ORDINANCE NO. 78 -16
AN ORDINANCE AMENDING CHAPTER 9, GARBAGE AND REFUSE ORDINANCE OF THE CODE
OF ORDINANCES OF THE CITY OF HUNTSVILLE, TEXAS, BY AMENDING ALL REFERENCES
TO THE DIRECTOR OF PUBLIC WORKS; BY AMENDING THE DEFINITION OF "COMMERCIAL"
IN SECTION 9 -1; BY AMENDING SECTION 9 -9 SPECIFYING CHARGES FOR DISPOSAL OF
SOLID WASTE MATERIALS, BY AMENDING SUBSECTIONS (C) THROUGH (H) AND BY ADDING
A NEW SUBSECTION (I), ESTABLISHING NEW RATES AND ADDING REGULATIONS FOR
PACKER TYPE GARBAGE TRUCKS; BY AMENDING SECTION 9 -10 A, CHARGE FOR COMMERCIAL
OR INSTITUTIONAL SERVICE, BY AMENDING SUBSECTION (a) SETTING NEW MINIMUM CHARGE;
BY AMENDING SECTION 9 -10 -A, SUBSECTION (c) SPECIFYING DWELLING UNITS AND ESTAB-
LISHING NEW RATES; BY AMENDING SECTION 9 -10 -C, CONTAINERS FURNISHED BY CITY
FOR COMMERCIAL AND INDUSTRIAL CONCERNS, BY SETTING A NEW MINIMUM RATE WHICH
CAN BE CHARGED; BY ADDING A NEW SECTION 9 -14 COLLECTION RATES PRESCRIBED,
PROVIDING FOR CHANGE OF SAME BY RESOLUTION OF THE CITY COUNCIL; AND PROVIDING
FOR AN EFFECTIVE DATE.
Section 1:
BE IT ORDAINED that all references in Chapter 9 to the Director of
Public Works be hereby changed to Director of Public Services in keeping
with the City's organizational structure; and that Chapter 9 of the Code of
Ordinances of the City of Huntsville, Texas, be amended as follows:
SECTION 9 -1. DEFINITIONS
Commercial. "Commercial" shall mean any structure or building other
than residential, including business structures, hotels, motels, rooming or
boarding houses, and structures containing four or more dwelling units.
SECTION 9 -9 SPECIFYING CHARGES FOR DISPOSAL OF SOLID WASTE MATERIALS
(C) Passenger car, station wagons, and pickups used by non-
Huntsville resident owners to haul owner's waste . . . $ 2.50 per load
(D) Commercial pickups with sideboards $ 5.00 per load
(E) Trucks, single axle with cargo bed length less
than 15 feet; or trailer, two axle $10.00 per load
(F) Trucks, three axle; or truck, two axle with cargo
bed length 15 feet or greater $15.00 per load

(G) Any load including tire or waste rubber$ 5.00 addi-
tional charge
per load
(H) Large animals (cows, horses, hogs, etc.)$10.00 each
(I) Packer type garbage trucks used by private
or state agencies (based on maximum
manufacturer's capacity) $ 1.50 per cubic yd.
SECTION 9 -10 -A. CHARGE FOR COMMERCIAL OR INSTITUTIONAL SERVICE
(a) The charge for the collection and removal of garbage
trash and rubbish from premises uded for business, commercial or
institutional purposes shall be from a minimum of FIVE DOLLARS
AND TWENTY CENTS ($5.20)per month to a maximum of the actual
cost to the city of the loading, hauling, and disposing of same
plus (10) ten percent of such cost.
(c) Building or connected series of buildings containing
four (4) or more dwelling units having water billed through a
single meter will be billed as a single charge along with the
single water or sewer charge regardless of the occupancy of such
multiple dwelling unit. The charge for collecting garbage, rubbish,
and trash from apartment houses consisting of four (4) or more
units, having a single water meter shall be $ 3.50 per unit per
month. Multiple dwelling units classified as fraternities,
sororities, boarding houses and dormitories shall be charged as
a commercial establishment which require more than the minimum
service described herein and is subject to having the charges
increased by. the city sanitation division based upon the
additional service required. Any multiple dwelling unit having
individual water meters shall be billed individually at the
residential rate.
Section 10 -C CONTAINERS FURNISHED BY CITY FOR COMMERCIAL
AND INDUSTRIAL CONCERNS
Second Last Paragraph shall read:
Where more than one (1) commercial establishment uses the
same container, the charges shall be prorated according to use,
but in no case shall be less than FIVE DOLLARS AND TWENTY CENTS
($5.20) per month.
Section 2:
BE IT FURTHER ORDAINED that a new section entitled Section
9 -14 be added to Chapter 9, such section to read as follows:
SECTION 9 -14. COLLECTION CHARGES -- PRESCRIBED
There shall be charged, assessed and collected from all users
of the City Landfill, such charges for refuse and garbage disposal
services as may be determined from time to time by the City
Council fo the City of Huntsville.

Section 3:
IT IS ALSO FURTHER ORDAINED that the within ordinance
amendments shall become effective immediately upon passage.
PASSED AND APPROVED in regular open council by the City
Council of the City of Huntsville, Texas, on this the "4day
