Ordinance 2013-23 - Amending Ch 24 - Land Development ORDINANCE 2013-23 AN ORDINANCE OF THE CITY OF HUNTSVILLE AMENDING CHAPTER 24 LAND DEVELOPMENT OF THE HUNTSVILLE, TEXAS MUNICIPAL CODE OF ORDINANCES BY ADDING A SECTION ADOPTING THE PLANNED DEVELOPMENT DISTRICT; REQUIRING THE PUBLICATION OF THIS ORDINANCE; PROVIDING FOR A SEVERABILITY CLAUSE; REPEALING ORDINANCES IN CONFLICT WITH THIS ORDINANCE;AND DECLARING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission of the City of Huntsville at their meeting on March 21, 2013 held a public hearing prior to consideration of the addition of Section 505.5 Planned Developments to the Development Code; WHEREAS, the Planning and Zoning Commission recommended the addition of Section 505.5 Planned Developments to the current Development Code; and WHEREAS, the City Council held a public hearing at their meetings on May 7, 2013 and May 21, 2013 prior to consideration of amending the Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, COUNTY OF WALKER,STATE OF TEXAS: I. FINDINGS OF FACT All of the above premises are hereby found to be true and correct legislative and factual findings of the City of Huntsville,Texas, and are hereby approved and incorporated into the body of this Ordinance as if copied in their entirety. II. AMENDMENT The Huntsville Code of Ordinances, Chapter 24, Land Development, is amended by adding a new section, Section 505.5 Planned Developments, attached hereto as Exhibit "A" to Chapter 5 of the Development Code. III. REPEALER All ordinances or parts of ordinances in force when the provisions of this Ordinance becomes effective which are inconsistent or in conflict with the terms and provisions contained in this Ordinance are hereby repealed only to the extent of any such conflict. IV. SEVERABILITY It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance be severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences or sections of this ordinance, and the remainder of this Ordinance shall be enforced as written. V. EFFECTIVE DATE This Ordinance shall take effect on June 1, 2013. The City Secretary shall publish the caption of this Ordinance in the official City newspaper at least twice within ten (10) days of its passage. VI. PROPER NOTICE AND MEETING It is hereby found and determined that the meeting at which this Ordinance was passed was open to the public and that public notice of the time, place, and purpose of said meeting was given as required by the Open Meetings Act, Chapter 551, of the Texas Government Code. Notice was also provided as required by Chapter 1 of the City of Huntsville Development Code. PASSED AND APPROVED on this,the 2151 day of May, 2013. The Planned Development District (PD) is intended to encourage flexible and creative planning to ensure the compatibility of land uses, to allow for the adjustment of changing demands to meet the current needs of the community,and to provide for a a development that is superior to what could be accomplished in other zoning districts by meeting one or more of the following purposes: (1) Provides for a superior design of lots or buildings. (2) Provides for increased recreation and/or open space opportunities for public use. (3) Provides amenities or features that would be of special benefit to the property users or community. i (4) Protects or preserves natural amenities and environmental assets such as trees, creeks, ponds,floodplains,and slopes or hills. (5) Protects or preserves existing historical buildings,structures,features or places. ,i (6) Provides an appropriate balance between the intensity of development and the ability to ,i provide adequate supporting public facilities and services. i 505.5(2)Plans Required There are three types of plans that may be used in the Planned Development District process. The general purpose and use of each plan is described as follows: (1) Concept Plan s t 'i This plan is intended to be used as the first step in the Planned Development process District.It establishes the most general guidelines for the district by identifying the land uses and intensities, thoroughfare locations, open space and project boundaries and illustrates the integration of these elements into a master plan for the whole district 3 a (2) Development Plan This plan is intended to be used most often as the second step of the Planned Development z District process. The Development Plan contains all the information of a Concept Plan, but includes more detailed information as to the specific land uses and their boundaries.
