehicle that has an overall length of nineteen (19) feet or more, or of any vehicle having a trailer attached thereto, in a two -hour parking curb zone. (b) A person commits an offense if he stops, stands or parks a vehicle that has an overall length of nineteen (19) feet or more at right angles to the curb line in a two -hour parking curb zone. (c) It is an affirmative defense to any prosecution under subsection (a)'that the vehicle operates under a commercial or farm license, parks for the purpose of loading or unloading of merchandise, supplies and materials to an adjacent business, occupies no more than two (2) parking spaces, parks for no time longer than necessary to expeditiously load or unload the merchandise, and parks no longer than fifteen (15) minutes. • • ARTICLE VII. REGULATION OF TRAFFIC GENERALLY Sec. 12.70. Truck Routes -- Certain Vehicles Prohibited from Operation Except on Designated Streets. (a) A person commits an offense if he drives a commercial motor vehicle upon a public street not designated a truck route. (b) It is an affirmative defense to any prosecution under this section if (1) such vehicle was being driven to or from home or to fulfill a local commercial obligation to a buyer or seller at a given destination, evidenced by a bill of sale or invoice, and such public street was not a substantial deviation from the shortest route between such home or destination and the nearest designated truck route; (2) Such vehicle is a bus or light truck. Sec. 12.71. Failure to Remove Hazardous Substance. A person commits an offense if he knowingly fails or refuses to immediately remove or cause to be removed from any public street, any substance, load or equipment which has fallen from vehicle he owns or drives or from real property under his control likely to interfere with traffic or pose a traffic hazard. Sec. 12.72. Removal of Traffic Hazards. (a) Any police officer who shall find a vehicle, boat, structure, object, substance or material stopped or resting upon a public street or public traffic area which, in the opinion of the officer, poses a particular hazard to the movement of traffic because of its proximity to or position upon a roadway, the lighting or weather conditions, its visibility or the density of traffic, or the nature of the traffic movement around or across such hazard, is authorized to be moved or cause the same to be removed at the owner's expense. (b) Any illegally stopped,parked or standing vehicle, bicycle or motor - assisted bicycle may be removed under the direction of any police officer at the owner's expense. Sec. 12.73. Obstruction of Public Rights -of -Way. (a) An owner or occupant of any premises commits an offense if he intention- ally or knowingly allows or permits any tree, shrub, vine, plant, lumber, boxes, posts or other objects of any description to be grown, cultivated or maintained in such a manner so that any portion overhangs, obtrudes, obstructs, or exists upon or over any public right -of -way in such a manner as to block the vision of the operator of a motor vehicle on a public street. • • (b) In any prosecution authorized by this section, it shall be presumed that the premises owner or occupant intentionally or knowingly committed the offense if the City E n g i n e.e r personally serves him with notice of the obstruction, or if ten days elapse after the City Engineer mails to him notice of the obstruction by regular U.S. mail without the condition being corrected. Sec. 12.74. Attempting to Board or Alight from Moving Vehicle Prohibited. (a) A person commits an offense if he knowingly attempts to board or alight from a moving vehicle. (b) It shall be a defense to any prosecution herein that such person was par- ticipating in a parade supervised by Huntsville Police Department. Sec. 12.75. Riding on Portion of Vehicle Not Intended for Passengers Prohibited. (a) A person commits an offense if he knowingly rides on any portion of a vehicle not intended for passengers. (b) It shall be a defense to any prosecution herein that (1) such person was within a cavity of such vehicle intended for carry- ing a load; or (2) such person was participating in a parade supervised by the Huntsville Police Department. Sec. 12.76. Prohibited U- Turns. A person commits an offense if, while driving a vehicle, bicycle, or motor - assisted bicycle upon a public street, he makes a U -turn: (a) not at an intersection; (b) where prohibited by sign; or (c) when such movement cannot be made with safety and without interference with other traffic. Sec. 12.77. Prohibited Turn Across Opposite Lane of Traffic to Park. A person commits an offense if, while driving a vehicle, bicycle, or motor - assisted bicycle upon a public street, he makes a turn across the opposite lane of traffic for the purpose of parking in spaces designed for, or accessible to traffic proceeding only from the opposite direction. • • Sec. 12.78. No Passing Zones. A person commits an offense if he drives a vehicle on the left side of any roadway within an area designated as a no passing zone. Sec. 12.79. Exceeding Weight Limit. A person commits an offense if he drives a vehicle which exceeds a desig- nated weight limit upon a public street or an area thereof. Sec. 12.80. Regulation of Ready -Mixed Concrete Vehicles. (a) A person commits an offense if he drives a vehicle transporting ready - mixed concrete upon a public street, and the vehicle either carries a tandem axle load that exceeds 41,000 pounds, a single axle load that exceeds 12,500 pounds, or a gross vehicle load that exceeds 53,500 pounds. (b) Any person, firm or corporation intending to operate a vehicle used ex- clusively to transport ready -mixed concrete on the streets and highways within the corporate limits of the City of Huntsville, with a tandem axle load in excess of thirty -four thousand (34,000) pounds, shall file with the City Secretary of the City of Huntsville a surety bond in favor of the City of Huntsville in the principal sum of $15,000.00, conditioned that the owner of such vehicles will pay to the City of Huntsville all . damages done to the streets and highways within the corporate limits of the said City of Huntsville by reason of the operation of such vehicle, or vehicles having a tandem axle load in excess of 34,000 pounds. The initial surety bond required under the provisions of this section shall be filed within ten (10) days after the effective date of this section if the owner of any such vehicles is operating same with loads in excess of 34,000 pounds. Any owner of such vehicles thereafter operating or commencing to operate such vehicles having a tandem axle load in excess of 34,000 pounds shall file said surety bond with the City Secretary prior to operation of such vehicles by said owner or his employees on such streets and highways. (c) Upon filing of the surety bond provided for in the above paragraph, the City Secretary shall record the number of such vehicles intended to be operated by each owner of same and which shall be covered by such surety bond. The City Secretary shall issue for each such vehicle an identification card, sticker or tag which shall be displayed on each such vehicle authorized to use the streets and highways within the cor- porate limits of the City of Huntsville with a tandem axle load in ex- cess of 34,000 pounds. (d) No owner of such vehicles shall operate, or allow to be operated, any such vehicles required by this section to be registered with the City Secretary until such registration has been made and the required surety • • bond tendered. Bonds shall be renewed annually for so long as the owner of such vehicles uses the public streets and highways within the City of Huntsville. The City Secretary shall be notified of vehicles deleted or added to the owner's fleet of vehicles covered by such surety bond. (e) A person commits an offense if he operates upon a public street a vehicle used exclusively for transportation of ready -mixed concrete without an invoice indicating the gross load of cement then in transport. Sec. 12.81. City Property Restricted. (a) A person commits an offense if he parks, leaves unattended, or drives a vehicle into or upon property owned and controlled by the City and re- stricted to use by authorized persons and vehicles only, without first obtaining permission to do so from the City Manager. (b) The City Manager is hereby authorized to restrict the use of city property to persons and vehicles authorized in writing by him to use such property. (c) All property of the City that has been restricted, either by the City Council or the City Manager, to use by authorized persons and vehicles only, shall be so designated by appropriate and conspicuous signs posted at all vehicular entrances thereto, and such signs shall advise that the property is restricted, and that the driver of any illegally parked or driven vehicle shall be subject to a fine up to $200. Sec. 12.82. Driving through Procession. A person commits an offense if he drives a vehicle so as to pass through or into or interfere with any civic, military, funeral or other authorized procession, except at the direction of a traffic officer. Purpose • • ARTICLE VIII SCHEDULES OF DESIGNATED STREETS AND ZONES REFERRED TO IN THIS CHAPTER The primary purpose of setting forth the following listed schedules is to enable the City to publish and issue the major Text of the Motor Vehicles and Traffic Ordinance (Chapter 12) as an entity and issue separately the schedules which commonly are revised or added to with great frequency. Technically the schedules are a part of the ordinances. The official record of all schedules is on file with the City Secretary, City Engineer, Municipal Court and Police Department. SCHEDULE I. DESIGNATION RESTRICTIVE TURN MOVEMENTS XII. DESIGNATION NO TRUCKS ALLOWED XIII. DESIGNATION NO PASSING ZONE • • ARTICLE IX. SPECIAL REGULATIONS AT SAM HOUSTON STATE UNIVERSITY Sec. 12.90. Authority granted to board of university; purposes. The governing board of Sam Houston State University is hereby granted and delegated jurisdiction and control of the parking lanes within the street portions described in section 12.91 hereof, which street portions abut property owned by the State of Texas and under the control of said Sam Houston State University, for the following purposes: (a) To assign parking spaces and designate parking areas and their use, and assess a charge therefor. (b) To prohibit parking as it deems necessary. (c) To remove vehicles parked in violation of its rules and regulations, Laws of the State of Texas, or ordinances of the City of Huntsville at the expense of the violator. (d) To issue traffic tickets in compliance with the procedure established by the Huntsville Municipal Court. (e) To enforce such regulations and traffic laws through its commissioned peace officers jointly with the City of Huntsville police officers. Sec. 12.91. Streets under university jurisdiction. (a) Sam Houston State University Campus Police shall in all things be vested with authority as peace officers to enforce the laws of the State of Texas and the City of Huntsville, Texas, within the said City of Huntsville, Texas, and specifically in the following defined areas: (1) Avenue J from 15th Street to 22nd Street (2) Avenue I from 16th Street to Avenue H, intersection. (3) Avenue H from 16th Street to Avenue I, intersection. (4) 17th Street from Avenue H to Avenue M. (5) Avenue 0 from 17th street to 19th Street. (6) 19th Street from Avenue M to Sam Houston Avenue. (7) Sam Houston Avenue from 17th Street to 22nd Street. (8) 22nd Street from Avenue J to Avenue N1. (9) College Farm Road from 22nd Street to Interstate 45. (14) Avenue K (University Avenue) from 15th Street to 17th Street. -14- C A • • (b) The City Council recognizes Sam Houston State University Campus Police as peace officers as that term is defined under the laws of the State of Texas and this section shall not be deemed to limit or otherwise diminish the authority of said peace officers as authorized by any statute of the State of Texas or any regulation issued by the board of regents of Sam Houston State University. Sec. 12 -92. Procedure upon arrests of violators. The procedure upon arrests of violators shall be as follows: (a) Whenever a person is arrested for any violation of a city ordinance or state law, and such person is not immediately taken before the judge of the municipal court, the arresting officer shall prepare in triplicate written notice to appear in the municipal court of the City of Huntsville, Texas, on a form approved by the city attorney, contain the name and ad- dress of such person, the license number of his vehicle, when and where such person shall appear in court, and any other information required by the city attorney; provided, however, that the offense of speeding shall be the only offense making mandatory the issuance of a written notice to appear in court and only then if the arrested person gives his written promise to appear in court by signing the written notice prepared by the arresting officer; and provided further, it shall not be mandatory for an officer to give a written notice to appear in court to any person arrested for the offense of speeding when such person is operating a vehicle licensed in a state or country other than the State of Texas or who is a resident of a state or country than the State of Texas. (b) The time specified in said notice to appear must be at least ten (10) days after the issuance unless the person arrested shall demand an earlier hearing. (c) The arrested person, in order to secure release as provided herein, must give his written promise to so appear in court by signing in triplicate the written notice prepared by the arresting officer. The original of said notice shall be retained by said officer and the first copy thereof delivered to the person arrested; thereupon said officer shall forthwith release the person arrested from custody. (d) Any person violating his written promise to appear before the municipal court, given as provided in this article is guilty of a misdemeanor re- gardless of the disposition of the charge upon which he was originally arrested, and upon conviction thereof shall be fined as provided in the Code of Ordinances. (ord. of 2- 22 -72) • • Sec. 12.93. Authority to direct traffic as conditions require. In case of fire, emergency or to expedite traffic, Sam Houston State University peace officers may direct traffic as conditions may require, and it shall be unlawful for any person to fail to comply with any lawful order or direction of any such officer. Sec. 12.94. Duty to obey traffic signs, signals and markings. (a) It shall be unlawful for the driver of any vehicle to disobey the instruc- tions of any traffic sign, signal or marking constructed, installed or painted within the area described in section 12.91 of this article, when same are authorized by the governing board of Sam Houston State University unless such driver is otherwise directed by a police officer. (b) All such traffic signs, signals or markings shall be deemed authorized by said governing board. Sec. 12.95. Preservation of university authority over personnel. Notwithstanding any of the provisions of this article, all officers com- missioned by the governing board of Sam Houston State University may be authorized and empowered by the saiyi board to enforce rules and regulations promulgated by it regarding its students and personnel. Nothing herein is intended to limit or restrict the authority of such institution to promul- gate and enforce appropriate rules and regulations for the orderly conduct of the institution in carrying out its purpose and objectives or the right of separate jurisdiction relating to the conduct of its students and personnel. Sec. 12.96. Preservation of police powers of city.
