ORD 1984-39 - RedistrictingORDINANCE NO. 84-39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, REDISTRICTING COUNCIL WARDS NUMBERS 3 AND 4 BY THE ADDITION OF CERTAIN PROPERTIES; AND PROVIDING THE EFFECTIVE DATE HEREOF. WHEREAS Section 4.04 of the City Charter provides that City Council may redistrict its four wards; and WHEREAS it is necessary to include the newly annexed territory described herein in Council Wards; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: Section 1: Council Ward Number Three is hereby redistricted by the addition of certain property that is described as follows: HENDERSON LAND CO. KNOTTS APRIL POINT BEGINNING at the intersection of the north city limits with the west boundary of the Joe Ferro 50.6 acre tract as described by deed recorded in Vol. 210, pg. 710, Walker County Deed Records; THENCE, with Ferro west boundary, in a northerly direction to Ferro's northwest corner, same being the southwest corner of the Frank Robinson, Sr. tract and in the east boundary of the TDC Wynne Unit; THENCE, with Ferro-Robinson common boundary in an easterly direction to the Ferro northeast corner, same being the northwest corner of Section One, Henderson Land Company Subdivision as shown by plat recorded in Vol. 1, Pg. 171, Walker County Plat Records, and continuing with Henderson north boundary and Robinson south boundary 537.08 ft. to the southerly southeast corner of the Robinson tract and an "ell" corner of the Henderson tract; THENCE, N 0°14'W 988.24 ft. to a corner in Parker Creek; THENCE, with meanders of the creek, same being common boundary of the Robinson and Henderson tracts: (1) N 39 °57'E 28.27 ft; (2) N 23 °12'E 73.07 ft; (3) N 26 °41'E 105.70 ft; (4) N 19 °35'E 116.92 ft; (5) N 32 °06'E 128.28 ft; (6) N 72 °48'E 132.67 ft; (7) N 62 °34'E 36.65 ft; (8) N 51 °40'E 91.98 ft; (9) N 49 °52'E 65.48 ft; (10) N 55 °57'E 80.68 ft; (11) S 68 °40'E 77.36 ft; (12) S 63 °08'E 108.01 ft; (13) S 77 °33'E 79.06 ft; (14) S 68 °18'E 86.93 ft; (15) N 38 °37'E 65.66 ft; and (16) N 82 °50'E 72.61 ft. to the most northerly corner of the Henderson tract, same being the most westerly corner of the residual of the W. H. Knotts 49.33 -acre tract as described by deed recorded in Vol. 222, Pg. 357, Walker County Deed Records; THENCE, with the meanders of Parker Creek, same being the north boundary of the Knotts tract, in an easterly direction, approximately 1500 ft to the southwest corner of the Patrick M. Carmichael 8.860 -acre tract (April Point Mobile Home Park) as described by deed recorded in Vol. 374, Pg. 419, Walker County Deed Records; THENCE, with Carmichael west boundary: (1) N 01 °19'57 "E 480.00 ft; (2) S 88 °14'55 "E 100.15 ft; (3) N 02 °02'09 "E 9.16 ft; (4) S 88 008'14 "E 104.30 ft; (5) S 03 °00152 "W 23.01 ft; (6) S 88 013'01 "E 243.79 ft; (7) N 01 038'38 "E 82.33 ft; (8) S 88 °08'30 "E 190.54 ft; and (9) N 01 °34'28 "E 150.15 ft. to a corner on the south boundary of Jenkins Road; THENCE, with common boundary Carmichael tract and Jenkins Road, S 88° 15'45 "E 209.00 ft. to a corner in the west right -of -way for FM Highway 247; THENCE, with the west R.O.W. for FM 247 southerly to its intersection with City Limits as defined May 8, 1973; THENCE, with existing city limits, in a westerly direction to the POINT OF BEGINNING. FISH HATCHERY BEGINNING at northwest corner of 224 acre tract conveyed by Gibbs Brothers Co. to United States of America and recorded in Vol. 82, Pg. 145 of the Walker County Deed Records; said corner being also the southwest corner of an 11 -acre tract conveyed to James F. Wollum and recorded in Vol. 204, Pg. 151 of the Walker County Deed Records; said corner being referenced N 0 °15'W 1135.2 ft from the southwest corner of the Foster Bobo Survey. Said point being on the east line of the city limits as annexed May 8, 1973. THENCE N 75 °30 "E within the Foster Bobo Survey approximately 5504.4 ft to a corner of the William A. Cook Survey and the Jesse Parker Survey in the east line of the Foster Bobo Survey; said corner being also the most southeasterly corner of Spring Hill Addition Section III as recorded in Vol. 1, Pg. 4 of the Plat Book of Walker County. THENCE N 34 °19'E 51.8' to a corner of the Spring Hill Addition Section III Subdivision. THENCE along the eastern boundary of Spring Hill Addition Section III as follows: (1) N 50 °26'W - 631.5' (2) N 32 °W - 551.7' (3) N 88 °16'E - 77.0' (4) N 01 °31'W - 199.8' To the northeast corner of Lot #18 of Spring Hill Section III being also in the south right -of -way of FM 2821. (Fish Hatchery) THENCE continuing N 01 °31'W 100' to the north right -of -way line of FM 2821. (Fish Hatchery) THENCE easterly along the north right -of -way of FM 2821 (Fish Hatchery) to corner No. 3 of a 100 acre tract No. J -3 conveyed by Gibbs Brothers and Co. to U.S.A. and recorded in Vol. 82, Pg. 131, Walker County Deed Records. THENCE north approximately 415.8 feet along a western line of the U.S.A. 100 -acre tract to corner No. 4; THENCE west approximately 3128.4 feet along the south line of the 100 -acre U.S.A. tract to the southwest corner (corner 5) of the U.S.A. 100 acre tract being also the southeast corner of a 1.99 acre tract conveyed from Bobby E. Bacon to Edward L. Peikert and wife Ruby V. Peikert and recorded in Vol. 368, Pg. 248; 3 THENCE, with Peikert south boundary, (1) S 56 °16'W 60.9 ft. to an angle point, and (2) S 66 °26'W 166.5 ft. to the southeast corner of the B.E. Johnson 2.87 acre tract as described by deed recorded in Vol. 152, Pg. 426, Walker County Deed Records; THENCE with Johnson south boundary, S 65 °38'W 227.5 ft. to the southeast corner of the L. M. Kelley 3.33 -acre tract as described by deed recorded in Volume 360, Pg. 520, Walker County Deed Records; THENCE, with Kelley south boundary, S 66 °07'W 227.5 ft. to the Tony S. Nuchia tract described by deed recorded in Vol. 176, Pg. 571, Walker County Deed Records; THENCE, with Nuchia southeast and east boundaries: (1) S 65 °38'W - 312.5 ft. and, (2) S 22 °00'W - 283.3 ft. to the northeast corner of the O.F. Shipp 5 -acre tract as described by deed recorded in Vol. 218, Pg. 178, Walker County Deed Records; THENCE, with Shipp's east boundary, S 21 °43'W 223.06 ft. to his southeast corner, same being the most easterly northeast corner of the city limits as described by city ordinance dated May 8, 1973; THENCE in a southerly direction along the city limits as established by 1973 ordinance to the POINT OF BEGINNING. BOETTCHERS MILL BEGINNING at an angle point in the city limit line as established by City Council on September 6, 1949; said point being north 4436 feet from the southeastern corner of the city limits as established on September 6, 1949. THENCE west - 1044' as described in the city limit annexation of September 6, 1949; THENCE north - 2990' as described in the city limit annexation of September 6, 1949; THENCE east - 1044' as described in the city limit annexation of September 6, 1949. THENCE north parallel with and 2640 feet from the east corporate limits along the line as described in the city limit annexation of September 6, 1949 to a point of intersection with the corporate limits as annexed December 20, 1968 being a line parallel with and 467.3 feet from the centerline of U.S. Hwy. 190; THENCE S 54 °30'E 1291.8' parallel with and 467.3 feet from the centerline of U.S. Hwy 190 to a point on the east boundary of the P.Gray League being the same line as described in city annexation dated December 20, 1968; 4 .1 THENCE along annexation dated December 20, 1968, North 574' to the intersection of the east boundary line of P. Gray League with the centerline of Hwy 190 and being the place of beginning of the annexation dated December 20, 1968, and, continuing with east boundary of the P. Gray League and the east boundary of a private road known as "School Road ", same being also the city limits as established by city ordinance dated 6 -20 -67 and recorded in Vol. 207, Pg. 301, Walker County Deed Records; approximately 185 ft. (total north course being approximately 760 ft.) to a point in the center of a creek, same being the common boundary of Gibbs Brothers and Co. tract and a Huntsville Independent School District tract; THENCE, with said creek, in an easterly direction, approximately 834 ft. to a concrete monument on the north bank of said creek, same being the southwest corner of the HISD tract; THENCE with east boundary of the school tract in a northerly direction to the common boundary of the T. Gibbs and H. L. Hunter Surveys; THENCE with said boundary same being the most southerly boundary of the city as established by Ordinance 80 -47 dated 10- 14 -80, easterly to the west right -of -way for State Highway 19, same being the westerly line an annexation tract described by Ordinance 81 -2 dated 1- 13 -81; THENCE, with said right -of -way, same being the western boundary of Ordinance 81 -2, southerly and southwesterly to the most easterly re -entry corner of the annexation tract described by ordinance dated 12- 14 -71, same being in the south line of the T. Gibbs Survey; THENCE, westerly with the T. Gibbs boundary and a north line of the annexation tract, to the southwest corner of the T. Gibbs Survey; THENCE, northerly with the southernmost west line of the Gibbs Survey, said line being common with the E. Davids League, to its intersection with the south line of the P. Gray League; THENCE, with the Gray /Davids boundary, west to the POINT OF BEGINNING. Section 3: City Ward Number Four is hereby redistricted by the addition of certain property that is described as follows: MAJESTIC FOREST BEGINNING at the southeast corner of Majestic Forest Addition, a rural subdivision of 20.19 acres out of the J. Hume Survey, Abstract 264, Walker County, Texas, same being also a point on the west right -of -way for FM Highway 1374; THENCE, with the south boundary of Majestic Forest, as described by dedication plat of record in Vol. 1, Pg. 48, Walker County Plat Records, 5 (1) N 66°02'W 466.72 ft; (2) N 65°34'W 211.47 ft; (3) N 65°02'W 200.27 ft; (4) N 65°31'W 164.10 ft; and (5) N 65°53'W 789.24 ft. to the southwest corner of the Majestic Forest Subdivision, same being a point on the common boundary of the J. Hume and W. McDonald Survey lines; THENCE northerly along the most westerly line of the J. Hume Survey and east line of W. McDonald Survey to an angle point in the J. Hume and W. McDonald Survey line. THENCE in a northeasterly direction along the west line of the J. Hume and the east line of W. McDonald Survey to the southwest corner of the Lewis Cox Survey; said point being also the existing city limit line as established by ordinance 81-3 dated 1-13-81. THENCE in a southeasterly direction along the existing city limit line being the south line of the J. Cox Survey to the southeast corner of the J. Cox Survey and a common ell corner with the J. Hume Survey and being on the existing city limit line as established by ordinance 80-49 dated 10-14-80. THENCE in a southwesterly direction along the westerly right-of-way of FM 1374 being the existing city limit line to the PLACE OF BEGINNING. Section 4: This ordinance shall take effect immediately upon its passage by City Council.
