AN ORDINANCE OF THE CITY COUNCIL AMENDING CHAPTER
TWO, ADMINISTRATION, OF THE CODE OF ORDINANCES OF
THE CITY OF HUNTSVILLE, TEXAS, BY THE ADDITION OF
A NEW ARTICLE V, PURCHASING, ESTABLISHING
PURCHASING PROCEDURES FOR THE CITY; MAKING OTHER
FINDINGS AND PROVISIONS RELATED THERETO; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on April 5, 1982, the citizens of the City of
Huntsville voted to amend the City Charter to require that
City Council establish purchasing procedures by Ordinance;
and
WHEREAS, TEX.REV.CIV.STAT. art. 2368a requires competitive
bids after notice and advertisement for certain contracts
for public works in excess of $5,000;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, that:
Section 1. Chapter 2. Administration, of the Code of
Ordinances of the City of Huntsville, Texas, is hereby
amended by the adoption of a new Article V. that shall read
as follows:
Article V. Purchasing Procedures
Sec. 2.50. CONTRACTS APPROVED BY COUNCIL.
a. All contracts for expenditures involving five thousand
($5,000.00) dollars or more must be expressly approved in
advance by the City Council.
b. All contracts for expenditures involving one thousand
($1,000.00) dollars or more must be expressly approved in
advance by the City Council if:
(1) the expenditure is not budgeted;
(2) the City administration proposes to award the bid
to other than the low bidder meeting specifications; or
(3) only one bid is received.
Sec. 2.52. Emergency Expenditures
The City Manager shall make a full report of the
circumstances of any emergency purchase not made in
accordance with the procedures set forth above. The report
shall be filed with the City Council.
Sec. 2.53. Purchasing Manual.
The City Manager shall publish a purchasing manual
establishing purchasing procedures consistent with this
chapter.
Section 2. All Ordinances and parts of Ordinances in
conflict with the provisions of this Ordinance are hereby
repealed; in particular, Chapter Two, Administration, of the
Code of Ordinances of the City of Huntsville, Texas, § 2 -1.
is repealed; provided however, that such repeal shall be
only to the extent of such inconsistency and in all other
respects this ordinance shall be cumulative of other
Ordinances regulating and governing the subject matter
covered by this Ordinance.
Section 3. This ordinance shall take effect immediately
from and after passage.
