ORDINANCE NO. 74 -20
AN ORDINANCE DETERMINING THAT A NECESSITY EXIST$
FOR THE IMPROVEMENTS OF CERTAIN STREETS WITHIN
THE CORPORATE LIMITS OF THE CITY OF HUNTSVILLE,
AUTHORIZING THE CITY ENGINEER TO APPROVE,
FILE AND ACCEPT PLANS AND SPECIFICATIONS FOR SUCH
IMPROVEMENTS TOGETHER WITH ESTIMATES OF THE COST
THEREOF AS PREPARED BY THE TEXAS HIGHWAY DEPARTMENT,
AND AUTHORIZING THE MAYOR TO ENTER INTO A MECHANIC'S
AND MATERIALMAN'S AND PAVING LIEN CONTRACT WITH
PROPERTY OWNERS, WHERE NECESSARY:
WHEREAS, the Texas Highway Department and the City
Engineer of the City of Huntsville, Texas, have made a survey of im-
provements needed for certain streets within the corporate limits of
the City of Huntsville, Texas, and reported such findings from, time
to time to the City Council and the Council having considered all of
the evidence available has determined that a necessity exists for im-
provements as recommended; and
WHEREAS, the City Council has heretofore approved by
Resolution an agreement for participation with the Texas Highway De-
partment for the paving and improvements of certain streets within
the corporate limits of the City of Huntsville, Texas, with the said
City to bear the expense and cost by assessment against abutting prop-
erty owners, only to the extent of the cost of curb and gutter and with
the remaining expense for the improvements to said street' to be paid
by funds allocated by the State of Texas to the Texas Highway Department
for such specific purpose;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF HUNTSVILLE, TEXAS, that the City Council of said City has
determined, and here finds, that a necessity exists for the paying and
improving of certain streets within the corporate limits of the City
of Huntsville, Texas, as more particularly described below:
A. To widen, pave, and install curb and gutter on South
Sam Houston Avenue from a point at its intersection with Sycamore Street
South to a point South of its intersection with Graham Road for a total
distance of approvimately 8,245.91 feet.
BE IT FURTHER ORDAINED that said project shall be in
accordance with the Resolution heretofore passed by said City Council,
to the effect that same shall be a joint project between the State of

Texas and the said City of Huntsville, Texas, in accordance with
plans and specifications prepared by the Texas Highway Department
and reviewed and approved by the City Engineer of the City of
Huntsville, Texas. The said City Engineer, is hereby directed to
prepare and file with the City Secretary said plans and specifications
for such work and preliminary estimates of the cost thereof. It is
further ordained that the Mayor of said City of Huntsville, Texas, be,
and he is hereby authorized to enter into any Mechanic's and Material -
man's and Paving Lien Contract with abutting property owners, where
applicable, in accordance with this ordinance and in accordance with
ordinances to be hereinafter enacted for such paving and improvements
of such street.
PASSED AND APPROVED in open Council by unanimous vote
on this the 42d day of November, 1974.
