COMBINED NOTICE OF FINDING OF NO SIGNIFICANT
IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS

This Notice shall satisfy the above-cited two separate but related procedural notification
requirements.
REQUEST FOR RELEASE OF FUNDS
On or about September 13th , 2011, the City of Huntsville will submit a request to the Texas
Department of Housing and Community Affairs (TDHCA) for the release of HOME
Reservation System Program Contract # 2010-0029 funds under Title II of the Cranston
Gonzalez National Affordable Housing Act of 1990, as amended, to undertake a project
known as Huntsville HOME Reservation Program for the purpose of
rehabilitation/reconstruction of up to fifteen (15) sub -standard, owner -occupied properties
throughout Huntsville. Rehabilitation/reconstruction activities are planned to begin upon funding
notification. The exact breakdown of the budget is unknown at this time since this is a
Reservation System and is based on first come, first serve until funds are exhausted. If funds are
available, approximately $1,200,000.00 will be spent on the rehabilitation/reconstruction of up to
fifteen (15) homes (max $80,000 per home). This project is following a tiering plan, and funds
will not be committed to a specific activity until after the site-specific review is complete.
On or about September 13th, 2011, the City of Huntsville will also submit a request to the
Texas Department of Housing and Community Affairs (TDHCA) for the release of
Neighborhood Stabilization Project funds under Public law 110-289 of the Housing and
Economic Recovery Act (HERA) of 2008, as amended, to undertake a project known as
Huntsville Neighborhood Stabilization for the purpose of purchase of at least two (2) foreclosed
properties for single family home rehabilitation, at least two (2) abandoned properties for
demolition and single family home reconstruction, and at least eight (8) new construction of
affordable, energy-efficient houses on abandoned vacant lots for low to moderate income
residents in the City of Huntsville. Contract # 77090000126. Award amount is estimated at
$1,533,609.00. This project is following a tiering plan, and funds will not be committed to a
specific activity until after the site-specific review is complete
FINDING OF NO SIGNIFICANT IMPACT
The City of Huntsville has determined that the project will have no significant impact on the
human environment. Therefore, an Environmental Impact Statement under the National
Environmental Policy Act of 1969 (NEPA) is not required. Additional project information
is contained in the Environmental Review Record (ERR) on file at Dr. Sherry McKibben's
o Tice -in &ity Ha-li(1-2-12 Avenue MHuntsville,—Texas-77340) and may be examined or copied
weekdays ( 8 ) A.M. to (5 ) P.M.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to
comment on the project may submit written comments to the office of Dr. Sherry McKibben
at Huntsville City Hall. All comments received by September 12th, 2011 will be considered by
the City of Huntsville prior to authorizing submission of a request for release of funds.
Commenters should specify which part of this Notice they are addressing.
RELEASE OF FUNDS
The City of Huntsville certifies to Texas Department of Housing and Community Affairs
(TDHCA) that Mr. William Baine in his capacity as City Manager of Huntsville consents to
accept the jurisdiction of the Federal Courts if an action is brought to enforce
responsibilities in relation to the _environmental review process and that these
responsibilities have been satisfied. Texas Department of Housing and Community Affairs
(TDHCA) approval of the certification satisfies its responsibilities under NEPA and d rela_ ted
laws and authorities, and allows the City of Huntsville to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
Texas Department of Housing and Community Affairs (TDHCA) will consider Qbjections to its
release of funds and the City of Huntsville certification received by September 28th, 2011, or
a period of fifteen days from its receipt of the request (whichever is later) only if they are
on one of the following bases: (a) the certification was not executed by the Certifying
Officer or other officer of the City of Huntsville approved by Texas Department of Housing
and Community Affairs (TDHCA); (b) the City of Huntsville has omitted a step or failed to
make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant
recipient or other participants in the project have committed funds or incurred costs not
authorized by 24 CFR Part 58 before approval of a release of funds by Texas Department of
Housing and Community Affairs (TDHCA); or (d) another Federal agency acting pursuant to
40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from
the standpoint of environmental quality. Objections must be prepared and submitted in
accordance with the required procedures (24 CFR Part 58) and shall be addressed to Texas
Department of Housing and Community Affairs (TDHCA) at P.O. Box 13941, Austin, Texas
78711. Potential objectors should contact Texas Department of Housing and Community
Affairs (TDHCA) to verify the actual last day of the objection period.
