AN ORDINANCE AMENDING THE HUNTSVILLE CODE OF ORDINANCES, SPECIFICALLY
ARTICLE II, SECTION 12 -19(C) OF CHAPTER 12 "BUILDINGS AND BUILDING
REGULATIONS "; MAKING OTHER PROVISIONS AND FINDINGS THERETO; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, Article II "Building Codes" of Chapter 12 `Buildings and Building Regulations" of the
Huntsville Code of Ordinances adopts certain building codes by reference with local amendments, governs
dilapidated or substandard buildings;
WHEREAS, the City now wishes to amend Chapter 12, Article II, Section 12 -19(c) of the Huntsville Code of
Ordinances by adopting the 2009 International Energy Code; and
WHEREAS, notice of the agenda for this meeting, was given in accordance with law by posting the same at
the place reserved and designated for notices of public meetings and public activities and prior to the adoption
of this ordinance.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT:
SECTION 1: The facts and matters set forth in the preamble of this Ordinance are found to be true and
correct and are hereby adopted, ratified, and confirmed.
SECTION 2: Huntsville Code of Ordinances Chapter 12 `Buildings and Building Regulations ", Article II,
Building Codes, Section 12 -19(c) is amended to adopt the 2009 International Energy Code and shall read as
follows;
"(c) The book entitled "International Energy Code, 2009 Edition," a copy of which, authenticated by
the signatures of the mayor and city secretary, and made a public record by this section, is on file in
the City Secretary's office."
SECTION 3: All ordinances or parts of Ordinances that are in conflict or inconsistent with the provisions of
this Ordinance shall be, and the same are hereby, repealed and all other ordinances of the City not in conflict
with the provisions of this Ordinance shall remain in full force and effect.
SECTION 4: Should any paragraph, sentence, clause, phrase or section of this Ordinance be adjudged or
held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a whole
or any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional.
SECTION 5: This Ordinance shall take effect on March 6, 2012, and the City Secretary is instructed to
publish the ordinance as required by Article 4.14 of the City Charter.

Approve Ordinance 2012 -18, amending Chapter 12 "Buildings and Building Regulations" of the
Code of Ordinances through the adoption of the 2009 Edition of the International Energy
Conservation Code.
Background:
The State of Texas adopted the 2009 edition of the International Energy Conservation Code as
the energy code for the use of the State of Texas, effective April 1, 2011, for all residential,
commercial and industrial construction that is not single family construction.
The energy efficiency provisions of the 2009 edition of the International Residential Building
Code were adopted by the State of Texas for the construction of single family residential
dwellings and became effective January 1, 2012.
Title 5, Section 388.003 C of the Texas Health and Safety Code requires that a municipality
within the State of Texas shall establish procedures for:
(1) the administration and enforcement of the codes and
(2) to ensure that code - certified inspectors shall perform inspections and enforce the codes in
the inspector's jurisdiction.
In August of 2011, the Huntsville City Council adopted the 2009 editions of the International
Building and technical codes. However, the 2009 edition of the International Energy
Conservation Code, typically used for commercial type buildings, was not adopted during this
time.
The City Council did also adopt the 2009 edition of the International Residential Building Code
which contains the energy efficiency provisions required by the State of Texas to be adopted and
enforced for the construction of single family dwellings.
Due to the requirements of the Texas Health and Safety Code, the 2009 edition of the
International Energy Conservation Code is presented for adoption.
Facts to Consider:
• The adoption of the 2009 International Energy Conservation Code is a requirement by the
Texas Health and Safety Code, Title 5, Chapter 388
• Copies of the International Energy Conservation Code are available at the Service Center
and City Secretary's office for review
Fiscal Impact /Funding Source(s):
There will be no fiscal impact on the City of Huntsville budget.
However, the required adoption and enforcement of the 2009 edition of the International Energy
Conservation Code can create a fiscal impact on the owners of existing and future commercial
use type buildings within the city limits of Huntsville. Examples of requirements that may create
such impacts would include:
• The re- roofing of an existing building will require the insulation of the ceiling /roof area to
be upgraded to the 2009 standards if during the re- roofing work the roof sheathing and /or
insulation is exposed.
• If the use of an existing building changes to a different use and the electrical service or
gas service is increased in size, the insulation within the walls and ceiling must be
upgraded to the 2009 insulation standards as well as the lighting for the building must be
upgraded to the 2009 energy standards. An example of such a building use change would
be the remodeling of a residential building into a commercial business office.
