Agenda Item #1b
Item/Subject: SECOND READING - Consider authorizing the City Manager to award the construction
for IH-45 Segment 2A Utility Relocation Project – Project No. 18-03-01, second reading.
Initiating Department/Presenter: Engineering
Presenter: Y. S. “Ram” Ramachandra, City Engineer
Recommended Motion: Move to authorize the City Manager to enter into a construction contract with
5-T Utilities, Inc. in the amount of $5,615,884.06 for the construction of IH-45 Segment 2A Utility
Relocation Project – Project No. 18-03-01.
Strategic Initiative: Goal #4 - Infrastructure - Ensure the quality of the City utilities, transportation and
physical structures so that the City’s core services can be provided in an effective and efficient
manner.
Discussion: Texas Department of Transportation (TxDOT) has completed the design to widen IH-45 for
the segment between SH-19 at the south end to approximately near Eastham Drive at the north end
(known as IH-45 Segment 2A).
Before IH-45 Segment 2A widening construction can begin, TxDOT is ensuring that all existing utilities
that are in conflict with IH 45 Segment 2A widening work are relocated. Current TxDOT timeline for
letting IH-45 Segment 2A Widening project for construction is July/August 2021. The City has several
waterline and sanitary sewer line segments within the TxDOT Right-of-Way in the IH-45 Segment 2A
Widening project limit that are needed to be relocated to remove potential conflict with highway
construction and to provide necessary clearances to the new roadway surfaces. See the attached
location map that shows the segments of waterline and sanitary sewer line to be relocated.
Upon TxDOT’s initiation with the City during June / July 2018 to begin water and sewer utility relocation
design, the City retained RPS Infrastructure, Inc. (RPS), Houston, TX for providing professional
engineering services consisting of detail engineering design, bidding, construction administration, daily
construction inspection and TxDOT Coordination for the utility relocation project. After extensive
coordination with TxDOT over the last two years, utility relocation design was completed and was
advertised on October 23, 2020 soliciting bids for project construction. The City’s utility relocation
design also consists of up-sizing waterlines and sanitary sewer lines in several locations. The upsizing
is necessary to accommodate anticipated future growth.
Notice to Bidders was posted on the Huntsville Item and the City of Huntsville websites. Also, the notice
was posted on the Electronic State Business Daily (ESBD) and Public Purchase websites. Hard copies of
the bid documents were available for review at the Service Center.
A non-mandatory pre-bid meeting was held on November 4, 2020, to allow all responders access to the
City staff for questions, comments, and clarifications on the scope of work. The bids were opened on
November 10, 2020. Two (2) bidders submitted bids for this project. The certified bid tabulation is
attached. 5-T Utilities, Inc., Huntsville, TX is the low bidder with a bid amount of $5,615,884.06.

Agenda Item: 1b
CITY COUNCIL AGENDA
Agenda Item #1b
5-T Utilities has successfully completed several City of Huntsville water and sewer infrastructure
projects over the last 20 years.
The construction contract period will be one hundred and eighty (180) calendar days from the date of
the Notice to Proceed (NTP). The NTP is scheduled to be issued effective sometime in early January

The cost of utility relocation design and construction for all relocations with similar sizes and types etc.

design and the TxDOT utility agreement (currently in process for full execution), In-Kind Replacement

Betterment is at approximately 12% of the total estimated cost (to be borne by the City).

reimbursement approximately $4.942,000 (88% In-Kind Replacement cost) and the City’s construction
cost will be $674,000 (12% Elective Betterment).
The City has already set aside a total amount of $1,100,000 in the last two fiscal year budgets (FY 2018-
2019 and FY 2019-2020) to meet the City’s design and construction share due to up-sizing of lines (i.e.,

No. 2 $ 5,902,480.00 TLC Construction
After careful review of the bid prices and summation of total cost for each bid, there were no mathematical
errors.
Bid documents submitted by 5-T Utilities, Inc. are in order. RPS contacted the enclosed references and
received positive feedback related to schedule and quality of work. RPS has also worked with 5-T Utilities,
Inc. on a recent project for Huntsville in 2018 that was under budget with a minimal amount of change
orders. 5-T Utilities, Inc. has successfully completed various utility projects of similar size for many municipal
clients in the region.
Based on our evaluation, the lowest bidder appears to be responsible and responsive. We recommend that
the contract be awarded to the low bidder, 5-T Utilities, Inc.

Agenda Item #1c
Item/Subject: SECOND READING - Consider authorizing the City Manager to enter into an agreement with RPS
Infrastructure, Inc. for professional engineering services for IH-45 Segment 2B Utility Relocation Design Project
#21-10-03, second reading.
Initiating Department/Presenter: Engineering
Presenter: Y.S. “Ram” Ramachandra, City Engineer
Recommended Motion: Move to authorize the City Manager to enter into an agreement with RPS
Infrastructure, Inc. for professional engineering services for IH-45 Segment 2B Utility Relocation Design Project
– Project No. 18-03-01.
Strategic Initiative: Goal #4 - Infrastructure - Ensure the quality of the City utilities, transportation and physical
structures so that the City’s core services can be provided in an effective and efficient manner.
Discussion: Texas Department of Transportation (TxDOT) is working on the design to widen IH-45 from
approximately 0.9 miles north of State Hwy 30 (more or less near the Home Depot location) to approximately
the City limit line south of FM 1696 (overall length is approx. 4.7 miles). This segment is termed IH-45 Segment
2B. TxDOT has scheduled letting IH-45 Segment 2B widening project construction for September 2023. TxDOT
has asked all agencies that have existing utilities in their IH-45 Segment 2B corridor to design and relocate
sections of utilities that conflict with widening project by their letting September 2023. The City has water and
sewer lines along and across this IH-45 Segment 2B.
The cost of water and sewer line relocation designs and construction for all relocations utilizing the same size
pipes, valves, etc. as existing ones (termed “In-Kind Replacement”) is 100% reimbursable by TxDOT. Upsizing of
pipes and other associated appurtenances that the City would opt for as part of relocation will be considered as
“Elective Betterment” and the increased cost for such upsizing shall be met by the City.
Based on the proposed preliminary design data provided by TxDOT for IH-45 widening, the City staff has
estimated “In-Kind” utility replacement cost (which will be reimbursed by TxDOT) to be $6.3 million. “Elective
Betterment” cost (the City’s cost) based on the up-sizing options that the City has chosen to meet the City’s
future needs is currently estimated at $0.6 million.
Considering above conceptual cost estimates, TxDOT and City cost participation ratios for design and
construction are anticipated to be approximately: 90% TxDOT and 10% City.
TxDOT has provided Utility Agreement forms to the City. Utility Agreement will be ready to execute when utility
relocation design plans and detail cost estimates are available. Staff will present Utility Agreement to the Council
upon the completion of the utility relocation design, which is anticipated to be in Spring 2022. Construction of
utility relocation work will begin only upon execution of Utility Agreement with TxDOT.
To proceed with the utility relocation design, the City has obtained scope and fee proposal from RPS
Infrastructure, Inc. (RPS). RPS is best suited to provide professional engineering services for utility relocation
design and construction support services RPS has worked on and completed similar utility relocation design for

RE: Professional Engineering Services
Proposal for IH-45 Segment 2B Utility Relocations
Dear Mr. Ramachandra:
Thank you for the opportunity to provide professional engineering services to the City of Huntsville
(City). This proposal provides a detailed scope and fee of engineering services to evaluate and relocate
water lines and sanitary sewer infrastructure identified that conflict with the future widening and
reconstruction of IH-45 Segment 2-B as shown in the attached Exhibits.
BACKGROUND
The Texas Department of Transportation (TxDOT) will be widening and reconstructing IH-45 from just
north of SH 30 to approximately the city limit line south of FM 1696 for a total length of reconstruction
of 4.7 miles. The letting date for IH-45 Segment 2B Reconstruction is scheduled for September 2023.
The City has retained RPS to help identify utility conflicts, design the relocations, and assist in managing
construction. RPS utilized schematic level drawings provided by Jacobs Engineering, existing utility
information provided by the City, and subsurface utility exploration (SUE) data provided by the IH-45
Design Team to help determine the existing utilities that require relocation as a result of the IH-45
Segment 2B Widening and Reconstruction Project. The total preliminary in-kind construction cost is
approximately $6.3 million for the approximately forty-one (41) utility conflicts with a proposed
betterment cost of $6.8 million. RPS will upsize the proposed utilities as requested by the City for
future development flows. The proposed utility relocations are as follows:
1. STA 1893+00 - 12” Water Line (Longitudinal Relocation)
2. STA 1921+60 - 12” Water Line (Longitudinal Relocation)

Agenda Item #2a
Item/Subject: FIRST READING - Consider the purchase of FY20-21 vehicles, to include all equipment,
from multiple vendors, authorizing the City Manager to award the contract, first reading.
Initiating Department/Presenter: Public Works
Presenter: Brent S. Sherrod, P.E., Public Works Director

CITY COUNCIL AGENDA
Agenda Item #2a
The sellers for each of the subject units are identified by the green highlighted items in the attached
summary.
Fleet and Purchasing staff have obtained vehicle pricing worksheets from two (2) local venders and two
(2) regional cooperative contract award holders to assure competitive and advantageous pricing for the
City’s vehicle requirements. The Texas Association of School Boards (TASB) Buyboard program has
historically afforded Texas municipalities a sound purchasing position given the competitive vehicle
pricing available under the program. This cooperative contract meets all requirements of Texas Local
Government Code 252 pursuant to competitive bidding by Texas municipalities.
Fleet and Purchasing staff have evaluated the vehicle pricing worksheets received to determine (from
among Ford and Chevrolet) the best value to the City when considering price, critical
options/equipment availability and cost, and warranty coverage/term.

Agenda Item #2b
Item/Subject: FIRST READING – Consider authorizing the City Manager to enter into a contract for furniture for the new Police Department and Fire Station #2 facilities, first reading. Initiating Department/Presenter: Engineering Presenter: Y.S. “Ram” Ramachandra, City Engineer and Bob Pearce, Purchasing Manager Recommended Motion: FIRST READING. No action is necessary. Strategic Initiative: Goal #4 - Infrastructure - Ensure the quality of the City utilities, transportation and physical structures so that the City’s core services can be provided in an effective and efficient manner. Discussion: The new Police Department (PD) and Fire Station No. 2 (FS #2) facilities currently under construction will require substantial furnishings upon completion that is currently anticipated by end of March 2021. Pursuant to budget approved for the required furnishings, Public Safety and Engineering staff coordinated with the architect (Architect Design Group, ADG) and the City Purchasing staff to develop furniture bid specifications and conduct a competitive bid solicitation with bids opened November 4, 2020. The projects were bid separately for PD and FS #2 facilities to allow the City flexibility in award if deemed to be in the City’s best interest to award separately. Bid notices were published in the newspaper of record and on the City, Public Purchase and State of Texas Electronic State Business Daily bidding websites. Five (5) bids were received for each of PD and FS #2 facilities in response to the invitation for bids, as reflected in the bid tabulations. Specifications provided for an award based on best value, with selection criteria including, but not limited to: a) Purchase price b) Delivery time c) Bidder reputation d) Quality of the bid items e) Extent to which goods meet City needs. Upon analysis of the bid responses by the City staff with assistance from ADG, the following two (2) bidders emerged as the top two contenders for both PD and FS #2 facilities for bid award given the relative considerations of price and other evaluation criteria: 1) WRG, LLC, Dallas, TX (Alternate Bid): - PD Facility Bid: $353,076.83 - FS #2 Facility Bid: $91,224.73 ----------------------------- TOTAL $444,301.56 -----------------------------

2) HBI, Huntsville, TX: - PD Facility Bid: $356,991.17 - FS #2 Facility Bid: $92,273.65 ----------------------------- TOTAL $449,264.82 ----------------------------- It should be noted that the lowest bids from DHospitality dba DH Contract (PD bid of $304,536 and FS #2 bid of $79,549), stipulated payment of 50% at time of order and additional 25% payment at 30 days out, representing a financial outlay of 75% of purchase price prior to delivery of furniture. This is contrary to the bid specification stating payment only upon delivery and acceptance of the subject furnishings. Thus, DH Contract is considered a non-responsive bidder. The top two (2) contending responses referenced above, WRG (alternate bid) and HBI, were vetted by the City staff. It was determined that the City staff team would visit the respective bidder facilities to get a first-hand view of the product quality proposed by both WRG and HBI. Those visits were completed during the weeks of November 16th and 23rd. Upon the visits to the bidders’ facilities and inspection of the line of offered furniture products, the City staff team opinion is that product needs and quality requirements would best be met by the proposal from HBI. City staff recommendation is to award a contract to HBI in the total amount of $449,264.82 for supply and installation of furniture for PD & FS #2 facilities. While this pricing is slightly higher than that provided by WRG at $444,301.56, staff is recommending City Council consideration to exercise the statutory allowance by Texas Local Government Code Chapter 271, Sec. 271.9051 which provides that a municipality may consider the location of a bidder’s principal place of business in awarding a bid: i) If the resident bidder is within five percent (5%) of the lowest non-resident bidder ii) Is for a contract or purchase of less than $500,000 iii) That the governing body determines in writing that the local bidder offers the municipality the best combination of contract price and additional economic development opportunities for the municipality created by the contract award. In this instance, the HBI pricing is within 1.12% of that provided by WRG. HBI can provide a delivered unit within 45-60 calendar days of order, which accommodates the construction time, and includes time for the vendor to finalize the custom details to be determined by the City such as finishes, color, etc. Given the factors referenced herein, HBI response is considered by the City staff to offer the best value to the City. Item/Subject: Consider adoption of Ordinance 2021-05 to amend Ordinance 2020-27 to reinstate
suspension of Utility Service for non-payment.
Initiating Department/Presenter: Finance
Presenter: Steve Ritter – Finance Director
Recommended Motion: Move to adopt Ordinance 2021-05 to amend Ordinance 2020-27 to reinstate
suspension of Utility Service for non-payment.
Strategic Initiative: Goal #6 - Finance - Provide a sustainable, efficient and fiscally sound government
through conservative fiscal practices and resource management.
Discussion: On April 7, 2020, City Council passed Ordinance 2020-21 in order to provide health
protections to the citizens of Huntsville and provide some economic relief to citizens due to COVID-19
and its impact on the economy. Section 5 of Ordinance 2020-21 placed a hold on suspension of Utility
Service for non-payment. The economy in Huntsville is doing well with Sales Tax revenue as a primary
indicator; from April 2020 through October 2020 Sales Tax revenue is up 9.1% compared to the same
7-month period in 2019. Staff’s process to reinstate “cut-offs” (suspension of service for non-payment)
would be to allow delinquent customers 4 months (until March 31, 2021) to get current. As of the end
of October there were approximately 570 customers with an average delinquent balance of around
$285.
Previous Council Action: None.
Financial Implications:
Unknown at this time but any negative impact (potentially increased write-offs of accounts receivable)
should be immaterial to the Utility Fund. For example, write offs of 50% ($80,000) of the roughly
$160,000 of delinquent amounts at the end of October would be less than 3/10ths of 1 percent of the
Utility Fund’s $30,000,000 total annual revenue.
