Legal Notice
- Users in Significant Noncompliance
The definition of Significant Noncompliance is
established in the Code of Federal Regulations,
Title 40, Subchapter N, Part 403.8(f)(2)(vii), as
revised on July 24, 1990, and in the City of
Huntsville Code of Ordinance Chapter 46 Article III,
Industrial Wastewater Standards. Listed below are
facilities in Significant Noncompliance during the
2nd Rolling Quarter of the 2012-2013 Pretreatment
Year, the criterion for placing the facility on the list,
enforcement actions taken by the Control Authority
of the City of Huntsville Industrial Pretreatment
Program to bring the User into compliance and the
User's current compliance status. The publication,
which is published annually and quarterly if
applicable, in the Huntsville Item, includes those
Users in Significant Noncompliance during the
Control Authority's 2012-2013 Pretreatment Year
(August 1, 2012 through July 31, 2013).
The evaluations for Significant Noncompliance with
effluent limits are based on the definition and
guidance provided by EPA Region VI in a letter
dated October 24, 1991.
Criterion: "Chronic violations of wastewater
discharge limits, those in which 66% or more of the
measurements taken during a six-month period
exceed, by any magnitude, the daily maximum or
monthly average limit for the same pollutant;
Technical Review Criteria (TRC) violations, those in
which 33% or more of the measurements taken
during a six-month period exceed the product of the
limit multiplied by the applicable TRC (1.4 for oil
and grease, carbonaceous biochemical oxygen
demand and total suspended solids and 1.2 for all
other pollutants except pH)." One (1) Categorical
Industrial User (CIU) is listed under this criterion:
Gardner Glass Products, Inc. (CIU) was not in
Chronic Violation during the 2nd Rolling Quarter.
However, Gardner Glass Products, Inc. did exceed
the Technical Review Criteria (silver limit 0.09*TRC
1.2 = 0.108mg/L) daily maximum limit for total silver
in the second rolling quarter; August 2012 -January
2013 34%. The Control Authority conducted
enforcement activities on an escalating scale,
including Notices of Violation and Compliance
Orders with fines. The User is modifying
pretreatment procedures and working with
consultants in returning to compliance.
