MIN CC 02/19/2002CITY COUNCIL MEETING OF FEBRUARY 19, 2002 374 MINUTES OF THE HUNTSVILLE CITY COUNCIL MEETING HELD ON THE 19TH DAY OF FEBRUARY, 2002, IN THE CITY HALL, LOCATED AT 1212 AVENUE M IN THE CITY OF HUNTSVILLE, COUNTY OF WALKER, TEXAS AT 5:15 P.M. The Council met in a regular session with the following members present: COUNCILMEMBERS: OFFICERS: William B. Davis, Jr., Vance Howard, Marjorie Rex, Steed Smith CALL TO ORDER [5:20 p.m.] Mayor Green called the meeting to order. INVOCATION Invocation by Reverend David Valentine, First Baptist Church. CONSENTAGENDA 1. Approve the purchase of 12" pipe and miscellaneous supplies from Act Pipe Supply for $33,491.00 for the construction of a new 12" water line at the Raven Nest Golf Course. 2. Adopt the revisions within titles 9, 11, and 12 of the Huntsville Code of Ordinances to include the adoption of the International Codes, and as recommended by the Board of Adjustments and Appeals, to further approve that a two -year period be granted for the obtainment of the "Maintenance Electricians License" as required in section 11.01.08 of Title 11. Councilmember Erb made a motion to aoorove the Consent Aaenda: and Councilmember Martinez seconded the motion. The motion passed unanimousl STATUTORY AGENDA 1. Approve the amended Interlocal Agreement with Walker County with regard to subdivision regulations in the extraterritorial jurisdiction and authorize the Mayor to execute the same on behalf of the City. House Bill 1445, enacted by the 2001 Texas Legislature, provides that a city and a county may not both regulate a subdivision in the city's extraterritorial jurisdiction ("ETJ"). The bill requires each city to enter into an agreement with the county not later than April 1, 2002, identifying the entity that will regulate subdivision plats and approve related permits in the ETJ. City staff has met with Walker County officials and it was agreed that the City of Huntsville would regulate subdivision plats and approve related permits, except the approval of on -site sewage systems, in Huntsvil le's ETJ. The City Council approved the original agreement at its meeting on December 11, 2001. Afterthe Council approved the agreement, the County requested that certain changes be made in the agreement to clarify the responsibilities of both the City and County. The main change is to reflect that the City is acting as the central office for approval of subdivision plats pursuant to the provisions of Section (d)(4) of H.B. 1445. City staff met with County officials and worked out the language of the proposed changes requested by the County. The County Commissioners approved the agreement at its meeting on February 11, 2002. The attached amended agreement meets the requirements of H.B. 1445 and authorizes the City to operate the single office for both the City and County and approve subdivisions within Huntsville's ETJ pursuant to the City's subdivision regulations. MAYORICITY MANAGER ACTIVITY REPORT 1. Program/Project Status a. City Manager Bob Hart introduced the new Grants Coordinator in the Planning and Development Department, Mark Leonard. b. Mr. Hart also recognized Phillip Burnett (Superintendent III, Water Distribution, Public Works), Theo Whiteside (Superintendent III, Wastewater, Public Works) and Mark Moore (Superintendent 11, Planning and Development) for the successful closing of the College Farm lift station which had not been in use for several years but was costing the City approximately $4,000.00 annually to maintain. c. He also stated that an updated manual would be available soon, with the information gleaned at the training. 'i 2.
