ORD 1999-15 - Amending Title 19 08-06-1999ORDINANCE NO. 99-15 AN ORDINANCE AMENDING TITLE 19 OF THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY AMENDING SECTION 19.01.02 "MANUFACTURED HOMES, RECREATION VEHICLE PARKS; PERMIT REQUIRED" TO CLARIFY WHO MUST OBTAIN A PERMIT BEFORE PLACING A MANUFACTURED HOME ON A LOT; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Huntsville has experienced problems with manufactured homes and mobile homes being placed on lots within the City without first obtaining the necessary permits from the City; and WHEREAS, the responsibility for obtaining a permit and the type of permit(s) needed should be clarified in the City Code; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, that: SECTION 1: Title 19 "Manufactured Homes and Recreational Vehicles," Part 19.01 "In General," Section 19.01.02 "Manufactured homes, recreational vehicle parks; permit required" is amended to hereinafter read as follows: 19.01.02 Manufactured Homes, Recreational Vehicle Parks; Permits Required. A. The definitions found in Article 5221f, Vernon's Texas Civil Statutes, as amended from time to time (the "Manufactured Housing Standards Act), shall apply to this Section. B. (1) A person shall not place or allow to be placed a manufactured home or mobile home on any lot within the corporate limits of Huntsville without first obtaining a Certificate of Compliance in accordance with the requirements of the City of Huntsville's Development Code, Title 32. (2) A person shall not connect or allow to be connected any manufactured home or mobile home within the corporate limits of Huntsville to any water, sewer, gas or electrical connection without first obtaining the necessary permits, including a Certificate of Compliance, in accordance with the requirements of the City of Huntsville Development Code, Title 32. (3) A person shall not construct, alter or extend a manufactured home development without first obtaining the necessary permits or authorization to do so in accordance with the requirements of the City of Huntsville Development Code, Title 32. ORDINANCE NO. 99-15 Page 2 (4) A person shall not construct, alter or extend a recreational vehicle (RV) park without first obtaining the necessary permits or authorization to do so in accordance with the requirements of the City of Huntsville Development Code, Title 32. C. It shall be unlawful for any person or his/her representative, agent, seller, or installer to violate any of the provisions enumerated in Subsection B. above, and any person violating or failing to comply with Subsection B shall be fined, upon conviction, in accordance with the provisions in Section 1602 of Title 32, and a separate offense shall be deemed committed upon each and every day that this provision of the Code is violated. SECTION 2: This Ordinance shall be cumulative of all other ordinances of the City and shall not repeal any of the provisions of those ordinances except in those instances where the provisions ofthose ordinances are in direct conflict with the provisions ofthis Ordinance. SECTION 3: If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, such invalidity shall not affect the remaining provisions hereof and the Board hereby determines that it would have adopted this Ordinance without the invalid provision.
