ORDINANCE NO. 80 -3
AN ORDINANCE AMENDING CHAPTER 9, "GARBAGE AND REFUSE" ORDINANCE OF
THE CODE OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY AMENDING
THE PRESENT SECTION 9 -9, "SPECIFYING CHARGES FOR DISPOSAL OF SOLID
WASTE MATERIALS," BY DELETING SUBSECTION (a) "CHARGES ENUMERATED" AND
ADDING A NEW SUBSECTION (a) ENTITLED "DISPOSAL CHARGES -- PRESCRIBED,"
PROVIDING FOR CHANGE OF SAME BY RESOLUTION OF THE CITY COUNCIL; AND
AMENDING SECTIONS 9 -10.1, "CHARGE FOR COMMERCIAL OR INSTITUTIONAL
SERVICE," SUBSECTIONS (a) AND (c) AND SECTION 9 -10.3, "CONTAINERS
FURNISHED BY CITY FOR COMMERCIAL AND INDUSTRIAL CONCERNS," SUBSECTION
(d) BY DELETING ALL REFERENCES TO SPECIFIC RATES; AND PROVIDING FOR
AN EFFECTIVE DATE.
Section 1
BE IT ORDAINED by the City Council of the City of Huntsville, Texas, that
the present subsection (a) "Charges enumerated" of Section 9 -9 of Chapter
9 of the Huntsville City Code of Ordinances, be hereby rescinded and
deleted from the Code of Ordinances.
Section 2
BE IT FURTHER ORDAINED that a new subsection (a) of Section 9 -9, "Specifying
Charges for Disposal of Solid Waste Materials," shall be established as
follows:
(a) Disposal Charges -- Prescribed
There shall be charged, assessed and collected from all
users of the City's landfill, such charges for refuse and
garbage disposal services as may be determined from time to
time by resolution of the City Council of the City of Huntsville,
Texas.
Section 3
BE IT FURTHER ORDAINED that subsections (a) and (c) of Section 9 -10.1,
"Charge for Commercial or Institutional Service" shall be amended to read
as follows:
(a) The charge for the collection and removal of garbage, trash
and rubbish from premises used for business, commercial or
institutional purposes shall be as prescribed in Section 9 -4
of this Chapter.
(c) Buildings or connected series of buildings containing more
than four (4) dwelling units having water billed through
a single meter will be billed as a single charge along with
the single water or sewer charge regardless of the occupancy
of such multiple dwelling unit. The charge for collecting
garbage, rubbish, and trash from apartment houses consisting
of four (4) or more units having a single water meter shall
be as prescribed in Section 9 -4 of this Chapter and shall be

on a per unit basis. Multiple dwelling units classified as
fraternities, sororities, boardinghouses and dormitories
shall be charged as a commercial establishment which require
more than the minimum service described herein and are subject
to having the charges increased by the city sanitation division
based upon the additional service required. Any multiple dwelling
unit having individual water meters shall be billed individually
at the residential rate.
Section 4
BE IT FURTHER ORDAINED that subsection (d) of Section 9 -10.3, "Containers
furnished by City for Commercial and Industrial Concerns" shall be amended
to read as follows:
(d) Charges for containers furnished by City shall be as prescribed
in Sections 9 -4 and 9 -9 (a) of this chapter. Where more than
one commercial establishment uses the same container, the charges
shall be pro -rated according to use, but in no case shall be
less than the regular monthly commercial charge.
Section 5
IT IS ALSO FURTHER ORDAINED that the within ordinance amendments shall become
effective immediately upon passage.
PASSED AND SIGNED INTO EFFECT in regular open session of the City Council
of the City of Huntsville, Texas, on this the 26th day of February, A.D., 1980.
