ORD 1987-22 - Elections - Altering General Election Date. 09-08-1987ORDINANCE NO. 87 -22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, ALTERING ITS GENERAL ELECTION DATE; AND MAKING OTHER FINDINGS AND PROVISIONS RELATED THERETO. WHEREAS before September 1, 1987, the City held its general election of officers on the first Saturday in April in accordance with its Homerule Charter and State law; and WHEREAS the Texas Legislature has altered the uniform election dates to prohibit local political subdivisions such as the City from conducting April elections; and WHEREAS the City must change its election date not later than September 10, 1987; and WHEREAS the City may hold its general election either on: the third Saturday in January; the first Saturday in May; or the second Saturday in August; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: Section 1: Regular City general elections shall be held on the third Saturday in January. Section 2: Sections 6.01 and 6.08 of the City Charter of the City of Huntsville are hereby directed to be amended to read as follows: SECTION 6.01. GENERAL ELECTIONS. Regular City general elections shall be held on the third Saturday in January. All Councilmembers and the Mayor shall be elected for two year terms, provided that the Mayor and Councilmembers from all Wards shall be elected on odd numbered years and all Councilmembers -at -Large shall be elected on even numbered years. In all odd year elections, each qualified voter shall vote for not more than one candidate for Mayor and for not more than one candidate for Councilmember from the qualified voter's ward. In all even year elections, each qualified voter shall vote for not more than one candidate for each of the four Council -at -Large positions. Said election shall be ordered by the Mayor, or in the event the Mayor fails to do so by the Council. The City Secretary shall give notice of such election by causing said notice to be published at least forty days prior to the date of such election in the official newspaper of the City. SECTION 6.08. NOTIFICATION AND QUALIFICATION OF CITY OFFICIALS. It shall be the duty of the City Secretary to notify all persons elected or appointed to office of their election or appointment. All officials newly elected at City general election may enter upon their duties on the next following Council meeting after the date of their election. All other newly elected or appointed officials may enter upon their duties immediately. Any official elected at a City general election must qualify by taking and subscribing their oath of office not later than the 30th day following the date of their election; otherwise, the office shall be deemed vacant. All other elected or appointed officials must qualify by taking and subscribing their oath of office within thirty days; otherwise, the office shall be deemed vacant. Section 3: If any Section or part of a section of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity shall not invalidate or impair the validity, force, or effect of any other Section or part of a Section of this Ordinance. Section 4: This Ordinance shall become effective immediately after its passage. PASSED AND APPROVED on this the 8th day of September, 1987.
