A RESOLUTION OF THE CITY OF HUNTSVILLE, TEXAS, STATING THE DESIRE
OF THE CITY COUNCIL THAT THE HUNTSVILLE PLANNING AND ZONING
COMMISSION CONSISTENTLY INTERPRET THE BUILDING DEVELOPMENT
CODE, AND FURTHER DESIRE THAT A HOUSING PRODUCT TYPE MATCHES
THE LOT TYPE ON WHICH IT IS TO BE BUILT.
WHEREAS, the Huntsville Development Code (hereinafter referred to as the Development Code or
the Code) states that in the interpretation and application of the Code, all provisions shall
be liberally construed in favor of the City; and
WHEREAS, the Development Code states that all development or redevelopment shall comply fully
with the provisions of the Code and the standards contained therein and that such
compliance is a precondition for the issuance of any permits or approval of plats, public
improvements or private improvements within the City or its extraterritorial jurisdiction;
and
WHEREAS, the Development Code states that the Planning and Zoning Commission guides, through
the establishment of performance standards, the type, distribution, and intensity of
development; and
WHEREAS, the need has arisen for a rededication of the City and of the Planning and Zoning
Commission to both the spirit and the letter of the Development Code in its entirety;
WHEREAS, the Brookview Subdivision has excited controversy since submission of its preliminary
plat on account of perceived deviations from the Development Code, including, but not
limited to, absence of dedicated park land and open space; failure to provide
Homeowners' Association Rules at the time of submission of preliminary or final plats;
development built under row house standards but with more than 12 houses in a row (to
wit, 27); no 20 foot space between each of series of 12 homes; omission of a side street
setback of 25 feet; improper setbacks where water, sewer and drainage easements are
not next to streets; a continuing puzzle as to whether the development is classed as row
house or urban residential; and probably violation of sight triangle provision, and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS:
That the City Council is instructing staff to facilitate and to provide alternate dates to schedule a
joint meeting between the Council and the Planning and Zoning Commission (P &Z) for the
purpose of having the P &Z to recommend policies for guiding action affecting development in
the City and environs and to gather information necessary for drafting of ordinances and
regulations regarding the Development Code.
That the Purpose of the Joint Meeting is that the Huntsville Planning and Zoning Commission be
able to and do consistently interpret the Development Code, and that Housing Product Type
matches the lot type on which it is to be built.
That further the Huntsville City directs the Mayor to appoint a committee to investigate these
issues and report to the City Council by November 15, 2009 and before the Joint Meeting with
the Huntsville Planning and Zoning Commission.
PASSED, ADOPTED, AND APPROVED this 22nd day of September, 2009.

Honorable Mayor,Members of Huntsville City Council and City of Huntsville City Manager,
The offer of Jessie Bruce Powell and husband,Max F Powell,to contribute the sum of$10,000.
To the referenced project was tendered without restrictions. We stand ready,willing and able to
fund the offer.
We are sincerely pleased,however,that the city will consider our views in this matter and in that
spirit,our views,not mandates,are submitted as follows for your review and consideration:
1. We would appreciate the sign being very dignified and serving its purpose of
identifying the airport without a trace of advertising or commercialism..
2. We hope that the city will optimize the sign size, stability,workmanship(quality)and
material so as to use the entire donated amount of$10,000. If any funds are leftover,perhaps
they could be utilized for other signage on the airport building itself.
3. We are not requesting rights of"final approval"of the signage but would be very
pleased to be involved in the design aspects of the sign,privileged to offer comments or
suggestions and would be excited to watch its evolution. With this in mind,we have taken the
liberty of researching designs and materials,having been recently involved in another monument
project. We would like to continue to explore this route and coordinate with the City on aspects
of the design and material options of the sign.
Please accept our sincere appreciation for the action of the Mayor and City Council in voting for
the naming of the airport to Honor our Brothers and thus all who served in WWII and the efforts
of the City Manager and City Staff who have been working to further this project.
