MIN CC 09/27/2005CITY COUNCIL MEETING SEPTEMBER 27, 2005 BOOK "T" EN MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 27TH DAY OF SEPTEMBER, 2005, IN THE CITY HALL, LOCATED AT 1212 AVENUE M IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS AT 12:30 P.M. The Council met in a special session with the following members present: COUNCILMEMBERS: J. Turner OFFICERS: Judy Kayse Bob Tavenner Kevin Evans, City Manager Mickey Evans Mac Woodward Danna Welter, City Secretary Steed Smith Jack Choate Thomas Leeper, City Attorney Jim Willett Absent: Clarence Griffin CALL TO ORDER [12:30 p.m.] Mayor Turner called the special work session to order. PLEDGE OF ALLEGIANCE to US AND TEXAS FLAGS, INVOCATION Councilmember Steed Smith led the invocation. PUBLIC COMMENTS (Agenda Items Only) 1 John Wagamon. Mr. Wagamon asked about the legality of approving tax anticipation notes in regards to the City Charter. STATUTORY AGENDA Consider and approve action with respect to an "Ordinance Authorizing the Issuance of the City of Huntsville, Texas Limited Tax Note, Series 2005; Authorizing the Levy of an Ad Valorem Tax; Approving an Investment and Commitment Letter and a Paying Agent/Registrar Agreement; and Authorizing Other Matters Relating to the Issuance of the Note ". Joe Morrow, First Southwest Company, stated that the note would be in the amount of $1,145,000 for the aquatic center /paver with a seven year pay off. The debt schedule meets budgetary needs. The note is a private placement through First National Bank, Huntsville, at a true interest rate of 3.55. Using the private placement process saved the City approximately $40,000 overall. Richard Donoghue, McCall, Parkhurst, Horton, stated that the anticipation note is perfectly legal through Chapter 1431 of the Local Government Code. The language in the Charter relates to notes to cover oneratino expenses and not capital projects. 2. Consider and approve budget amendments. This item was not presented. 3. Authorize City Manager to enter into Interlocal Agreement with Walker County for emergency services. This item was not presented. 4. Authorize City Manager to enter into Interlocal Agreement with Walker County for prosecution services. This item was not presented. MAYOR / COUNCILMEMBER I CITY MANAGER REPORT a. Update on pending or contemplated litigation. b. Update on land acquisition. These items were not discussed. PUBLIC COMMENTS 1. Stan Foley, Entergy, stated that there were more than 150 employees in Huntsville working on restoring power to those customers that are still without due to Hurricane Rita. He also stated that Entergy representatives would be at the Chamber for the next few days to visit in person with residents with questions regarding their power. 2 Councilmember Kayse thanked City staff for all their hard work during the Hurricane. MEDIA INQUIRIES Kelly Prew, Huntsville Item, stated that she would now be covering City business. Council welcomed her.
