AN ORDINANCE AMENDING TITLE 9 BUILDINGS AND
BUILDING REGULATIONS OF THE HUNTSVILLE, TEXAS
MUNICIPAL CODE AND THE "SCHEDULE OF FEES" TO
INCLUDE PROVISIONS FOR THE LOCAL REGISTRATION
OF STATE LICENSED AIR CONDITIONING,
REFRIGERATION, PLUMBING AND IRRIGATION
CONTRACTORS, AND THE LOCAL REGISTRATION OF
STATE REGISTERED RESIDENTIAL CONTRACTORS WITH
ASSOCIATED FEES, CONTAINING A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville is a home rule city acting under its
charter adopted by the electorate pursuant to the Texas Constitution and the
Local Government Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF HUNTSVILLE, TEXAS:
SECTION 1. Title 9 Buildings and Building Regulations, Section 9.02.06
International Mechanical Code, shall be appended as follows:
8. Persons performing air conditioning and refrigeration work must be licensed
by and in accordance with the Texas Department of Licensing and Regulation
and shall register annually with the City of Huntsville, see "`Schedule of Fees ".
SECTION 2. Title 9 Buildings and Building Regulations, Section 9.02.07
International Plumbing Code, shall be amended as follows:
11. Section 106.4 is amended to read:
106.4 —Contractor License.
All persons who engage in or work at the actual installation, alteration, repair
and renovating of plumbing shall possess either a master or journeyman
plumber's license in accordance with the provisions of the state plumbing license
law and shall register annually with the City of Huntsville. It shall be the
responsibility of the registered plumber to notify the permit clerk of any change
of employment to another company or under another master plumber, see
"Schedule of Fees".

106.4.b.3 Plumbing work done by a licensed irrigator or licensed installer when
working and licensed under the Licensed Irrigators Act, Article 8751, V.T.C.S., as
amended. Licensed irrigators or installers shall register annually with the City of
Huntsville prior to permitting and performing irrigation work, see "Schedule of
Fees".
SECTION 3. Title 9 Buildings and Building Regulations, Section 9.02.10
Building Permit Required, shall be appended as follows:
A residential building permit for new construction or remodel construction shall
not be issued unless the contractor requesting the permit is registered with the
City of Huntsville. Application for local registration requires proof of current
registration with the Texas Residential Construction Commission, see "Schedule
of Fees".
SECTION 4. The "Schedule of Fees" shall be amended as follows:
CONTRACTOR REGISTRATION
Class A or B air conditioning and refrigeration contractor ....................... $60.00
Person holding a Master Plumber's license ........................................... $60.00
Person holding a Journeyman's Plumber's license .................................. $12.00
Person holding an Irrigator or Installer license ...................................... $60.00
Residential Construction contractor ............................ .........................$60.00
SECTION 5. SEVERABILITY CLAUSE
If any part of the provision of this ordinance or the application of this ordinance
to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, the judgment shall be confined in its operation to the part, provision,
or application directly involved in the controversy in which the judgment shall
be rendered and it shall not affect or impair the validity of the remainder of these
regulations or the application of them to other persons or circumstances. The
City Council hereby declares that it would have enacted the remainder of these
requirements even without any such part, provision, or application which is
judged to be invalid.

SECTION 6. EFFECTIVE DATE
This ordinance shall be in full force and effect on October 1, 2005.
