ORD CC 1980-51 - Territory annexationORDINANCE NO. 80-51 • AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF HUNTSVILLE, TEXAS; PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY THAT LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF HUNTSVILLE; AND MAKING OTHER PROVISIONS RELATED THERETO. WHEREAS, pursuant Ordinance No. 80 -39, a Public Hearing before the City Council of the City of Huntsville, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described property, to -wit: (Area P) BEGINNING at a point where the South line of Southwood Drive prolongated Westerly intersects the existing city limit line as annexed the 10th day of June, 1969, as filed for record in Volume 221, Page 501, Walker County Deed Records; THENCE Easterly along said prolongated South line of Southwood Drive 2000 feet to a point; THENCE Southeasterly parallel with the centerline of U.S. Highway 75 South to a point on the South line of a 1000 acre tract as conveyed by Joseph Baldwin and wife, Ellen S. Baldwin, to the State of Texas (T.D.C. Goree) dated 28th day of January, 1892, and recorded in Volume 6, Page 628, Walker County Deed Records; THENCE Westerly with the South line of aforementioned 1,000 acre tract to its most southwest corner, same being an interior corner for Elkins Lake Municipal Utility District boundary map recorded in Volume 1, Page 10, Plat Records of Walker County, Texas; THENCE Northerly with common line of aforementioned Elkins Lake M.U.D. boundary map and aforementioned TDC 1,000 acre tract to Elkins Lake M.U.D. most Northeast corner; THENCE Westerly with Elkins Lake M.U.D. North line to its intersection with aforementioned TDC 1,000 Acres' most west line, same being the Southwest corner of the R. T. Walker Survey, A -589; THENCE Northerly with the R. T. Walker Survey East line to a point in the aforementioned existing city limit line; THENCE Southeasterly and Northwesterly along said city limit line to the Point of Beginning. was held at 7 :00 p.m. in the City Council Chambers of the City Hall of the City of Huntsville, Texas, on the 30th day of September, 1980, which date is not more than twenty (20) nor less than ten (10) days prior to the first consideration of this ordinance; and WHEREAS, notice of such public hearing was published in the Huntsville Item, a paper having general circulation in the City of Huntsville, Texas, and Walker County, Texas, on the 18th day of September, 1980, which date was not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and WHEREAS, the total corporate area of the City of Huntsville, Texas, on the 1st day of January, 1980, was 7738.7 acres; and WHEREAS, the above described property lies within the extraterritorial juris- diction of the City of Huntsville, Texas; and WHEREAS, the above described property lies adjacent to and adjoins the City of Huntsville, Texas, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS: Section 1: That the following described land and territory lying adjacent to and adjoining the City of Huntsville, Texas, is hereby added and annexed to the City of Huntsville, Texas, and the said territory hereinafter described shall hereafter be included within the boundary limits of the City of Huntsville, Texas, and the present boundary limits of the City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Huntsville, Texas, to -wit: • • • BEGINNING at a point where the South line of Southwood Drive prolongated Westerly intersects the existing city limit line as annexed the 10th day of June, 1969, as filed for record in Volume 221, Page 501, Walker County Deed Records; THENCE Easterly along said prolongated South line of Southwood Drive 2000 feet to a point; THENCE Southeasterly parallel with the centerline of U.S. Highway 75 South to a point on the South line of a 1000 acre tract as conveyed by Joseph Baldwin and wife, Ellen S. North line to its intersection with aforementioned TDC 1,000 Acres' most west line, same being the Southwest corner of the R. T. Walker Survey, A -589; THENCE Northerly with the R. T. Walker Survey East line to a point in the aforementioned existing city limit line; THENCE Southeasterly and Northwesterly along said city limit line to the Point of Beginning. Section 2: The above described territory and the area so annexed shall be a part of the City of Huntsville, Texas, and the property so added shall bear its pro rata part of the taxes levied by the City of Huntsville, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all of the citizens of Huntsville and shall be bound by the acts, ordinances, resolutions, and regulations of the City of Huntsville, Texas.
