ORDINANCE NO. 87 -36
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, AMENDING CHAPTER 30, COMMUNITY
DEVELOPMENT OF THE CODE OF ORDINANCE OF THE CITY;
ADOPTING CHANGES OF THE FEDERAL EMERGENCY MANAGEMENT
AGENCY TO THE NATIONAL FLOOD INSURANCE PROGRAM;
REQUIRING ALL MECHANICAL AND UTILITY EQUIPMENT TO BE
FLOOD PROOFED; REVISING REFERENCES TO MANUFACTURED
HOMES (MOBILE HOMES); PROVIDING A PENALTY OF $200 FOR
CERTAIN VIOLATIONS AND PROVIDING FOR THE PUBLICATION
AND EFFECTIVE DATES HEREOF.
WHEREAS the Federal Emergency Management Agency enacted certain changes to
the National Flood Insurance Program (NFIP) which became effective
October 1, 1986; and
WHEREAS the City of Huntsville desires to comply with at least the minimum
requirements of the NFIP; now therefore.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, THAT:
Section 1: Chapter 30, Community Development, of the Code of Ordinance of the
City of Huntsville, Texas, is hereby amended by the additions of a
new subsection (4) to 103.2 (1)(d) that shall read:
(4) All new construction or substantial improvements with
electrical, heating, ventilation, plumbing, and air conditioning
equipment and other service facilities that are designed and /or
located so as to prevent water from entering or accumulating
within the components during conditions of flooding.
Section 2: Chapter 30, Community Development, of the Code of Ordinance of the
City is hereby amended by the repeal of subsection 103.2(f) an
presently constituted, and by substanuating in its place a new
subsection (f) that shall read:
(f) Manufactured Homes.
(1) All manufactured homes placed within the floodplain shall be
installed using methods and practices that minimize flood
damage. Manufactured homes shall be anchored to resist
flotation, collapse, or lateral movement. Methods of
anchoring may include, but are not limited to, use of over -
the -top or frame ties to ground anchors. This requirement is
in in addition to applicable state and local requirements for
resisting wind forces.

(2) All manufactured homes placed, or substantially improved, in
any flood hazard area shall have the lowest floor elevated to
or above the base flood elevation and be securely anchored to
an adequately anchored foundation system.
(3) An evacuation plan indicating alternate vehicular access and
escape routes shall be filed with appropriate disaster
preparedness authorities for manufactured home parks and
manufactured home subdivisions located within the floodplain.
(4) A person commits an offense if he places any manufactured
home in the regulatory floodway in other than an existing
manufactured home park or manufactured home park subdivision.
Section 3: Chapter 30, Community Development, of the Code of Ordinances of
the City is amended by the adding or altering the following
definitions found in Chapter 15:
Manufactured Home- A structure transportable in one or more
sections, which is built on a permanent chaises ad is designed for
use with or without a permanent foundation when connected to the
required utilities, and includes mobile homes.
Section 4: Any person, firm, or corporation violating any provisions of
this Ordinance or failing to comply with any requirement of this
Ordinance will be guilty of a misdemeanor and subject to a fine of
up to Two Hundred Dollars ($200.00) upon conviction. Each day
during or upon which said person shall violate or continue
violation of any provision of this Ordinance or non - compliance
with any requirement of this Ordinance shall constitute a distinct
and separate offense. The violation of any provision of this
Ordinance or the failure to comply with any requirement of this
Ordinance shall each constitute a distinct and separate offense.
Section 5: If any section, subsection, sentence, clause, phrase or portion of
this Ordinance is for any reason held invalid or unconstitutional,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect any of the remaining
provisions of this Ordinance.
Section 6: All Ordinances and parts of Ordinances in conflict with the
provisions of this Ordinance are hereby repealed; provided,
however, that such repeal shall be only to the extent of such
inconsistency and in all other respects this ordinance shall be
cumulative of other Ordinances regulating and governing the
subject matter covered by this Ordinance.
Section 7: The City Secretary is hereby directed to cause the caption of this
Ordinance to be published at least twice within ten days of final
passage. This ordinance shall take effect ten (10) days after the
date of final passage.
