of the draft letter of approval as recommended by the Planning Commission. The motion

55.0075 acres of certain property by the city of Huntsville, Texas, and authorizing and directing the City

Strategic Initiative: Goal #3 - Economic Development - Promote and enhance a strong and diverse
economy.
Discussion: Winter Wonder, LLC. is the owner of approximately 55.0075 acres of land which is located
in the City’s Extra-Territorial Jurisdiction (ETJ). This acceptance of the annexation petition and approval
of the resolution is the first step in the annexation process, in that, it will establish February 7, 2023, as
the date of the required public hearing to give the public the opportunity to comment on the annexation
of the proposed development.
The subject property is one that was included in the 2019 annexation program by the City and the
property owner entered into a development agreement whereby they consent to initiate voluntarily
annexation when the property is developed.

A RESOLUTION SETTING A DATE, TIME, AND PLACE FOR A PUBLIC HEARING
ON THE PROPOSED ANNEXATION OF APPROXIMATELY 55.0075 ACRES WITHIN
THE CORPORATE LIMITS OF THE CITY OF HUNTSVILLE, TEXAS BY THE CITY
OF HUNTSVILLE, TEXAS AND AUTHORIZING AND DIRECTING THE CITY
SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARING.
WHEREAS the City of Huntsville, Texas (the "City"), is authorized under Chapter 43 of the
Texas Local Government Code (the "Act"), to annex areas within its Extra
Territorial Jurisdiction (ETJ) on request of owner; and
WHEREAS the owner of the property filed with the City Secretary of Huntsville (the "City
Secretary") a petition ("Petition"), attached as Exhibit 1, requesting that the
property be annexed into limits of the City; and
WHEREAS the City Council of Huntsville, Texas (the "City Council") will hold a public
hearing in accordance with Chapter 43 of the Act; and
WHEREAS the City Council has determined to hold a public hearing on February 7, 2023,
regarding the petition of annexation; and
WHEREAS the City Council finds that the passage of this Resolution is in the best interest of
the citizens of the City; and
WHEREAS it is hereby officially found and determined that the meeting at which this resolution
was considered was open to the public, and public notice of the time, place and
purpose of said meeting was given, all as required by Chapter 551, Texas
Government Code.
NOW, THEREFORE, be it resolved by the City Council of the City of Huntsville, Texas that:
Section 1 All of the above recitals are hereby found to be true and correct factual
determinations of the City Council and are hereby approved and incorporated by
reference as though fully set forth herein.
Section 2 That a public hearing is hereby called for February 7, 2023, at 6:00 p.m. in the City
Council Chambers of the City of Huntsville City Hall, 1212 Avenue M, Huntsville,
Texas 77340 and at this public hearing all interested persons have the right to
appear and be heard on the proposed annexation by the City of Huntsville, Texas
of the following described property, to-wit:
Being 55.0075-acre tract or parcel of land out of a 80.0439 acres of land situated
in the JOHN HEYSER Survey, Abstract No. 240 and the Thomas Carothers
Survey, Abstract No. 140, both in Walker County, Texas, and being out and a
part of a called 80.77-acre tract and also out of a 100 acre tract described in a
Deed from Sammie Collins to Johnnie L. Crawford dated September 9, 1957, as
recorded in Volume 157, page 593, Walker County, Texas Deed Records.

Section 3 The City Secretary is hereby authorized and directed to cause notice of such public
hearing to be posted on the City’s internet website on or after the 20th day but
before the 10th day before the date of the hearing and must remain posted until the
date of the hearing and published in a newspaper of general circulation in the
municipality and in the above described territory not more than twenty days nor
less than 10 days prior to the date of such public hearing, in accordance with the
Municipal Annexation Act.
Section 4 If any portion of this Resolution shall, for any reason, be declared invalid by any
court of competent jurisdiction, such invalidity shall not affect the remaining
provisions hereof and the City Council hereby determines that it would have
adopted this Resolution without the invalid provision.
Section 5 This Resolution shall be in full force and effect from and after its passage, and it is
accordingly so resolved.

Recommended Motion: Move to authorize the City Manager to enter into a contract with HBI Office
Solutions, Inc. in the amount of $301,875.40 for supply and installation of furniture at the new Service
Center – Project No. 18-04-02.
Strategic Initiative: Goal #4, Infrastructure - Ensure the quality of the City utilities, transportation and
physical structures so that the City’s core services can be provided in an effective and efficient manner.
Discussion: The new Service Center under construction will require substantial furnishings upon
completion, which is currently anticipated by the end of July 2023. Pursuant to the budget approved
for the required furnishings, Public Works, Parks & Leisure, and Engineering Department staff
coordinated with the architect (Randall Scott Architects) and the City Purchasing staff to verify the
furniture list (see attached) provided by the HBI Office Solutions, Inc.
HBI Office Solutions has a contract with Texas Smart Buy, which is a cooperative and under the contract
detail number #TXMAS-19-7111, which they do not need to go out for bid.
The attached Quote dated 12/20/2022, allowed the staff from Public Works and Parks & Leisure to visit
the warehouse verifying the furniture listed on Quote # 25449.

reading requirement and move to approve Ordinance No. 2023 - 1 Amending Section 3.01 of the Rules
of Procedure
Strategic Initiative: Goal #2, Communications - Provide public information outreach efforts that inform
the public of City operations, accomplishments and policies and allows for citizens input on matters of
Council policy.
Discussion: As we are preparing to move from the current City Hall and move to the Old Police
Department while the new City Hall is being constructed, we need a location within the City to hold
regular City City Council meetings. The Rules of Procedure Section 3.01 states that the City Council shall
conduct all regular sessions at City Hall. Article IV of the Charter Sec. 4.07 states that there shall be one
or more regular meetings of the City Council each month, which shall be held at such times and places
as shall be prescribed by ordinance. All meetings of the council shall be held at the City Hall of
Huntsville or at such other public place within the city as may be approved by Council.
In order to designate a new location for City Council meetings, Section 3.01 of the Rules of Procedure
needs to be amended by Ordinance.

AN ORDINANCE OF THE CITY OF HUNTSVILLE, TEXAS, AMENDING THE RULES
AND PROCEDURES FOR THE CITY OF HUNTSVILLE CITY COUNCIL; MAKING
VARIOUS OTHER FINDINGS AND PROVISIONS RELATED THERETO; AND
DECLARING AN EFFECTIVE DATE.
WHEREAS Section 4.08 of the City Charter of the City of Huntsville states that "The
Council shall by ordinance determine its own rules and order of business"; and
WHEREAS the City Council adopted Rules of Procedure by Ordinance No. 2004-21 on
November 9, 2004; and as amended by Ordinance No. 2006-03 on January 17,
2006; by Ordinance No. 2007-05 on February 6, 2007; by Ordinance No. 2007-
13 on April 17, 2007; by Ordinance No. 2008-30 on August 19, 2008; by
Ordinance No. 2009-28 on March 3, 2009; by Ordinance No. 2009-46 on July
8, 2009; by Ordinance No. 2011-21 on February 15, 2011, by Ordinance No.
2012-20 on March 20, 2012, by Ordinance No.2013-19 on May 7, 2013, by
Ordinance No. 2014-33 on May 20, 2014, by Ordinance No. 2015-28 on July
21, 2015, by Ordinance No. 2015-38 on September 1, 2015, and by Ordinance

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, THAT:
Section 1: The facts and matters set forth in the preamble of this Ordinance are found to
be true and correct and are hereby adopted, ratified, and confirmed.
Section 2:The Rules of Procedures for the City Council of the City of Huntsville are hereby
amended as shown in the attached Exhibit A and incorporated herein for all purposes Exhibit A.
Section 3: This Ordinance shall take effect immediately upon its passage by the City Council.
Section 4:All ordinances or parts of Ordinances that are in conflict or inconsistent with the
provisions of this Ordinance shall be, and the same are hereby, repealed and all other ordinances
of the City not in conflict with the provisions of this Ordinance shall remain in full force and
effect.
Section 5:Should any paragraph, sentence, clause, phrase or section of this Ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of
this Ordinance as a whole or any part or provision thereof, other than the part so declared to be
invalid, illegal or unconstitutional.

Exhibit A
3.01. Regular Sessions.
The City Council shall conduct regular sessions generally on the first (1st) and third (3rd)

physical structures so that the City’s core services can be provided in an effective and efficient manner.
Discussion: Residents of Spring Lake subdivision have requested to speak to Council about drainage
issues they are facing in their community. Mayor Pro Tem Humphrey and Councilmember McKenzie
have cosponsored the item requested by Councilmember Strong.
In the previous year, the City has undertaken the following items to better address drainage not only in
Spring Lake, but throughout the City:
1. Approved a preliminary drainage master plan. The final document was provided to the City on
January 9, 2023 and will be posted on our website. The plan made recommendations for moving
forward, including revisions to codes and ordinances governing drainage. These recommendations are
under review and will be drafted for future Council consideration.
2. Authorized in the budget hiring outside consultants to review and recommend the implementation of
a drainage fee to help the City fund drainage projects throughout the community.
3. Authorized the submission of a grant application to the General Land Office for$2.25 million in hazard
mitigation funding including $750,000 for drainage and road improvements to Autumn Lane in the
Spring Lake subdivision. The funds have already been allocated to the City and the application is just a
formality to ensure the proposed projects meet funding guidelines.
4. Increased patrols and enforcement of existing codes related to silt fencing and erosion control.
5. Continued to respond to requests for maintenance of infrastructure including culvert and ditch
cleaning.
