AN ORDINANCE AMENDING TITLE 32 COMMUNITY
DEVELOPMENT OF THE HUNTSVILLE, TEXAS MUNICIPAL
CODE TO INCLUDE PROVISIONS FOR ADDITIONAL
REQUIREMENTS AND INFORMATION IN SITE PLAN
DEVELOPMENT, CONTAINING A SEVERABILITY CLAUSE
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville is a home rule city acting under its
charter adopted by the electorate pursuant to the Texas Constitution and the
Local Government Code.
WHEREAS, the City of Huntsville finds it necessary to improve the pre -
construction and site layout processes.
WHEREAS, the City of Huntsville wishes to minimize costly errors for
property owners and contractors during the construction and permitting process.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF HUNTSVILLE, TEXAS:
SECTION 1. Chapter 2 Development, Division and Use; Permits Required for
Development, Division and Use; Certificates of Compliance and Occupancy;
Platting Requirements, Penalties and Enforcement, shall be amended as
follows:
§203.1 Development plans or plats
The developer shall submit a development site plan, fulfilling the application
requirements for obtaining a development permit under this Code. The
developer shall also provide a copy of any instrument that contains a
restriction on the use of, or construction of, the lot, with a copy of any
amendment, judgment or other document affecting the use of the property.
Whenever the Planning Officer determines that additional information is required to
verify correct placement on the property, he may require additional site plan
documents to be prepared by a registered design professional including, but not
limited to, an architect, engineer or land surveyor.
SECTION 2. SEVERABILITY CLAUSE
If any part of the provision of this ordinance or the application of this ordinance
to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, the judgment shall be confined in its operation to the part, provision,

or application directly involved in the controversy in which the judgment shall
be rendered and it shall not affect or impair the validity of the remainder of these
regulations or the application of them to other persons or circumstances. The
City Council hereby declares that it would have enacted the remainder of these
requirements even without any such part, provision, or application which is
judged to be invalid.
SECTION 3. EFFECTIVE DATE
This ordinance shall be in full force and effect on January 1, 2007.
