AN ORDINANCE AMENDING ORDINANCE NUMBER 2009 -48 OF THE CITY
OF HUNTSVILLE, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD
ON THE 3RD DAY OF NOVEMBER, 2009 AND HERETOFORE INTIALLY
PASSED AND APPROVED ON THE 24TH DAY OF AUGUST,2009 BY ADDING
LANGUAGE TO SECTION 1 OF THE ORDINANCE TO SPECIFY EARLY
VOTING AND MAKING CERTAIN FINDINGS OF FACT AND CONCLUSIONS.
WHEREAS, the City Council of the City of Huntsville has heretofore adopted Ordinance No.
2009 -48 providing for the calling of an election for the purpose of voting on a proposition for
issuance of debt to rehabilitate the Huntsville Public Library, to vote on the exchange of Parkland,
and for the adoption or rejection on proposed amendments to the existing City Charter of the City
of Huntsville, Texas as amended and adopting Resolution 2009 -24; and
WHEREAS, said Ordinance Number 2009 -48 authorized the Mayor and /or the City Secretary and
the attorney for the City to take any action necessary to comply with the provisions of the Texas
Election Code, the Federal Voting Rights Act and the terms and provisions of any Election
Services Contract(s) and the Joint Election Agreement(s) in carrying out the provisions of this
Ordinance, whether or not expressly authorized herein; and
WHEREAS, the City Secretary and City Attorney have determined that language it is necessary
to add additional language to Section 1 of Ordinance 2009 -48 to address Early Voting; and
WHEREAS, notice of the agenda for this meeting, was given in accordance with law by posting
the same at the place reserved and designated for notices of public meetings and public activities
and prior to the adoption of this ordinance; and
AND NOW THEREFORE,
BE IT ADOPTED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE,
TEXAS:
1. The City Council of the City of Huntsville ha ving reviewed the findings of fact and
conclusions as herein set out and adopts the same for inclusion in this ordinance if the same had
been repeated verbatim herein.
2. Ordinance Number 2009 -48 of the City of Huntsville, Texas is hereby amended by the
adding the following language to Section One:
"Early Voting in the election by personal appearance shall be conducted at the times,
dates and polling places as provided for in the Walker County Election Agreement
between the City of Huntsville, Texas and Walker County, Texas.
Voting by personal appearance begins October 19, 2009 and ends October 30, 2009,
hours of 8:00 a.m. — 5:00 p.m., Monday- Friday at the Walker County Annex, 1301 Sam
Houston Avenue, Ste. 101. Applications for ballots by mail should be sent to: Dee
Brimer. Deputy Elections Administrator, 1301 Sam Houston Avenue, Ste. 101
Huntsville, TX 77340."
3. This ordinance shall take effect from and after its passage and the City Secretary is
directed to attached this Ordinance as Exhibit "B" to Ordinance 2009 -48
PASSED AND APPROVED THIS THE 1s` DAY OF September 2009.

Y PREVIAMENTE ACEPTADA Y APROBADA INICIALMENTE EL 24'°° DIA
DE AGOSTO DE 2009 MEDIANTE LA ADICI6N DE LENGUAJE A LA
SECCI6N 1 DE LA ORDENANZA PARA ESPECIFICAR LA VOTAC16N
ANTICIPADA Y REALIZAR CONCLUSIONES DE HECHO Y DE DERECHO.
CONSIDERANDO QUE, el ayuntamiento de la Ciudad de Huntsville he adoptado previamente la
Ordenanza NO 2009 -48 que estiputa la Ilamada a elecciones con el objetivo de votar sobre una
propuesta para emitir deuda con el fin de rehabilitar la Biblioteca Priblica de Huntsville, pare votar
en el intercambio del parque forestal, y para adopter o rechazar las enmiendas propuestas a los
Estatutos Municipales existentes de la Ciudad de Huntsville, Texas y sus enmiendas y adoptando
la comp Resoluci6n 2009 -24; y
CONSIDERANDO QUE, dicha Ordenanza numero 2009 -48 autorizaba al alcalde o secretario
municipal y al abogado de la Ciudad para tomar las medidas necesarias pare cumpiir con las
provisiones del C6digo de elecciones de Texas, la Ley federal de los derechos de votaci6n y los
to§rminos y provisiones del Contrato(s) de servicios de elecciones y Acuerdo(s) de elecciones
conjuntas Para Ilevar a Cabo las provisiones de esta Ordenanza, esten o no autorizadas por este
documento; y
CONSIDERANDO QUE, el secretario municipal y el abogado de la Ciudad han determinado que
hate aladir lenguaje adicional a la Secci6n 1 de la Ordenanza 2009 -48 Para hablar sobre las
elecciones anticipadas; y
CONSIDERANDO QUE, se avis6 de la agenda de esta reuni6n an virtud de la ley poni6ndola a
is vista an el lugar reservado y designado pare avisos de reuniones publicas y actividades
publicas y antes de adoptar esta ordenanza; y
Y AHORA POR LO TANTO,
EL AYUNTAMIENTO DE LA CIUDAD DE HUNTSVILLE ADOPTA:
1. El ayuntamiento de la Ciudad de Huntsville habiendo revisado las conclusiones de hecho
y de derecho establecidas por este documento las adopts para que sean incluidas en esta
ordenanza si las mismas se hubieran repetido literalmente en este documento.
2. La Ordenanza numero 2009 -48 de la Ciudad de Huntsville, Texas se enmienda por to
presente alladiendo el siguiente lenguaje a la Secci6n uno:
"La votaci6n anticipada en persona en las elecciones deber0 realizarse a la hora y
lugares de votaci6n establecidos an el Acuerdo de elecciones del condado de Walker
entre la Ciudad de Huntsville, Texas y el condado de Walker, Texas.
La votaci6n en persona comienza el 19 de octubre de 2009 y termina el 30 de octubre de
2009, entre las 8:00 AM y las 5:00 PM, lunes - viernes en el Anexo del condado de
Walker, 1301 Sam Houston Avenue, Ste. 101. Las solicitudes de papeletas par votar por
correo se deben enviar a: Dee Brimer, Vice administrador de elecciones. 1301 Sam
Houston Avenue, Ste. 101. Huntsville, TX 77340."
3. Esta ordenanza entrarA an vigor desde y despues de ser aprobada y el secretario
municipal debe adjuntar esta Ordenanza como Anexo "B" a Is ordenanza 2009 -48
ACEPTADA Y APROBADA ESTE 10' D(A DE septiembre de 2009.
