Listed below are facilities in Significant Noncompliance during the 2011-2012 Pretreatment Year, the criterion for placing the facility on the list, enforcement actions taken by the Control Authority of the City of Huntsville Industrial Pretreatment Program to bring the User into compliance and the User's current compliance status. The publication, which is published annually in the Huntsville Item, includes those Users in Significant Noncompliance during the Control Authority's 2011-2012 Pretreatment Year (August 1, 2011 through July 31, 2012). The evaluations for Significant Noncompliance with effluent limits are based on the definition and guidance provided by EPA Region VI in a letter dated October 24, 1991. Criterion: Code of Federal Regulations Title 40, Subchapter N, Part 403.8(f)(2)(viii)(G) Failure to accurately report noncompliance; One (1) Categorical Industrial User (CIU) is listed under this criterion: Gardner Glass Products, Inc. (CIU) failed to properly report a spill/discharge occurring on January 24, 2012 to the Control Authority. Gardner Glass failed to comply with both the verbal and written notification timeframes as required in their permit.The Control Authority conducted enforcement activities on an escalating scale, including a Compliance Order with fine. The User has modified its pretreatment procedures, paid the fine and continues to report fewer violations than previous years.
