AN ORDINANCE AMENDING THE CITY OF HUNTSVILLE, TEXAS CODE OF ORDINANCES,
SPECIFICALLY CHAPTER 38 "SOLID WASTE" BY AMENDING SECTION 38 -8; MAKING OTHER
PROVISIONS AND FINDINGS THERETO; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Huntsville Code of Ordinances ( "Code "), Chapter 38 governs solid waste;
WHEREAS, the City Council finds that an ordinance providing for rules and regulations concerning solid
waste and collection of residential refuse is good and necessary for the public safety, health and
welfare; and
WHEREAS, notice of the agenda for this meeting, was given in accordance with law by posting the same
at the place reserved and designated for notices of public meetings and public activities and prior to the
adoption of this ordinance;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that:
SECTION 1: The facts and matters set forth in the preamble of this Ordinance are found to be true
and correct and are hereby adopted, ratified, and confirmed.
SECTION 2: Huntsville Code of Ordinances Chapter 38 "SOLID WASTE" is hereby amended by
amending sections 38 -8(a) and 38 -8(g) in section 38 -8 titled "Yard waste and heavy trash" in Article I "IN
GENERAL" which shall read as follows as shown on the attached Exhibit "A ".
SECTION 3: All ordinances or parts of Ordinances that are in conflict or inconsistent with the
provisions of this Ordinance shall be, and the same are hereby, repealed and all other ordinances of the
City not in conflict with the provisions of this Ordinance shall remain in full force and effect.
SECTION 4: Should any paragraph, sentence, clause, phrase or section of this Ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this
Ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid,
illegal or unconstitutional.
SECTION 5: This Ordinance becomes effective upon adoption by the City Council.
SECTION 6: This Ordinance becomes enforceable at 12:01 a.m. on April 3, 2015.

Chapter 38 - SOLID WASTE
ARTICLE I. — IN GENERAL
"Sec. 38 -8. Yard waste and heavy trash.
(a) Yard waste trimmings such as tree trimmings, hedge clippings and similar materials
generated from residential properties shall be cut into lengths not to exceed four feet, no
larger than four inches in diameter and securely tied in bundles not more than two feet
thick or weighing more than 50 pounds. All leaves, grass, pine needles, or any loose yard
waste material are required to be placed in compostable bags or a trash container (other
than the City - provided garbage and recycle containers). All material must be placed within
two feet of the nearest city street.
(g)
The city shall provide heavy trash /large yard waste collection service on the second and
fourth Wednesday of each month on a call -in basis except for weeks with a city holiday on
said Wednesday. Requests for pickup shall be placed a minimum of one week prior to the
scheduled collection day. No heavy trash may be placed at the street's edge earlier than five
days prior to the scheduled collection day. There shall be a fee charged for Residential
Heavy Trash call in service and said fee will be as described in the city schedule of fees and
charges.
