STATUTORY AGENDA
1. Approve the amended Interlocal Agreement with Walker County with regard to subdivision regulations in the
extraterritorial jurisdiction and authorize the Mayor to execute the same on behalf of the City.
House Bill 1445, enacted by the 2001 Texas Legislature, provides that a city and a county may not both regulate a
subdivision in the city's extraterritorial jurisdiction ("ETJ"). The bill requires each city to enter into an agreement with the
county not later than April 1, 2002, identifying the entity that will regulate subdivision plats and approve related permits in
the ETJ. City staff has met with Walker County officials and it was agreed that the City of Huntsville would regulate
subdivision plats and approve related permits, except the approval of on -site sewage systems, in Huntsvil le's ETJ. The City
Council approved the original agreement at its meeting on December 11, 2001. Afterthe Council approved the agreement,
the County requested that certain changes be made in the agreement to clarify the responsibilities of both the City and
County. The main change is to reflect that the City is acting as the central office for approval of subdivision plats pursuant
to the provisions of Section (d)(4) of H.B. 1445. City staff met with County officials and worked out the language of the
proposed changes requested by the County. The County Commissioners approved the agreement at its meeting on
February 11, 2002. The attached amended agreement meets the requirements of H.B. 1445 and authorizes the City to
operate the single office for both the City and County and approve subdivisions within Huntsville's ETJ pursuant to the City's
subdivision regulations.
