AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS, APPROVING THE
EXPENDITURE OF FUNDS IN THE AMOUNT NOT TO EXCEED THREE HUNDRED AND TWENTY -FIVE
THOUSAND AND NO/100 DOLLARS ($325,000.00) FOR EMERGENCY REPAIRS AND RESTORATION TO
WATER WELL # 14 FOR CLEANING, ACIDIZING, REMOTE CAMERA, PUMPS, PIPE CASING, AND SCREENS.
TO AUTHORIZE THE EXECUTION OF ALL DOCUMENTS IN CONNECTION THEREWITH BY THE CITY
MANAGER, OR IN HIS ABSENCE AN EXECUTIVE DIRECTOR AS AUTHORIZED BY THE CITY CHARTER AND
THE LOCAL GOVERNMENT CODE AND OTHER FINDINGS.
WHEREAS The City Council of the City of Huntsville, has been presented a proposal by Weisinger
Water Well, Inc. to expend funds in the amount of three thousand one and seven
Hundred and four and no /100 dollars ($301,174.00) for the emergency repair and
restoration of Water Well # 14.
WHEREAS The City Council of the City of Huntsville, has approved a contingency amount of twenty
three thousand eight hundred and twenty -six and no /100 dollars ($23,826.00)for
unforeseen repairs only viewable after cleaning and acidizing of pipe casing.
WHEREAS The City Council is of the opinion that the expenditure for such emergency repair is in
the best interest to avoid a public calamity that requires the immediate appropriation of
money to relieve the necessity of the municipality's residents or to preserve the
property of the municipality, Local Government Code, Section 252.022 (a) 1;
WHEREAS The City Council is of the opinion that the expenditure for such emergency repairs is
necessary to preserve or protect the public health or safety of the municipality's
residents, Local Government Code, Section 252.022 (a) 2;
WHEREAS The City Council is of the opinion that the expenditure is necessary because of
unforeseen damage to public machinery and equipment, Local Government Code,
Section 252.022 (a) 3;
WHEREAS Upon full review of and consideration of all matters attendant and related to the repair,
restoration and /or capping of Water Well # 14, such emergency expenditures should be
approved, and that the City Manager, or in his absence the Assistant City Manager,
should be authorized to execute any and all documents on behalf of the City of
Huntsville;
WHEREAS The City Charter, Article 11, Section 7 authorizes emergency appropriations for such
matters as described above by ordinance adopted by the favorable votes of 2/3 of the
Council Members and the Council finds that said expenditure has been made upon
recommendation of the City Manager; and
WHEREAS Notice of the agenda for this meeting, was given in accordance with law by posting the
same at the place reserved and designated for notices of public meetings and public
activities and prior to the adoption of this ordinance.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS:
SECTION 1. The City Council of the City of Huntsville having reviewed the findings of fact and
conclusions as herein set out and adopts the same for inclusion in this ordinance if the
same had been repeated verbatim herein.
SECTION 2: The Council authorizes approval of a purchase order for preliminary cleaning, acidizing,
minor patching and a 2n° remote camera viewing of Water Well If 14 to determine
extent of damage;
SECTION 3: The Council authorizes approval of purchase order for recommended repairs to pump,
pipe casing and screens as determined by camera;
SECTION4: The Council authorizes approval of purchase order tocap Water Well #14 should pipe
casing be catastrophic.
SECTION 5: The City Council directs and designates the City Manager, Bill Baine, as the City's Chief
Executive Officer and Authorized Representative, or in his absence the Assistant City
Manager to act in all matters in connection with this repair and /or capping.
