AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, FINDING A PUBLIC PURPOSE FOR THE SALE OF CITY -OWNED
LOTS FOR LOW OR MODERATE- INCOME HOUSING; AUTHORIZING THE
SOLICITATION OF PROPOSALS FOR THE PURCHASE OF THE LOTS; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville purchased property in the 900 block of
Avenue H in order to contract with a non profit corporation for the construction of low
and/or moderate - income housing;
WHEREAS, the City Council finds that there is a great need for low or moderate -
income housing within the City;
WHEREAS, the property should be sold to an appropriate non - profit organization
to provide low and moderate- income housing in Huntsville and Walker County and to
promote home ownership by low- income individuals and families; and
WHEREAS, the City Council finds that it would be appropriate to sell the
property that the City owns in the 900 block of Avenue H to suitable non -profit
organization in order for the construction of low and /or moderate - income housing; and
WHEREAS, the City Council specifically finds that it would be appropriate to
sell this property at less than its fair market value in order to provide such housing;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS, that:
SECTION 1: The property owned by the City of Huntsville, Texas, in the 900
block of Avenue H shall be offered for sale to a nonprofit organization that develops
housing for low- income individuals and families as a primary activity or a non -profit
corporation described by 26 U.S.C. Section 501(c)(3) that has been incorporated in this
state for at least one year, has a corporate purpose to develop affordable housing that is
stated in its articles of incorporation, by -laws or charter, has at least one -fourth of its
board of directors residing in the municipality, and engages primarily in the building,
repair, rental or sale of housing for low- income individuals and families for the purpose
of constructing low and/or moderate - income housing and selling the same to qualified
purchasers, and the City Manager is authorized to determine terms and conditions for the
bidding for the sale of said property consistent with this Ordinance and which will
provide low and/or moderate - income housing within the City.
SECTION 2: Low - income individuals and families means individuals and
families earning not more than eighty per cent (80 %) of the area median income or
applicable federal poverty line, as determined under Section 2306.123 or Section
2306.1231 of the Texas Government Code.
SECTION 3: This Ordinance shall become effective from and after the date of its
passage.
