AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVITLF, TEXAS, INCREASING RATES FOR WATER AND SEWER
SERVICE FURNISHED BY THE CITY; MAKING VARIOUS FINDINGS
AND PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
Section 1: Chapter 17, Water and Sewer, of the Code of Ordinances of the
City of Huntsville, Texas, is hereby amended by the repeal of Section
17-9, Monthly charges for water, as presently constituted, and by the
adoption of a new Section 17-9 that shall read as follows:
Sec. 17-9. Monthly charges for water.
a. Basic rate schedule. Except as hereafter provided, each
residential and commercial user of water situated within the
corporate limits of the City of Huntsville and supplied with
water service by the City shall be charged a monthly water
service charge based upon the amount of consumption attributed
to the user, as determined herein, and applied to the following
rate schedule:

b. Unit billing for residential dwellings.
(1) Individually metered units.
Each residential dwelling unit individually metered and
billed for consumption of water shall be charged for and owe
each month a water service charge based upon the amount of
water consumed, as determined by the meter reading, applied
to the above rate.
(2) Jointly metered units.
Each multi-family dwelling unit project shall be charged for
and owe each month a water service charge as follows:
A minimum bill equal to total number of units multiplied by
the minimum monthly charge, plus a consumption charge based
upon the amount of water consumed in excess of 3,000 gallons
times the number of units, as determined by the meter
reading, applied to the above rate schedule.
c. Institutional Users.
Institutional and contract users (Simn Houston State University,
Texas Department of Corrections, and Elkins Lake Municipal
Utility District) shall be charged a monthly water service charge
based upon the amount of water consumption attributed to the
user, as determined herein, and applied to the following rate:

d. Users outside the City.
Each residential and commercial user of water situated outside
the corporate limits of the City of Huntsville and supplied with
water service by the City shall be charged a monthly service
charge based on water consumption attributed to the user, as
determined herein, except that the charges shall be double the
rates charged to a user situated within the City limits.
Section 2: Chapter 17, Water and Sewer, of the Code of Ordinances of the
City of Huntsville, Texas, is hereby amended by the repeal of Section
17-21, Monthly charges for sewer, as presently constituted, and by the
adoption of a new Section 17-21 that shall read as follows:
Sec. 17-21. Monthly charges for sewer.
a. Basic rate schedule. Except as hereafter provided, each resi-
dential and commercial user of water situated within the
corporate limits of the City of Huntsville and supplied with
sewer service by the City shall be charged a monthly sewer
service charge based upon the amount of water consumption
attributed to the user, as determined herein, and applied to the
following rate schedule:

b. Unit billing for residential dwellings
(1) Individually metered units.
Each residential dwelling unit individually metered and
billed for consumption of water shall be charged for and owe
each month a sewer service charge based upon the amount of
water consumed, as determined by the meter reading, applied
to the above rate schedule, provided that the maximum sewer
bill for each residential unit is $15.25.

(2) Jointly metered units.
Each multi-family dwelling unit project shall be charged for
and owe each month a sewer service charge as follows:
A minimum bill equal to total number of units multiplied by
the minimum monthly charge, plus a consumption charge based
upon the amount of water consumed in excess of 3,000 gallons
times the number of units, as determined by the meter
reading, applied to the above rate schedule, provided that
the maximum sewer charge for multiple residential units
shall not exceed the number of units multiplied by $15.25.
c. Institutional Users.
Institutional and contract users (Sam Houston State University
and Texas Department of Corrections) shall be charged a monthly
sewer service charge based upon the amount of water consumption
attributed to the user, as determined herein, and applied to the
following rate:

Each residential and commercial user of water situated outside
the corporate limits of theCity of Huntsville and supplied with
sewer service by the City shall be charged a monthly service
charge based on water consumption attributed to the user, as
determined herein, except that the charges shall be double the
rates charged to a user situated within the City limits.
e. Other charges not affected.
Nothing herein shall affect or alter any other charge for sewer
service required by the Code or the City's industrial waste
ordinances.
Section 3: Chapter 17, Water and Sewer, of the Code of Ordinances of the
City of Huntsville, Texas, is hereby amended by the repeal of Section
17-81, Industrial waste surcharges, as presently constituted, and by
the adoption of a new Section 17-81 that shall read as follows:
Sec. 17-81. Industrial waste surcharges.
(a) Users discharging industrial wastes which exhibit none of the
characteristics of wastes prohibited in Division 2, other than
excessive BOD or suspended solids, having a concentration during
a twenty-four (24) hour period average of suspended solids of BOD
content in excess of "normal domestic sewage" shall be required
to pretreat the industrial wastes to meet the requirements of
"normal domestic sewage"; however, such wastes may be accepted
for treatment if all the following requirements are met:
(1) The wastes will not cause damage to the collection system.
(2) The wastes will not impair the treatment process.
(3) Any user who accepts a discharge permit agrees to pay a
surcharge over and above the existing sewer rates with the
basis for the surcharge on industrial wastes to be computed
in the following manner:

***If BOD is less than two hundred fifty (250) it should be
calculated as zero; if TSS is less than two hundred fifty
(250) it should be calculated as zero.
(b) The volume of wastes may be determined by the same methods used
to calculate the regular sewer service charge,or as a percentage
of users water bill. Users discharging less than twenty thousand
(20,000) gallons/day, the BOD and suspended solids values may be
determined from standard values for various industries
established by the approving authority. In cases where the
discharge exceeds twenty thousand (20,000) gallons/day, or in the
event that the user desires to determine accurate values of BOD
and suspended solids, the user shall install at his expense a
sampling point at a location near the outlet of each building
drain or connection with any sanitary sewer of the city. BCD and
suspended solid values determined from samples collected from any
establishment shall be determined by the director or a registered
professional engineer employed by the user. Such report shall
contain a statement that the samples collected and values
determined are based on a twenty-four hour composite
representative of the establishment's flow. Each sampling point
shall be installed and shall be so maintained by the user so that
any authorized representative of the city may readily and safely
obtain samples of the flow at all times. Plans and location of
such sampling points shall be approved by the director prior to
construction.
(c) All flow rates and BOD and suspended solid values used in
determination of the industrial sewer service charge shall be
reevaluated on an annual basis. If there is a major change in
the operation to cause changes in value, however, the values may
be increased or decreased on a study of changes or actual
measurements.

(d) The basis for determining the surcharge shall be reviewed
biannually and shall be adjusted to reflect any increase or
decrease in waste water treatment costs based on the previous
year's experience.
Section 4: These rates provided for herein will be effective on all bills
rendered after October 1, 1983.
Section 5: This ordinance shall take effect immediately from and after its
passage.
