ORD 1986-29 - Reject GSU Rate IncreaseORDINANCE NO. 86-29
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, REJECTING THE REQUEST OF GULF STATES UTILITY COMPANY
TO INCREASE RATES FOR ELECTRICAL SERVICE IN HUNTSVILLE, AND
MAKING OTHER PROVISIONS AND FINDINGS RELATED THERETO.
WHEREAS, on November 18, 1986, Gulf States Utility Company (G.S.U.) filed
with the City of Huntsville, as well as with all other Texas cities in
its service area, an application for a major rate increase; and
WHEREAS, on the same day G.S.U. filed an application for a major rate
increase with the Texas Public Utility Commission (P.U.C.) for those
areas not regulated by cities (the rural rate case); and
WHEREAS, in the past, it has been the policy and practice of the P.U.C. to
use the rural rate case as the vehicle to determine the propriety of a
utility company's rate request; and
WHEREAS, G.S.U. has previously used the appellate jurisdiction of the
P.U.C. to maintain uniform rates within G.S.U.'s service area by
appealing every Texas City decision, favorable or not, to the P.U.C.;
and
WHEREAS, such policies and past practices of G.S.U. and the P.U.C. thwart
any meaningful rate regulations at a local level;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
Section 1: The request of G.S.U. for a major rate increase is hereby
denied.
Section 2: This Ordinance shall take effect immediately.
