AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, PROVIDING FOR THE
ANNEXATION OF CERTAIN TERRITORY THAT LIES ADJACENT TO AND ADJOINS
THE PRESENT BOUNDARY LIMITS OF THE CITY OF HUNTSVILLE, TEXAS:
APPROVING A SERVICE PLAN FOR SAID AREA: AND MAKING VARIOUS OTHER
FINDINGS AND PROVISIONS RELATED THERETO.
WHEREAS, pursuant to Ordinance No. 84-22, the City of Huntsville ordered
public hearings where all interested persons would be provided the
opportunity to be heard on the proposed annexation of the property
described in Exhibit '/Au attached hereto; and
WHEREAS notice of such public hearings was published in the Huntsville
Item, a paper having general circulation in the City of Huntsville,
Texas and Walker County, Texas, on both Sunday, September 23, 1984,
and on Sunday, September 30, 1984, which dates were not more than 20
days nor less than 10 days prior to said hearings; and
WHEREAS said public hearings were held at 7:00 p.m. on Tuesday, October
9, and at 8:00 p.m. on Tuesday, October 16, 1984, in the City Council
Chambers of The City Council at City Hall, 1212 Avenue M, Huntsville,
Texas, which dates are not more than forty /40\ days nor less than 20
days prior to the first consideration of this ordinance; and
WHEREAS during said hearings the proposed service plan was made
available for inspection and explained to the inhabitants of the
areas to be annexed at that time; and
WHEREAS the above described property lies within the extraterritorial
jurisdiction of the City of Huntsville, Texas; and
WHEREAS the above described property lies adjacent to and adjoins the
City of Huntsville;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
THAT:
Section 1: The following described land and territory lyiny adjacent to
and adjoining the City of Huntsville, Texas, is hereby added and
annexed to the City of Huntsville, Texas, and the said territory
hereinafter described shall hereinafter be included within the
boundary limits of the City of Huntsville, Texas and the present
boundary limits of the City, at the various points contiguous to the
area hereinafter described, are altered and amended so as to include
said area within the corporate limits of the City of Huntsville,
Texas, to-wit:
MAJESTIC FOREST
BEGINNING at the southeast corner of Majestic Forest Addition a rural
subdivision of 20.19 acres out of the J. Hume Survey, Abstract 264,
Walker County, Texas same being also a point on the west right-of-way
for FM Highway 1374;
THENCE, with the south boundary of Majestic Forest, as described by
dedication plat of record in Vol. 1, Pg 48, Walker County Plat Records,
(1) N66002'W 466.72 ft;
(2) N65°34'W 2I1.47 ft;
(3) N65o021W 200.27 ft^
(4) N55o31'W 164.10 ft; and
(5) N68)53/W 789.24 ft to the southwest corner of the M ajestic
Forest Subdivision, same being a point on the common boundary of the J.
Hume and W. McDonald survey lines;
THENCE northerly along the most westerly line of the J. Hume Survey
and east line of W. McDonald Survey to an angle point in the J. Hume and
N. McDonald Survey line.
THENCE in a northeasterly direction along the west line of the J.
Hume and the east line of W. McDonald Survey to the southwest corner of
the Lewis Cox Survey; said point being also the existiny city limit line
as established by ordinance 81-3 dated 1-13-81.
THENCE in a southeasterly direction along the existing city limit
line being the south line of the J. Cox Survey to the southeast corner
of the J. Cox Survey and a common ell corner with the J. Hume Survey and
being on the existing city limit line as established by ordinance 80-49
dated 10-14-80.
THENCE in a southwesterly direction along the westerly right-of-way
Of FM 1374 being the existing city limit line to the PLACE OF BEGINNING.
Section 2` . The Service Plan attached to this ordinance as Exhibit "B",
and made a part hereof for intents and purposes, is hereby adopted
and approved as the service plan for the area annexed by this
ordinance.
Section 3: The above described territory and the area so annexed shall
be a part of the City of Huntsville, Texas, and the property so added
shall bear its pro rata part of the taxes levied by the City of
Huntsville, Texas, and the inhabitants thereof shall be entitled to
all of the rights and privileges of all the citizens of Huntsville
and shall be bound by the acts, ordinances, resolutions and
regulations of the City of Huntsville, Texas.
Section 4: This ordinance shall take effect immediately upon its
passage by City Council.
