AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING SECTION
21.03.03 OF THE CODE OF ORDINANCES TO REQUIRE AN OPAQUE FENCE
ENCLOSING AUTOMOBILE SALVAGE YARDS; PROVIDING A GRANDFATHER
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
that:
Section 1: That Chapter 21 "Offenses and Miscellaneous Provisions," Part 21.03 "Salvage
Operations Generally," Section 21.03.03 "Maintenance of premises; fencing" is amended to
hereinafter read as follows:
21.03.03 Maintenance of premises; fencing.
Any person, partnership or corporation granted a license as provided for in section 21.03.02
hereof, shall keep the premises used in the operation and maintenance of said business in a
neat and orderly condition. The property and premises on which said business is conducted
and where such disassembled or stored motor vehicles are kept shall be enclosed by a tight,
vertical fence or wall constructed of nontransparent materials at least six (6) feet in height
and said fence or wall shall be kept in a neat condition at all times, and no wrecked or
disassembled motor vehicle, or stored, worn out, wrecked or abandoned motor vehicle shall
be allowed to remain outside such fenced or walled area. The fence does not need to be
constructed of nontransparent materials in those locations where the disassembled or stored
motor vehicles cannot be seen from a public right-of-way or from property used for
residential or multi-family purposes.
Any person, partnership or corporation having a valid license granted pursuant to section
21.03.02 as of the effective date of this Ordinance shall have one (1) year from the effective
date of this Ordinance to comply with the requirements of this section. City Council may
grant an extension of time for compliance with the requirements of this section upon a
showing of good cause by the applicant for the extension.
Section 2: If any portion of this Ordinance shall, for any reason, be declared invalid by any
court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and
the City Council determines that it would have adopted this Ordinance without the invalid provision.
Section 3: This Ordinance shall take effective immediately from and after the date of its
passage.
