AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS
AMENDING ITS PERSONNEL POLICIES BY ADDING APPENDICES RELATED TO
CHARTER OFFICERS; ADOPTING A REVISED ORGANIZATIONAL CHART; AND
MAKING OTHER PROVISIONS RELATED THERETO.
Be it ordained by the City Council of the City of Huntsville, Texas, that:
Section 1: The Personnel Policies of the City of Huntsville, Texas, are
hereby amended by the adoption of appendices A, B, and C which
shall read as follows:
PERSONNEL RULES - APPENDIX A
Charter Officers - City Manager
At -will Employee
The City Manager is an at will employee of the Council and nothing
herein shall prevent, limit or otherwise interfere with the right of the
City Council to terminate the employment of the City Manager at anytime.
Salary
The City agrees to pay the City Manager an annual base salary.
Outside Employment
The City Manager shall devote full business time and best efforts to the
City and remain in the exclusive employment of the City.
Working hours; compensatory time
City Manager regular hours of work will be 8:00 a.m. to 5:00 p.m., five
(5) days per week, excepting vacation and holiday time. Reasonable
compensatory time off shall be permitted the City Manager, within the
general guidelines approved for other exempt employees, so long as such
compensatory time off does not interfere with the normal conduct of the
office of City Manager and is approved by the Mayor.
Other Compensation
In addition to an annual salary, the City Manager shall be entitled to
those benefits provided other open - salaried employees of the City such
as vacation leave, holiday leave, health insurance, life insurance,
retirement system contribution, sick leave, short -term and long -term
disability coverage. The City Manager shall not be entitled to
longevity pay, overtime pay, or license pay.
Other Personnel Rules
Except as otherwise specifically provided, the general provisions of the
personnel policies including those provisions related to discipline and
appeals are not applicable to the City Manager. Moreover, the City
Manager is expected to maintain a level of conduct as high or higher
than that established by the personnel policies.
Financial Disclosure
The City Manager shall report to the Mayor and council any ownership
interest in real property in the City and any financial interest in any
firm doing work or proposing to do work for the City. Such reporting
shall be made in writing within ten (10) days upon acquisition of the
real property and immediately upon notice of work or intended work for
the City.
Residency
The City Manager shall establish with six (6) months of employment
his /her principal place of residency within the corporate limits of the
City and shall maintain such residency at all times during employment by
the City.

Section 3: The City Council hereby adopts the following job descriptions for
its Charter Officers:
Job Title: City Manager
Reports To: Mayor and City Council
JOB SUMMARY
Under policy direction of the City Council, is responsible for planning,
controlling, directing, and coordinating the activities, functions and
programs of the City in accordance with the policies set forth by the City
Council.
PRINCIPLE DUTIES
Manages and directs the daily activities of the City; acts as a liaison
between the City Council, City employees including charter officers, and
citizens in the administration of policy; formulates, reviews, and submits the
annual budget to the City Council for adoption; determining City goals and
objectives as directed by Council; reviews and approves official directives
news releases and correspondence; attends City Council work sessions and
meetings; attends and participates in business, civic, and professional
programs on behalf of the City; develops and presents reports to the City
Council; performs all other duties as provided for by charter, ordinance, or
state law; reviews operations franchised by the City to ensure compliance;
executes deeds, easements, releases, contracts and other instruments binding
the City to financial agreements and obligations.
LICENSES OR CERTIFICATES REQUIRED
None
Job Title: City Attorney
Reports To: City Council / City Manager
JOB SUMMARY
Under policy direction of the City Council, and supervision of the City
Manager, is responsible for providing legal expertise, guidance, and counsel
to the City Council and the City management along with planning, organizing,
and directing the activities of the City Attorney's Office.
PRINCIPLE DUTIES
Prosecutes and represents the City in court cases; prepares legal opinions and
briefs; prepares ordinances, resolutions, contracts, and other legal documents
that pertain to the conduct of City business; attends meetings of the City
Council, as required; attends other meetings where City legal representation
and /or expert legal advice is required or requested; coordinates with outside
counsel; performs such other duties as provided for by charter ordinance, or
state law.
LICENSES OR CERTIFICATES REQUIRED
Must be licensed to practice law in the State of Texas.
Job Title: City Secretary
Reports To: City Council / City Manager
JOB SUMMARY
Under policy direction of the City Council, is responsible for planning,
organizing, and directing, the activities of the City Secretary's office
PRINCIPLE DUTIES
Signs, seals and maintains files of official City documents and records
including ordinances, resolutions, contracts, easements, deeds, judgments, and
budgets; coordinates the City's records management function; prepares, posts
and advertises city public meetings; attends City Council meetings, records
the proceedings, and prepares officia minutes; coordinates the conduct of
elections and referendums; following appropriate election laws concerning
filing, voting, reporting and other procedures; explaining City Council
protocol and procedures; assisting in planning City Council functions,
receives and files claims against the City; coordinates and issues licenses
for various municipal functions as required by ordinance; monitors the status
of City Council appointments to boards and commissions; administers oaths of
office; provides support and assistance to the the City Council as required.
LICENSES OR CERTIFICATES REQUIRED
Must obtain and maintain certificate as a Texas Registered Professional
Municipal Clerk.
Job Title: Municipal Court Judge
Reports To: City Council /City Manager
JOB SUMMARY
Presides over a municipal court of law.
PRINCIPLE DUTIES
Adjudicate non -jury cases and preside over jury criminal cases not involving
penitentiary sentences: Adjudicate violations of city ordinance; Adjudicate
juvenile cases punishable by fine only for persons ten to sixteen years of
age; Assign alternative sentencing such as work or counseling; Act as a
Magistrate for the purpose of giving warnings in felony criminal cases;
Consider requests for a search warrant in criminal matters; Determine the
amount of criminal bonds and adjudicates indigence; Read or listen to
plaintiff allegations in civil and administrative actions such as the
disposition of property and determines if actions are supported by facts;
Examine evidence in criminal cases to determine truth of charges or if
evidence supports charges; Listen to presentation of cases, rules on
admissibility of evidence and methods of conducting testimony; Issue arrest
warrants; Settle disputes between citizens; and Levy fines and costs,
determine bond forfeitures, and maintain docket book for criminal offenses.
LICENSES OR CERTIFICATES REQUIRED
Must be licensed to practice law in the State of Texas. Must obtain and
maintain a state certificate for Texas Municipal Court Judges.
Section 4: This ordinance shall take effect immediately from and after its
adoption.
