AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, REDEFINING JUNKED VEHICLE; AND MAKING OTHER
PROVISIONS RELATED THERETO.
WHEREAS The Texas Legislature amended the definition of Junked Vehicles by
House Bill No. 875;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, that
Section 1: Chapter 12, Motor Vehicles and Traffic, of the Code of
Ordinances of the City of Huntsville, Texas, is hereby amended by the
repeal of § 12 -100 as it presently exists, and by the adoption of a
new § 12 -100 that shall read as follows:
Sec. 12 -100. Junked vehicle - Defined.
A junked vehicle is a motor vehicle
(a) that is inoperative; and
(b) that does not have lawfully affixed to it either an unexpired
license plate or a valid motor vehicle safety inspection
certificate; that is wrecked, dismantled, partially dismantled,
or discarded; or that remains inoperable for a continuous period
of more than 45 days.
Section 2: This ordinance shall take effect and be in effect from and
after its passage, and it is so ordained.
