AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, AMENDING CHAPTER 11B,
MANUFACTURED HOMES AND RECREATIONAL VEHICLES OF
THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE,
ALTERING THE PROCEDURE FOR ISSUING CONNECTION
PERMITS, REQUIRING DRAINAGE PLANS, ALTERING
SETBACK STANDARDS, REQUIRING LANDSCAPING AND
CLARIFYING MINIMUM LOT SIZE REQUIREMENTS; MAKING
OTHER PROVISIONS RELATED THERETO; PROVIDING A
PENALTY OF UP TO $200; PROVIDING SAVINGS AND
REPEALING CLAUSES; PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, THAT:
Section 1: Chapter 11B, Manufactured Homes and Recreational
Vehicles, of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by the repeal of
subsections (b) and (c) of Sec. 11B -13, as presently
constituted, and by the adoption of new subsections (b) and
(c) that shall read:
Sec. 11B -13 Connection and building permits required .
(b) All applications for connection permits shall be
made upon form provided by the building official and shall
contain the name of the manufactured home owner, his mailing
address and a description of the manufactured home for which
application is made. Applicant shall submit a copy of
manufacturer's instructions for installation of the
manufactured home and an application /inspection fee of
$15.00. Additionally, permits shall be obtained from the
City for a foundation, driveway, electricity, plumbing, etc.
(c) The building official shall inspect the
manufactured home and home site for which the permit
application is made and if the home and home site have
sewer, gas, water and electrical facilities in accordance
with the applicable codes and ordinances of the City of
Huntsville, including this chapter, he shall issue a
connection permit or sticker for affixing to the
manufactured home inspected. Such permit or sticker shall
be displayed upon the front portion of said manufactured
home in such a manner as to be easily seen and shall remain
so displayed as long as said manufactured home remains
connected to sewer, gas, water or electrical connections.
Section 2: Chapter 11B, Manufactured Homes and Recreational
Vehicles, of the Code of Ordinances of the City ofr

Huntsville, Texas, is hereby amended by the addition of a
subsection (6) to Sec. 11B -22c, which said subsection shall
read as follows:
(6) a detailed drainage plan showing the proposed
method for handling storm water run —off within and from the
park site.
Section 3: Chapter 11B, Manufactured Homes and Recreational
Vehicles of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by the repeal of
subsection (1) of Sec. 11B- 23(d), as presently constituted,
and by the adoption of a new subsection (1) that shall read:
(1) All manufactured homes shall be located at least
25 feet from any front property line abutting upon a public
street or highway, at least 15 feet from any side property
line abutting upon a public street or highway, and at least
ten (10) feet from all interior property lines.
Section 4: Reserved.
Section 5: Chapter 11B, Manufactured Homes and Recreational
Vehicles of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by the repeal of
subsection (o) of Sec. 11B -23, as presently constituted, and
by the adoption of a new subsection (0) that shall read:
(o) Density. No more than ten (10) manufactured home
sites shall be situated per acre for the entire development,
including streets. In addition to this requirement, all
space and distance requirements as elsewhere herein set out
shall be compiled with so that the more restrictive of the
two (2) standards shall be applied in any situation to
determine compliance with this section.
Section 6: Chapter 11B, Manufactured Homes and Recreational
Vehicles, of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by the addition of a
new subsection (q) to Sec. 11B -23, which subsection (q)
shall read as follows:
(q) Landscaping. Every park shall be landscaped in
accordance with the provisions of Chapter 6, Article 5 of
the Code of Ordinances of the City of Huntsville, Texas,
whether or not a building permit is required.
Section 7: Chapter 11B, Manufactured Homes and Recreational
Vehicles, of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by the repeal of
Section 11B -42, as presently constituted, and by the
adoption of a new Section 11B -42 that shall read:
11B -42. Permits Required.
(a) All manufactured homes located outside
manufactured home parks for more than forty -eight (48) hours
shall be connected to all required utilities and in addition
to the connection permit required by Article II hereof,
permits shall be obtained from the City permit official for
a foundation, driveway, electrical and plumbing connections,
etc.
(b) The application for permits shall be made to the
City permit officer and shall contain the following, as a
minimum:
(1) name and address of the applicant;
(2) a plat or map of the proposed home site
showing the area and dimensions of the
property, the proposed location of the
manufactured home, the size of the
manufactured home, the location of all
proposed and existing structures on the
property;
(3) the location of proposed and existing
driveways, culverts and parking;
(4) the existing and proposed topography of the
site, with drainage patterns and elevations
at property corners, building and home sites;
(5) location of water, sewer and electrical
services;
(c) Every lot upon which a manufactured home is placed
outside a park shall be landscaped in accordance with the
provisions of Chapter 6, Article 5, of the Code of
Ordinances of the City of Huntsville, Texas, whether or not
a building permit is required.
Section 8: Chapter 11B, Manufactured Homes and Recreational
Vehicles, of the Code of Ordinances of the City of
Huntsville, Texas, is hereby amended by the repeal of Sec.
11B -43, as presently constituted, and by the adoption of a
new Sec. 11B -43 that shall read:
Sec. 11B -43. Minimum lot size.

(a) A manufactured home may be placed outside a park
provided that it is placed on a lot or tract of property
with more than six thousand (6,000) square feet of land;
provided further, however, that if a manufactured home is
placed on the same tract of land as one (or more) other
manufactured home, residential, or commercial structures,
there shall be at least six thousand (6,000) square feet of
land provided for each manufactured home and/or residential
or commercial structure.
Section 9: Chapter 11B, Manufactured Homes and Recreational
Vehicles, of the Cod! et Ordinances of the City of
Huntsville, Texas, is hereby amended by the addition of a
new subsection (f) to Sec. 11B-52(a)(3), which said
subsection (f) shall read:
Sec. 118-52. Permit Application; issuance.
(a) The application for permit shall be made to the
City permit office and shall contain the following . . .
(3) Engineering plans and specifications of the
proposed park showing . . .
(f) the proposed method for handling storm water
run-off within and from the park site.
Section 10: Chapter 11B, Manufactured Homes and
Recreational Vehicles, of the Code of Ordinances of the City
of Huntsville, Texas, is hereby amended by the addition of a
new subsection (g) to Sec. 11B-53, which said subsection (g)
shall read as follows:
Sec. 11B-53. Construction Standards.
(g) Landscaping.
Every park shall be landscaped in accordance with
the provisions of Chapter 6, Article 5 of the Code of
Ordinnoes of the City of huntsville, - -
not a building permit is required.
Section 12: The City Secretary is hereby authorized and
directed to correct the cross references affected by the
recent codification of Chapter 30 of the Code of Ordinances,
which replaced and superceded former Appendix A.

Section 13: Chapter 6, Buildings and Building Regulations,
of the Code of Ordinances of the City of Huntsville, Texas,
is hereby amended by the adoption of a new subsection c of
Section 6 -51, which said subsection c shall read:
Sec. 6 -51. Landscaping Reguired.
c. No permit for construction, alteration or
extension of a manufactured home park or RV park shall
be issued unless a minimum of ten (10 %) percent of the
building site not covered by a building or structure is
devoted to landscape development; moreover, no such
permit shall be issued for parks of one (1) acre or
more unless at least eighteen (18) diameter inches of
trees are provided per acre.
Section 14: A person commits an offense if he constructs,
alters or extends a manufactured home park or a Recreational
Vehicle park without a valid permit.
Section 15: Any person, firm or corporation violating any
provision of this ordinance or failing to comply with any
requirement of this ordinance will be guilty of a
misdemeanor and subject to a fine of up to two hundred
($200.00) dollars upon conviction. Each day during or upon
which said person shall violate or continue violation of any
provision of this ordinance or non - compliance with any
requirement of this ordinance shall constitute a distinct
and separate offense. The violation of any provision of
this ordinance or the failure to comply with any requirement
of this ordinance shall each constitute a distinct and
separate offense.
Section 16: If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional, such portion shall be deemed a
separate, distinct and independent provision and such
holding shall not affect any of the remaining provisions of
this Ordinance.
Section 17: All ordinances and parts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed; provided, however, that such repeal shall be only
to the extent of such inconsistency and in all other
respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter
covered by this ordinance.
Section 18: This ordinance shall take effect from and after
ten (10) days from its passage by the City Council. The
City Secretary is hereby ordered to give notice hereof by
causing the caption of this ordinance to be published in the
official newspaper of the City of Huntsville at least twice
within ten (10) days after passage of this ordinance.
