Ordinance 2014-09 - Canvassing 11-5-13 Election ORDINANCE NO. 2014-09 AN ORDINANCE CANVASSING THE RETURNS OF THE REGULAR AND SPECIAL MUNICIPAL ELECTIONS HELD WITHIN THE CITY OF HUNTSVILLE ON THE 5TH DAY OF NOVEMBER 2013, FOR THE PURPOSE OF ELECTING A MAYOR AT-LARGE AND FOUR COUNCILMEMBERS, ONE FROM EACH OF THE CITY'S FOUR WARDS, ONE, TWO, THREE, AND FOUR; A SPECIAL ELECTION FOR THE PURPOSE OF FILLING A VACANCY FOR CITY COUNCILMEMBER AT-LARGE POSITION 1; AND A SPECIAL ELECTION FOR THE PURPOSE OF VOTING ON THE ADOPTION OR REJECTION OF PROPOSED AMENDMENTS TO THE EXISTING CITY CHARTER OF THE CITY OF HUNTSVILLE, TEXAS, AS AMENDED; DECLARING THE RESULTS OF THE ELECTION; FINDING THAT NOTICE OF THE ELECTION WAS DULY AND PROPERLY GIVEN, THAT THE ELECTION WAS PROPERLY HELD AND RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE. WHEREAS pursuant to. Section 6.07 of the Charter of the City of Huntsville, the City Council, at a regular meeting held on the 14th day of November 2013, proceeded to canvass the returns of the regular and special municipal elections held in the City on the 5th day of November 2013, for the purpose of electing a Mayor At-Large; four Ward Councilmembers, one for each of the City's four wards: (1) one, (2) two, (3) three, and (4) four; a Councilmember At- Large Position One (1); and for adoption or rejection of proposed amendments to the City Charter of the City of Huntsville,Texas;and WHEREAS the election was held under and pursuant to the provisions of Ordinance No. 2013-34 and No. 2013-38 calling the election;and WHEREAS the election having been duly and regularly held as called in the ordinance and according to law, and the returns thereof having been made and the election judges having certified the results of the election, as hereinafter set out, and the City Council having duly and regularly canvassed the returns of the election and finding that the total votes cast at the election were as follows: FOR MAYOR MAC WOODWARD 1998 FOR COUNCILMEMBER WARD 1 JOE EMMETT 371 PAUL W.KNOX 182 FOR COUNCILMEMBER WARD 2 (a recount petition has been received for this race) KENDALL SCUDDER 170 TISH HUMPHREY 187 FOR COUNCILMEMBER WARD 3 RONALD ALLEN 144 FOR COUNCILMEMBER WARD 4 JOSE (JOE) RODRIQUEZ 1033 ~ FOR AT-LARGE COUNCILMEMBER,POSITION I RACHEL WILLEFORD 584 ANDY BRAUNINGER 1600 CHARTER AMENDMENTS AMENDMENT l. "No bond, other than refunding bonds issued to refund and in exchange for previously issued outstanding bonds, issued by the City shall be sold for )eom than ^ par value and accrued interest. � All bonds of the City having been issued inconformity with the laws of the State of - - k SECTION 6: Andy Brauninger received a majority of the votes cast at the election for the office of Councilmember At-Large Position 1, and accordingly, Andy Brauninger is declared elected to the office of Councilmember At-Large Position 1, subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. SECTION 7: Charter Amendment 1 was approved by a majority of the votes cast at the election on amendments and accordingly, Article II, Section 2.01 will be changed provide that the City may extend its boundaries and annex and disannex territory to the extent and in the manner provided by the constitution and laws of the State of Texas,to read as follows: EXTENSION OF BOUNDARIES. The City Council shall have the power by ordinance to fix the boundaries of the City of Huntsville. Without limiting the previous sentence, this power includes the ability to annex and to disannex territory, when permitted, to the extent, in the manner, and subject to any restrictions or limitations, provided by the constitution and laws of the State of Texas. Section 2.01(a) REPEALED. Section 2.01(b) REPEALED. SECTION 8: Charter Amendment 2 was approved by a majority of the votes cast at the election on amendments and accordingly, Article IV,Section 4.07 will be changed relating to where city,council meetings are held, to read as follows: All meetings of the council shall be held at the City Hall of Huntsville or at such other public place within the city as may be approved by Council and, except as otherwise permitted by law, all meetings shall be open to the public and closed or executive meetings or sessions shall only be permitted as authorized by law. SECTION 9: Charter Amendment 3 was approved by a majority of the votes cast at the election on amendments and accordingly, Article IV,Section 4.12, which allowed an employee who is not appointed by the City Council to appeal a decision on a grievance of that employee to the City Council,will be deleted. SECTION 10: Charter Amendment 4 was approved by a majority of the votes cast at the election on amendments and accordingly, Article XI, Section 11.02 (f) will be changed to strike the sentence,"Such audit shall be on a non-certified basis." SECTION 11: Charter Amendment 5 was approved by a majority of the votes cast at the election on amendments and accordingly, Article XI,Section 11.13, relating to the sale of bonds issued by the City will be changed to read as follows: "No bond, other than refunding bonds issued to refund and in exchange for previously issued outstanding bonds, issued by the City shall be sold for less than par value and accrued interest. Texas, and having been delivered to the purchaser thereof, shall thereafter be incontestable, and all bonds issued to refund and in exchange for outstanding bonds previously issued shall, after said exchange, be incontestable." 1655 FOR 436 AGAINST AMENDMENT 6. Shall Article XI, Section 11.17 of the existing City Charter, that relates to the issuance of new debt by the City be amended by deleting the last sentence "A favorable majority of all votes cast at the City election is required for approval."and inserting as the last sentence "A favorable majority of the qualified voters voting on the proposed issuance of new debt is required for approval."? 1782 FOR 438 AGAINST AMENDMENT 7. Shall Article XIV, Section 14.18 of the existing City Charter, that requires the reading of all reports made by the State of Texas concerning the City be deleted? 956 FOR 1164 AGAINST WHEREAS the City Council of the City of Huntsville finds that the election returns set out above to be accurate and correct. A recount petition has been filed for the office of Councilmember Ward 2. No other election protest or contest has been filed with Council or instituted in connection with the election returns. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,that: SECTION 1: Mac Woodward received a majority of the votes cast at the election for the office of Mayor At-Large, and accordingly, Mac Woodward is declared elected to the office of Mayor At-Large, subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. SECTION 2: Joseph Emmett received a majority of the votes cast at the election for the office of Councilmember, Ward 1, and accordingly, Joseph Emmett is declared elected to the office of Councilmember, Ward 1, subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. SECTION 3: Tish Humphrey received a majority of the votes cast at the election for the office of Councilmember, Ward 2, and accordingly, Tish Humphrey is declared elected to the office of Councilmember, Ward 2, subject to the taking of her oath and filing bond as provided by the laws of the State of Texas. SECTION 4: Ronald Allen received a majority of the votes cast at the election for the office of Councilmember, Ward 3, and accordingly, Ronald Allen is declared elected to the office of Councilmember, Ward 3, subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. SECTION 5: Jose (Joe) Rodriquez received a majority of the votes cast at the election for the office of Councilmember, Ward 4, and accordingly, Jose (Joe) Rodriquez is declared elected to the office of Councilmember, Ward 4, subject to the taking of his oath and filing bond as provided by the laws of the State of Texas. All bonds of the City having been issued in conformity with the laws of the State of Texas, and having been delivered to the purchaser thereof, shall thereafter be incontestable, and all bonds issued to refund and in exchange for outstanding bonds previously issued shall, after said exchange,be incontestable." SECTION 12: Charter Amendment 6 was approved by a majority of the votes cast at the election on amendments and accordingly, Article XI, Section 11.17 will be changed to delete the last sentence "A favorable majorihj of all votes cast at t11e Cihj election is required for approval." and inserting as the last sentence "A favorable ntajorihj of the qualified voters voting on tine proposed issuance of nev7 debt is required for approval." SECTION 13: Charter Amendment 7 was not approved by a majority of the votes cast at the election on amendments and accordingly, Article XIV, Section 14.18, requiring the reading of all reports made by the State of Texas concerning the City, shall not be deleted. SECTION 14: City Council finds that the notice of the election was duly and properly given as required by law and as provided in ordinance calling the election, and that the election was duly and regularly held, and the returns thereof duly and regularly made by the proper officials of the election, and in all things according to the law. SECTION 15: This ordinance shall take effect immediately from and after its passage. PASSED AND APPROVED this the 14th day of November 2013.
