RESOLUTION OF THE CITY OF HUNTSVILLE, WALKER COUNTY, TEXAS CALLING A SPECIAL
ELECTION ON NOVEMBER 3, 2009 ON THE ISSUANCE OF BONDS FOR THE REPAIRS,
EXPANSION AND IMPROVEMENTS TO THE CITY OF HUNTSVILLE PUBLIC LIBRARY, AND
AUTHORIZING THE CITY STAFF TO PREPARE THE APPROPRIATE ORDINANCE CALLING THE
ELECTION AND SETTING THE DATES, TIMES, LOCATIONS FOR EARLY VOTING AND ELECTION
DAY VOTING AND PREPARING THE REQUIRED BALLOT LANGUAGE, AND HAVING THE
ORDINANCE SUBMITTED TO THE CITY COUNCIL PRIOR TO SEPTEMBER 2, 2009.

WHEREAS, the City Council of the City of Huntsville has previously accepted the Library Feasibility Study
Ad Hoc Committee's ( "Committee ") report and recommendations presented on March, 3 2009;
WHEREAS the City Council by motion and vote authorized the Committee to go forward with its
recommendation and use the originally budgeted funds for a feasibility study be used for the hiring of an
architectural firm to do a preliminary design only;
WHEREAS, the City Council finds the current City Public Library has become insufficient in size for the
population of the City of Huntsville and the various educational activities being held at the Library;
WHEREAS, the City Council finds that the construction, repair and expansion of the City Public Library
serves a public purpose, enhances the community and provides educational resources to be used by the
citizens;
WHEREAS, the City Council is authorized by Article VI, Section 6.09 of the City Charter to call a special
election by ordinance or resolution;
WHEREAS, the City Council is authorized by Article X1, of the City Charter to issue bonds for permanent
public improvements, public purposes or any other self - liquidating municipal function not prohibited by the
Constitution and the Law of the State of Texas;
WHEREAS, it is hereby found and determined that the proposed issuance and delivery of the bonds as
authorized by the City Charter,is in the public interest and the proposed use of the proceeds thereof in the
manner specified herein constitutes a valid public purpose; and
WHEREAS, it is officially found, determined, and declared that the meeting at which this Resolution has
been adopted was open to the public and public notice of the time, place and subject matter of the public
business to be considered and acted upon at said meeting including this resolution.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS:
Section 1, The City Council of the City of Huntsville having reviewed the findings of fact and
conclusions as herein set out and adopts the same for inclusion in this resolution if the same had been
repeated verbatim herein.
Section 2. The City Council of the City of Huntsville calls and orders a special election on November
3, 2009 to allow the public to vote on the issuance of bonds to pay for the repairs, expansion and
improvements, and purchase of any land or materials needed to accomplish the repairs, expansion and
improvements of the Huntsville City Public Library.
Section 3. The City Council hereby directs the City Staff to prepare an ordinance ordering the
election and setting the dates, times and locations for early voting and election day voting, the appropriate
ballot language for the proposed bond issuance and all other matters required by the City Charter, the
Texas Election Code, State and Federal law.
Section 4. The City Council hereby directs the City Staff to present said Ordinance to the City
Council before September 2, 2009. ..
Section 5. This resolution shall be effective from and after the date of its passage.
