AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS PROHIBITING THE KEEPING OR
MAINTAINING OF ANY WILD OR EXOTIC ANIMALS WITHIN
THE CITY; DEFINING WILD ANIMAL; PROVIDING A
PENALTY OF UP TO $200 A DAY; MAKING OTHER
PROVISIONS ANU FINDINGS RELATED THERETO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS that:
Section 1. Chapter 4, Animals and Fowl, of the Code of
Ordinances of the City of Huntsville, Texas, is hereby
amended by the addition of a new subsection 4 -1 (g) that
shall read as follows:
(y) Wild Animals: Any poisonous reptile or any other
dangerous or carnivorous wild animal or reptile, any vicious
or dangerous domesticated animal or any other animal or
reptile of wild, vicious or dangerous propensities.
Section 2. Chapter 4, Animals and Fowl, of the Code of
Urdinances of the City of Huntsville, Texas, is hereby
amended by the addition of a new section '4 -7, Wild and
Exotic Animals, that shall read as follows:
Sec. 4 -7. Wi ld and Exotic Animals
(a.) A person commits an offense if he intentionally
or knowingly keeps or has in his possession or under his
control within the City any wild animal.
(b.) A person commits an offense if he intentionally
or knowingly keeps, maintains or has in his possession or
under his control within the City any of the following
animals:
(1) All poisonous animals including rear -fang snakes;
(2) Apes; Chimpanzees (Pan); gibbons (Hylobates); gorillas
(gorilla); orangutans (Pongo); and siamangs
(Symphalanyus);
(3) Baboons (Papoi; Mandri l lus);
(4) Bears (Ursidae);
(5) Bison (Bison);
(6) Cheetahs (Acirronyx jubatus);
(7) Crocodilians (Crocodilia), thirty (30) inches in length
or more:
(8) Constrictor snakes, five (5) feet in length or more;
(9) Coyotes (Canis latrans);
(10) Deer (Cervidae) including w hi tetai led deer, elk, anelope
or moose;
(11) Elephants;
(12) Game cocks and other fighting birds;
(13) Hippopotam (Hippopotamidae);
(14) Hyenas (Hyaenidae);
(15) Jaguars (Panthera onca), leopards (Panthera pardus),
lions (Panthera leo) or tigers ( panthera tigris);
(16) Lynxes (lynx);
(17) Monkeys, old world (Cercopithe cidae);
(18) Ostriches (Struthia);
(19) Piranha fish (Characidoe);
(20) Pumas (Felis con color), also known as cougars, mountain
lions or panthers;
(21) Rhinoceroses (Rhinocero tidae);
(22) Sharks (class Chondrich thyes); or
(23) Wolves (Canis lupus).
Section 3. Any person, firm or corporation violating any
provision of this Ordinance or failing to comply with any
requirement of this Ordinance will be guilty of a
misdemeanor and subject to a fine of up to two hundred
($200.00) dollars upon conviction. Each day during or upon
which said person shall violate or continue violation of any
provision of this Ordinance or non - compliance with any
requirement of this Ordinance shall constitute a distinct
and separate offense. The violation of any provision of
this Ordinance or the failure to comply with any requirement
of this Ordinance shall each constitute a distinct and
separate offense.
Section 4. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held
invalid or unconstitutional, such portion shall be deemed a
separate, distinct and independent provision and such
holding shall not affect any of the remaining provisions of
this Ordinance.
Section 5. This ordinance shall take effect from and
after ten (10) days from its passage by the City Council.
The City Secretary is hereby ordered to give notice hereof
by causing the caption of this ordinance to be published in
the official newspaper of the City of Huntsville at least
twice within ten days after the passage of this ordinance.
