AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS,
AMENDING AND RATIFYING THE EMPLOYEE MEDICAL BENEFIT PLAN ADOPTED
AND APPROVED BY CITY COUNCIL ON SEPTEMBER 10, 2009; AND MAKING OTHER
FINDINGS AND PROVISIONS RELATED THERETO.
WHEREAS The City of Huntsville Employee Health Plan was last adopted by Ordinance 97 -07.
WHEREAS The City Council of the City of Huntsville on September 10, 2009 by minute order approved
amendments and changes for health insurance and vision care; approved a self- insured dental plan and
approved plan for life, accidental death & dismemberment and long term disability all for employee
healthcare benefits as authorized by Section 14.17 of the City Charter and now wishes to ratify the minute
order by Ordinance.
WHEREAS, The City Council of the City of Huntsville has determined it is more efficient and beneficial to
allow the City Manager, Human Resources Manager and Financial Controller to oversee and City's
partially self- funded health plan.
WHEREAS, notice of the agenda for this meeting, was given in accordance with law by posting the same
at the place reserved and designated for notices of public meetings and public activities and prior to the
adoption of this ordinance.
NOW, THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
HUNTSVILLE, TEXAS, that:
SECTION 1: The facts and matters set forth in the preamble of this Ordinance are found to be true and
correct and are hereby adopted, ratified, and confirmed.
SECTION 2: "THE CITY OF HUNTSVILLE EMPLOYEE HEALTH PLAN ", attached hereto as Exhibit "A"
is hereby adopted as the plan document of the City of Huntsville Employee Health Plan and Trust.
SECTION 3: All ordinances or parts of Ordinances that are in conflict or inconsistent with the provisions
of this Ordinance shall be, and the same are hereby, repealed and all other ordinances of the City not in
conflict with the provisions of this Ordinance shall remain in full force and effect. Specifically, Section 2 of
Ordinance 97 -07 is repealed in its entirety.
SECTION 4: Should any paragraph, sentence, clause, phrase or section of this Ordinance be adjudged
or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Ordinance as a
whole or any part or provision thereof, other than the part so declared to be invalid, illegal or
unconstitutional.
SECTION 5: This Ordinance shall take effect immediately from and after the date of its publication as
required by Charter and law.
