TEXAS, DETERMINING THAT A NECESSITY EXISTS IN THE PUBLIC IN-
TEREST FOR THE CLOSING AND ABANDONMENT OF CERTAIN PORTIONS OF
CERTAIN CITY STREETS WITHIN THE CORPORATE LIMITS OF THE SAID
CITY,AUTHORIZING THE CONVEYANCE OF THAT PORTION OF THE CITY
STREET LYING WITHIN THE VACATED AND ABANDONED PROPERTY TO BE
CONVEYED TO THE BOARD OF REGENTS OF SAM HOUSTON STATE UNIVERSITY
FOR THE USE AND BENEFIT OF SAM HOUSTON STATE UNIVERSITY, ESTAB-
LISHING A CONDITION PRECEDENT TO THE CONVEYANCE OF ONE SUCH
STREET AND OTHERWISE ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Huntsville has for several years
monitored the growth of said City in accordance with the master
plan for the development of the City of Huntsville and in connection
therewith has cooperated from time to time with officials of Sam
Houston State University, a public institution located within the
corporate limits of the City of Huntsville, Texas, which institution
has developed a master plan for the orderly growth of said State
institution in a coordinating effort with the master plan for the
development of the City of Huntsville; and
WHEREAS, the respective master plans of the City of
Huntsville and Sam Houston State University are designed to de-
velop the University area within the limits of the City of Hunts-
ville in a manner deemed in the best interest of the public as
a whole, taking into consideration environmental, beautification,
and other related factors, including the local traffic flow and
control with the result that a determination has been made that
a portion of 20th Street, located within the said City of Huntsville
for a distance of approximately 550 feet east from the intersection
of said street with Avenue I terminates in the parking lot of
property owned by Sam Houston State University, thereby limiting
the usefulness of said street to the public as a whole and that
the construction of certain buildings within the campus of Sam
Houston State University would best be served by locating on a
portion of said Street and that by virtue thereof, a necessity
exists for the closing, vacating and abandoning of said Street
and that such action would be in the best interest of the public;
that further, a portion of 19 -1/2 Street within the said City of
Huntsville for a distance of approximately 450 feet from its inter-
section with the east line of Avenue I in said City is also similarly
situated and that the best interest of the public would be served
by abandoning, vacating and closing of said Street; and
WHEREAS, the said City Council of the City of Huntsville,
Texas, finds that all property located on either side of said 20th
Street in the area proposed to be vacated and abandoned is owned
by Sam Houston State University, but that a portion of 19 -1/2 Street
is still owned in fee simple by private individuals lathe area
proposed to be vacated and abandoned and that therefore, any such

ordinance effective to abandon that portion of 19 -1/2 Street
from its intersection with the east line of Avenue I in an easterly
direction a distance of approximately 450 feet should be conditioned
upon the acquisition of said real estate for public purposes by
Sam Houston State University.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF HUNTSVILLE, TEXAS, THAT THE FOLLOWING ORDINANCE VA-
CATING AND ABANDONING CERTAIN PORTIONS OF PUBLIC STREETS WITHIN
THE CORPORATE LIMITS OF THE SAID CITY BE ENACTED AS FOLLOWS:
Section 1. That 20th Street as it is presently used
and traveled within the City limits of the City of Huntsville,
Texas, to the extent of the width presently owned and utilized by
said City from its intersection with the east line of Avenue I,
in an easterly direction, a distance of 550 feet, more or less,
to the eastern terminal of said 20th Street at the west property
line of the paved parking lot owned by Sam Houston State University,
be vacated, abandoned, and closed as a public street, effective upon
the passage of this ordinance.
Section 2. That 19 -1/2 Street as it is presently used
and traveled within the City limits of the City of Huntsville,
Texas, to the extent of the width presently owned and utilized by
said City from its intersection with the eastline of Avenue I,
in an easterly direction, a distance of 450 feet, more or less,
to the eastern terminal of said 19 -1/2 Street; provided however,
that the abandonment and vacation of the use of 19 -1/2 Street
as a public Street shall not be effective nor become effective
until such time as all property contiguous to either side of said
Street for that portion to be abandoned is acquired for public
purposes by Sam Houston State University. Upon acquisition of
title to such real estate by Sam Houston State University, the
provisions of this ordinance shall automatically become effective
without further action upon the part of the City Council of the
City of Huntsville, Texas.
Section 3. Be it further ordained by the said City
Council that the Mayor of said City be, and he is hereby authorized
to convey by Deed of Abandonment that portion of said City street
designated herein with such deed to that portion of 20th Street
to be executed forthwith and the deed to 19 -1/2 Street to be executed
only upon fulfillment of the condition precedent to abandonment of
said Street as provided in the within ordinance.
Section 4. Be it further ordained that the City Council
of the City of Huntsville, Texas, by virtue of the facts recited
in the preamble to the within ordinance that a necessity exists

for the abandonment of said public streets and that the best in-
terest of the public as a whole would be so served by such action.
