AN ORDINANCE AMENDING TITLE 28 TAXICABS AND
OTHER VEHICLES FOR HIRE OF THE HUNTSVILLE, TEXAS
MUNICIPAL CODE TO INCLUDE REVISIONS TO SECTION
28.02.17 AND 28.07.04; CONTAINING A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville is a home rule city acting under its
charter adopted by the electorate pursuant to the Texas Constitution and the
Local Government Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF HUNTSVILLE, TEXAS:
SECTION 1. Title 28 Taxicabs and Other Vehicles for Hire, Section 28.02.17,
Schedules-Audits; school children, shall be amended as follows:
Section 28.02.17 Schedules--Adults; school children.
The rates to be charged for a taxicab service shall be as follows, and no greater rate
shall be charged:
A. One dollar and twenty cents ($1.20) for thefirst one-sixth mile or fraction
thereof;
B. One dollar and twenty cents ($1.20) for each mile thereafter or fraction thereof,
C. Aflat charge of one dollar ($1.00) for each additional passenger over one
occupying the taxicab on the same trip or part thereof;
D. Twenty-one ($0.21) cents per minute /twelve dollars and sixty cents ($12.60)
per hour for waiting time, and when the taxicab is engaged by the hour,
E. In all cases, the minimum charge per trip shall not be less than three dollars
($3.00) nor more than five dollars ($5.00). The taxicab service shall determine
their minimum fee during permit renewal. Once designated, the minimum fee may
only be changed during the yearly renewal. The minimum fee shall be prominently
posted with the rate schedule in each taxicab.
F. Notwithstanding anything to the contrary in this section or in section 28.02.18
of this part, any independent school district may contract with any taxicab

permitholder for the transportation of people to and from school upon any terms as
to compensation, route and time of furnishing the service as be agreed to in such
contracts; and in transporting people under such contract it shall not be necessary
for the taxicab to use the taximeter.
1. Taxicab service furnished pursuant to any contract entered into between the
permitholder and a third party, including the city, shall not be subject to this
section provided that the contract has been approved by the chief of police.
G. A taxicab may be so designed that a passenger using a wheelchair can be
transported while occupying the wheelchair and can be taken into and out of the
cab without leaving the wheelchair. The wheelchair shall be securely fastened in
place while the cab is in motion. The design of such cab shall be subject to approval
of the chief of police as to its reasonable safety. A charge of two dollars for each trip,
in addition to the regular fare, shall be made for each passenger transported in a
wheelchair.
SECTION 2. Title 28 Taxicabs and Other Vehicles for Hire, Section 28.07.04
(B)(3), Insurance, shall be amended as follows:
Section 28.07.04 Insurance.
3. The maximum amount recoverable under such policy shall not be less than the
minimum established by the Texas Department of Transportation relating to
motor carriers.
SECTION 3. SEVERABILITY CLAUSE
If any part of the provision of this ordinance or the application of this ordinance
to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, the judgment shall be confined in its operation to the part, provision,
or application directly involved in the controversy in which the judgment shall
be rendered and it shall not affect or impair the validity of the remainder of these
regulations or the application of them to other persons or circumstances. The
City Council hereby declares that it would have enacted the remainder of these
requirements even without any such part, provision, or application which is
judged to be invalid.
SECTION 4. EFFECTIVE DATE
This ordinance shall be in full force and effect on October 1, 2006.
