MIN CC 05/05/1992CITY COUNCIL MEETING OF MAY 5, 1992 BOOK "R" 51 MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 5TH DAY OF MAY, 1992 IN THE CITY HALL COUNCIL CHAMBERS, LOCATED AT 1212 AVENUE M IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS AT 5:30 P.M. The Council met in a regular session with the following members present: W. H. Hodges, Mayor Officers: Gary Bell William H. Knotts, Jr. Gene Pipes, City Manager Ila G. Gaines Ronald L. Lange Scott Bounds, City Attorney William B. Green Dan S. Davis Melba Byers, City Secretary Charles Robinson ABSENT: James L. Carter CITIZENS /INPUT INQUIRY Mayor Hodges called the meeting to order and asked if anyone would like to make any comments in this portion of the meeting. Dr. P. L. Allred was presented with a Proclamation for 'Better Hearing and Speech Month by Mayor Hodges. Bette Nelson voiced her concern regarding "garage sales" in Huntsville and Walker County. She stated that resale and antique businesses play a major role in revenues for the City and stated instances of people having on -going garage sales plus people from out -of -town having garage sales in Huntsville on a regular basis with Huntsville receiving no revenue from these sales. She requested that the Council consider some type of restrictions /permitslpolicy for garage sales. Mayor Hodges referred this matter to City Attorney Bounds for research and report back to Council with recommendations. City Attorney Bounds stated he had discussed this problem with the Police Department to prevent use of various parking lots and other areas. The general advice is if an individual has a garage sale more than two week -ends in a row, then let's check and be sure that individual has all the necessary sales tax permits and other information — we will make inquiries. ' We make inquiries on a complaint basis now. So, we are aware of this problem, and if contacted, individuals generally move on if they do not have a sales tax permit. Councilmember Gaines stated her appreciation to Betty and her group for promoting businesses in Huntsville and commended her on her efforts to promoting the City- of Huntsville and playing a major role in revitalizing the downtown Huntsville area. REGULAR SESSION - CALL TO ORDER Mayor Hodges called the regular session to order. Invocation by Councilmember Davis. CONSIDER MINUTES OF APRIL 28, 1992 Councilmember Gaines made a motion to approve the minutes of April 28 1992, and Councilmember Knots seconded the motion All were in favor and the motion passed unanimously. NOTE: Councilmember Carter was absent. ATTENDING CITIZENS None present. CONSIDER ORDINANCE NO. 92 -5 -5.1 Councilmember Green made a motion to approve the first reading of Ordinance 92- 5 -5.1, a franchise agreement for use of the public right -of -ways to operate a telecommunications business by Southwestern Bell Telephone Company and prescribing the annual compensation due the City and conditions governing the right -of -ways use and performance of construction. Councilmember Green stated the Finance Committee had a limited consensus of approval of this motion. Councilmember Davis made a second. The motion passed unanimously. CONSIDER BID NO. 89 -08 -05 City Manager Pipes stated he had a single bid from Spivey Construction Company which has not been opened. This j bid is for Curb and Gutter Work on 8th Street and Avenue J. Mayor I-Iodges recommended opening the bid, and if it is within budget to award the bid. Councilmember Green made a motion to open the bid with a second by Councilmember Gaines. The motion passed unanimously. City Manager Pipes then gave the bid to Public Works Director, Johnny Poteete and Director of Engineering Design, Glenn Isbell, to review and report back to Council. Staff members Poteete and Isbell recommended acceptance of the bid which was for $23,648.80. Budgeted was approximately $33,000.00. Councilmember Gaines made a motion to award the bid with a CITY COUNCIL MEETING OF MAY 5, 1992 BOOK "R" 52 second by Councilmember Bell. 'ne motion passed unanimously. CITY MANAGER'S REPORT City Manager Pipes stated that each Councilmember has been provided with a copy of the Policies and Procedures for the Fire Department in their agenda packet. He also informed Council that members of the Fire Department had been provided with copies and had indicated receipt of policies and procedures by signing for their packet. Also, full -time, part -time and volunteer employees have received detailed explanations on the policies and procedures. This is provided for your information and does not require any formal action by Council. City Manager Pipes also brought attention to the Huntsville 2020, The Cultural Planning Project, report which was provided for each Councilmember for their information. No formal action is required by Council. - MAYOR'S ACPIVITY REPORT Mayor Hodges reminded everyone of the Cinco de Mayo celebration in progress at the Jane Monday Amphitheater located behind City Hall. He encouraged everyone to attend after adjournment of City Council Meeting. CITY COUNCILMEMBER ACPION No activity. MEDIA INQUIRIES There was no media activity; however, City Manager Pipes informed Council that he had a note from James Patton, Walker County Clerk, to Mayor Hodges thanking the City Staff for all their many kindnesses they showed to the two deputies during the time of the early voting in February, March and April this year. City Manager Pipes also informed Council that he had a letter from Gerry Haverland, Fire Marshal City of Huntington, complementing and thanking Fireman John Hobbs for teaching a portion of a "Fire Prevention" class at the Livingston Fire School ' Mr. Haverland stated he was well prepared, obviously knew what he was talking about, and presented an excellent class and felt we were fortunate to have him represent Huntsville's Fire Department.
