AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING ORDINANCE
NO. 2000-12 BY CHANGING THE REFERENCE TO BUILDING OFFICIAL TO ON -SITE
SEWAGE FACILITIES INSPECTOR IN PART 17.04.05 AND PART 17.04.07 AND
REMOVING THE CUMULATIVE PROVISIONS OF THE ORDINANCE; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville passed Ordinance No. 2000 -12 adopting Chapter 366 of
the Texas Health and Safety Code and authorizing Huntsville to regulate the use of on -site sewage
disposal facilities in its jurisdiction; and
WHEREAS, the Texas Natural Resource Conservation Commission has requested that the
City make two changes to Ordinance No. 2000 -12; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
that:
SECTION 1: (a) Part 17.04.05 "Duties and Powers." of Ordinance No. 2000 -12 is hereby
amended to hereinafter read as follows:
Part 17.04.05 Duties and Powers.
The On -Site Sewage Facilities Inspector ( "OSSF Inspector ") or inspectors of the City of
Huntsville, Texas, are herewith declared the designated representative(s) for the enforcement
of these Rules within the jurisdictional area. The OSSF Inspector(s) must be approved or
certified by the Texas Natural Resource Conservation Commission before assuming the
duties and responsibilities of an OSSF Inspector of the City of Huntsville.
(b) Part 17.04.07 "Appeals." of Ordinance No. 2000 -12 is hereby amended to hereinafter read
as follows:
Part 17.04.07 Appeals.
Persons aggrieved by an action or decision of an OSSF Inspector may appeal such action
or decision to the City of Huntsville Board of Appeals.
(c) Section 3 of Ordinance No. 2000 -12 is hereby amended to hereinafter read as follows:
SECTION 3: All ordinances and parts of ordinances in conflict with the provisions of this
Ordinance are hereby repealed.
SECTION 2: This Ordinance shall become effective from and after its date of passage and
upon approval of the Texas Natural Resource Conservation Commission.
