ORD CC 11/06/1945 - abandoning Houston Street to Huntsville Cotton Oil CompanyORDINANCE NO. AN ORDINANCE RATIFYING AND CONFIRMING THE CLOSING AND ABANDONING OF A STREET FORMERLY SITUATED BETWEEN BLOCK NO, 39 AND BLOCK NCB. 42; RATIFYING AND CONFIRMING CONVEYANCE FROM CITY OF HUNTSVILLE, TEXAS, TO HUNTSVILLE COTTON OIL COM- PANY, DATED FEBRUARY 18, 1914; DECLARING AN EMERGENCY AND FIXING A TIME FOR THIS ORDINANCE TO BECOME EFFECTIVE. WHEREAS, prior to February 18, '1914, the City Coun- cil of the City of Huntsville, Texas, by proper means, author- ized the closing and abandoning of the street theretofore existing between Block No. 39 and Block No. 41 (sometimes theretofore known as Houston Street) in the City of Huntsville, Texas, and for a valuable consideration paid to said City of Huntsville, authorized the deeding of the property formerly in such street to Huntsville Cotton Oil Company; and pursuant thereto, a dead was executed, acknowledged and delivered by the duly authorized officer of the said City to Huntsville Cotton Oil Company, which deed is dated February 18, 1914 and recorded in Volume 36, pages 310 -311, of the Deed Records of Walker County, Texas; and WHEREAS, the official records of the said City, in- eluding its ordinances, passed and adopted in the year, 1914 and in prior years,have been destroyed by fire, and it is the wish and desire of the present owner of the said land and of the City Council of the City of Huntsville, Texas, that the City, by its official records, show the closing and abandoning of the said street and the sale by the City of such property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: THAT, the action of the City of Huntsville, in closing and abandoning the said street formerly existing between Block No. 39 and Block No. 42, in the, City of Huntsville, Texas, prior to Feburary 18, 1914 (sometime prior to said date referred to as Houston, Street), be in every manner ratified and con - firmed, and that such street is hereby closed and permanently abandoned as a street and thoroughfare for traffic of all kinds and for all purposes; and THAT, the action of the City of Huntsville, Texas, by and through its then Mayor T. C. Gibbs, in conveying the property formerly situated in said street between Block No. 39 and Block No. 40 in Huntsville, to Huntsville Cotton Oil Company, by deed dated February 18, 1914, recorded in Volume 369 page 310.311, Deed Records of Sulker County, Texas, be fully and completely ratified and confirmed as the official act of the City of Huntsville; that by this ordinance, the City of Huntsville, Texas, does hereby recognize such deed as a valid and enforceable conveyance from the City of Huntsville, Texas, according to its terms and conditions; and THAT, the loss by fire of the official ordinances of the City passed and adopted in the year, 1914 and in prior years thereto, and the immediate need of the City to properly show of record the closing and abandon. -ag of the said street, creates an imperative public necessity that all requirements for the reading of this ordinance more han one time be sus- pended and this ordinance be in full force and effect immed- iately upon its passage and adoption.
