AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, PROHIBITING DISCHARGE OF FIREARMS IN THE CITY UNDER
CERTAIN CONDITIONS; REPEALING CONFLICTING ORDINANCES; PRE-
SCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00)
DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
Section 1: Chapter 13, Offenses and Miscellaneous Provisions, of the Code
of Ordinances of the City of Huntsville, Texas, is hereby amended by
the repeal of Section 13 -6 as presently constituted and by the adoption .
of a new Section 13 -6 that shall read as follows:
Section 13 -6. Discharge of Firearms Prohibited.
(a) A person commits an offense if he discharges a firearm
within the City.
(b) It is a defense to prosecution under this section that
the person discharged the firearm
(1) in a regularly established shooting range;
(2) when lawfully defending a person or property; or
(3) in lawful discharge of duties as a peace officer
or as an officer of the Texas Department of
Corrections.
Section 2: Any person violating the provisions of this ordinance shall be
punished by a fine of not more than two hundred ($200.00) dollars, and
each violation shall constitute a separate offense.
Section 3: All ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed only to the extent of such incon-
sistency.
Section 4: This ordinance shall take effect from and after ten (10) days
from its passage by the City Council. The City Secretary is hereby
directed to give notice hereof by causing the caption of this ordinance
to be published in the official newspaper of the City of Huntsville at
least twice within ten (10) days after the passage of this ordinance.
