ORDINANCE NO. 2010-13 p 1 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING CHAPTER 44,TRAFFIC AND MOTOR VEHICLES, OF ITS CODE OF ORDINANCES BY PLACING NO PARKING SIGNS ON THE NORTH SIDE OF 15TH STREET BETWEEN AVENUE I AND UNIVERSITY AVENUE, THE EAST SIDE OF AVENUE J BETWEEN 14TH AND 15TH STREETS, AND BOTH SIDES OF AVENUE I BETWEEN 14TH AND 15TH STREETS; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,TEXAS,THAT: Section 1: The following described no parking zone shall be ratified by the amendments shown below: Street Between North side of 15th Avenue I and University Avenue East side of Avenue J 14'h Street and 15'h Street Avenue 1 14`h Street and 15'h Street, save and except the west side of Avenue I approximately 200'south of the intersection of Avenue 1 and 14'h Street Section 2: The City Manager is authorized and directed to cause the placement of proper signs along the above described streets. Section 3: It shall be unlawful for driver of a vehicle to disobey the instruction of the signs placed in accordance with the provisions of this ordinance unless at the time otherwise directed by a Police Officer. Section 4: Any person, firm or corporation violating any provision of this ordinance or failing to comply with any requirement of the ordinance will be guilty of a misdemeanor as provided by Article I, Section 44-4 of Chapter 44 of the Huntsville Code of Ordinances being punishable by a fine of not less than $1.00 nor more than two hundred($200.00) dollars; except that minors who have passed their 14th birthday but have not reached their 17'hbirthday shall be punished by a fine of not more than$100.00. Section 5: If any section,subsection,sentence,clause,phrase or portion of this ordinance is for any reason held invalid or a separate, distinct and independent provision and such holding unconstitutional,such portion shall be deemed p p shall not affect any of the remaining provisions of this ordinance. Section 6: All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed; , provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 7: This ordinance shall take effect ten(10) days after its passage by the City Council. The City Secretary shall publish the caption of this ordinance in the official City newspaper at least twice within ten (10) days of its passage. Ramachandra, City Engineer From: David Welch, Street Superintendent Date: September 3, 2010 N-'--kJ 1/00"D Subject: No Parking request 15th Street Area Pursuant to a request, I met with Blake Galle with the Police Department concerning the parking situation on the streets surrounding the recycling business located on 15th Street. We also inspected a parking problem in the next block west of the area in question. After our observations it is my recommendation that No Parking zones be established on the north side of 15th Street between Ave I and University Dr., the east side of Ave J between 14th and 15th Streets, and Ave I both sides between 14th and 15th Streets. There are numerous college students parking everywhere in these areas many parked illegally and some even reported blocking driveways. The recycling business generates a fair amount of truck traffic and the vehicles on Ave I and Ave J create problems for the trucks at the business entrances on those two streets. On 15th Street vehicles are parked on both sides of the street, some also parked illegally. In the block between Ave J and University the road is narrow and there is not enough room for two vehicles to pass by, there are no driveways on the south side and parking can be allowed. The north side has the driveways and should be kept clear. Likewise, in the block between Ave I and Ave J on the north side of 151h street should be kept clear because most of the driveways are on that side. Approval: Aron Kulhavy, AICP, Public Works Director 700 AK Issue/Item Description: Adoption of an ordinance amending the traffic schedule to ratify stop signs at the intersection of Sycamore Avenue and 16th Street. Background: Pursuant to the request of the developer involved in the construction of the apartment complex, the City performed traffic counts to aid in determining warrants for creating a four-way stop intersection at the intersection of Sycamore Avenue and 16th Street. Upon receiving the request, staff conducted site visits and the developer's engineer performed a traffic study utilizing the City's traffic counts for part of that study. The intersection met warrants with the sight distance issues, that have always existed at the location, due to the topography of that area. The signs were placed under the authorization of the City Manager. Facts to Consider: . The sight distance has always been an issue for traffic on 16th Street at this intersection . With all of the new apartments developing on Sycamore Avenue, the traffic counts are anticipated to increase significantly . Safety for the public has greatly improved because of this traffic control change . The signs have been in place for approximately 90 days and have had a positive impact on safety. Background: Staff received a complaint concerning the number of cars parked on 15th Street, Avenue J and on Avenue I. The vehicles were parked anywhere space could be found, and some were actually partially blocking driveways for the businesses in the area and on 15th Street. Vehicles were parking on both sides of the street, creating traffic flow issues. It would have been difficult, if not impossible, to get an emergency vehicle through the street, much less support two-way traffic. The primary perpetrators were college students forced to park on the streets due to inadequate parking at the University. Upon receiving the request, staff conducted site visits and recommended placing No Parking signs in the specific areas to alleviate the problems and still allow some on-street parking. The signs were placed under the authorization of the City Manager. Facts to Consider: e Staff found concern for emergency vehicle access on 15th Street, so No Parking signs were placed on the north side of 15th Street. e On Avenue I and Avenue J, parked cars were partially blocking driveways for the business located on 15th Street. e No Parking signs were placed at the specified locations to alleviate the traffic issues. The signs have been in place for approximately 90 days and have had a positive impact on safety. e The ordinance has been changed to reflect the allowance of parking on the west side of Avenue I, approximately 200' south of 14th Street.
