AN ORDINANCE PROHIBITING THE BURNING OF RUBBISH OR TRASH
WITHIN THE CORPORATE LIMITS OF THE CITY OF HUNTSVILLE, TEXAS, IN
OEEN FIRES WITHOUT A PERLIT AND SUPERVISION OF THE FIRE L:ARSIIALL,
AND PRESCRIBING PENALTIES FOR VIOLATIONS.
WHEREAS, the indiscriminate burning of rubbish and trash and
the burning of open fires within the corporate limits of the City
of Huntsville has been the cause of numerous destructive fires making
calls to be made by the Fire Department requires immediate regulation
thereof.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTSVILLE, TEXAS:
SECTION 1: It shall hereafter be unlawful for any person to
burn trash or rubbish within the corporate limits of the City of
Huntsville, Texas, except in a stove or furnace or inc&nerator which
shall be completely inclosed and shall be equipped with a flue or
chimney sufficient to prevent sparks from being blown, without having
made an application twenty four hours prior thereto to the :Fire
Marshall and receiving a permit from him therefor designating the
time and place for such burning.
SECTION 2: Upon receiving an application to burn trash or
rubbish within the corporate limits of the City of Huntsville the
Fire Marshall shall make an inspection of the premises upon which
such burning is requested and if determined that such burning can be
safely done without endangering surrounding property and will be
properly supervised, he shall issue the permit required by this
ordinance.
SECTION 3: Any person violating any provision of this ordinance
shall be guilty of a misdemeanor, and upon conviction shall be punished
by a fine of not less than Five (65.00) Dollars nor more than Two
Hundred ($200.00) Dollars.
PASSED, APPROVED AND ADOPTED at the regular meeting Of the City
Council of the City of Huntsville the 6th day of September 1960, to
be effective from and after its passage and legal publication.
