The meeting was called to order by the Honorable William V, hash, Mayor. The invocation was presented by
the Reverend Don 5chiel, Pastor of the Huntsville Christian Center.
CONSIDER THE MINUTES OF THE PREVIO'1; MEETING
ayor Nash presented the minutes of the Council Meeting of January 5,,1982 to the Council for their consider
den. Councilmember Corley made the motion to accept the minutes as prepared and Councilmember Monday seWrd_d
ha motion. All were in favor and the motion passed unanimously_.
ATTENDING CITIZEN
Dr. Thomas C. Cole to discuss the need for a variance to the setback o
Dr. Cole asked the Council's consideration for a variance to the setback ordinance to allow for a proposed
addition to his medical offices located at 12th and Avenue J Streets. Part of the addition would be a cover
Over a therapeutic swimming pool which has been constructed cn the property. He noted restoration and rehabili-
tation of the old home are also underway. He noted the property is eligible for consideration for the National
Register of Historic Places by the Department of the Interior of the U. S. Government. He noted in applying for
a building permit from the City, he finds he'd be inviolation of the offset ordinance of 15 feet from the city
property line, ile described the historic property involved and told the Council he understands it will consider
the future an ordinance to encourage preservation of historic homes. He noted although his therapeutic ',Nil
Is'back wi hin the offset ordinance requirements, any enclosure of the pool would there encroach into the 15 foot
requireninS�t He noted too any additions to this old holm, would he in violation of this ordinance as older homes
were built flush on the property lines.
Gene Pipes, City Manager, :noted the Setback ordinance does not allow for variances, therefore, the reeoelt
is before the Council toninht, The Council expressed an interest in finding a solution to the problem and asked
the staff to address it and brinn back a recommendation to the Council by net week. Councllrrenber Hondas asked
the -staff to consider this request as it pertains to historic structures and study its al'plIcebility to
other historic structures in the City, many of which were build on lot lines. She noted if we are to encourage
preservation of historic structures, we must make it feasible for them to be made usable in lieu of their being
torn down. In this situation, she felt we should look at a variance procedure. Councilmember Dickens noted
perhaps there should be a general variance procedure in the ordinance which could be applied in certain situaei
such as this. Councilmember Dowling reminded the staff of "bonus provisions" which had been discussed under the
design criteria manual which allowed trade -offs, etc., and asked if perhaps this concept could he reviewed in thie
ituation. Mr. Pipes noted this concert wus not used, only discussed.
Mayor Nash asked that the staff have a recommendation by next week.

tions as offered by Wittke Iron Works in the amount of 515,774 for containers of assorted sizes to be used in
the Commercial Collection Prrnram and funded from Sanitation Contingency Fund. Mr. Pipes noted it is also tee
